GARDNER - AHLQUIST GATEWAY SUBDIVISION
VARIANCE REQUEST
FOR
RIGHT IN I RIGHT OUT ON EAGLE ROAD
This variance request is for a "right - in, right - out" access to the Gardner - Ahlquist Gateway
Subdivision on the east side of Eagle Road between St. Luke's Drive (private road) and Franklin
Road.
We support our request for this variance of the Meridian Unified Development Code with a letter
from St. Luke's Hospital. St Luke's has worked with the applicant to provide limited access to
the subject site and is supportive of the development as it will complement the existing campus
environment of St. Luke's. As is noted in their letter, they have some "capacity" available but are
careful to note that providing access that would otherwise be provided by the requested access
point on Eagle Road would create unsafe conditions for patients and emergency responders
utilizing the St. Luke's Drive intersection.
According to the Unified Development Code in Table 11-2B-1: Purpose And Allowed Use By
Commercial District, the C-G Zone (approved by Meridian Planning and Zoning Commission
on March 15, 2007) is the "largest scale and broadest mix of retail, office, [and] service...." of the
commercial zones. No commercial development of this scale can survive with only one
dedicated, on site access point. If the Eagle Road access is not permitted through this variance
application, the site will only have on on-site access point with a severely restricting "right-in,
right-out" on Franklin Road. The need for visible, onsite access is not a request that would
permit the applicant a special privilege - access is critical to the success of this development.
The site characteristics generate a hardship with respect to it's proximity to the Eagle Road and
Franklin Road intersection - safe maneuvering into the site via one access on Franklin Road is
unrealistic. A second, well engineered to safely operate within the standards of traffic
engineering will distribute the traffic entering the site more evenly and thus generate less impact
to the operations of Eagle Road and Franklin Road. The public health, safety and welfare will
protected through the application of industry design principles and a cooperative relationship
with Idaho Department of Transportation.
In addition to the support of the access point from an economic and safety perspective, it should
also be noted that this request will not be generating a new access point. In fact, this access
point to Eagle Road has existed for some time, and will simply be reengineered to increase
safety and conform to Idaho Transportation Department standards for access onto a state
highway.

St. Luke's representatives have met with the developers of the proposed commercial
development on the property of what is now known as the Montvue Subdivision. Our
meetings with Mr. Ahlquist have been very productive and St. Luke's supports his
development. In fact, we will be revisiting our settlement agreement with the Montvue
Subdivision to reevaluate the terms of the agreement in the near future. St. Luke's only
concern with this proposed development is the potential increase in vehicle trips on to St.
Luke's Road. As submitted, the increase in vehicle trips will not be a problem for St.
Luke's, and thus, will be acceptable under the Montvue Settlement Agreement. However,
if the proposed development is denied the existing entrance at Montvue Drive, the
resulting increase in vehicle trips on to St. Luke's Road will be unacceptable to St.
Luke's. Our primary concern is one of safety. If patients in distress, emergency
responders, ambulance companies, and EMS vehicles cannot easily access our campus,
there is a very real possibility of bad patient outcomes. Forcing vehicles to access the
proposed development through the existing private roadway will likely cause an
overloading of the existing roadways, potentially creating an unsafe traffic situation in
and around our campus, particularly on our private roadway system.
In summary, St. Luke's is pleased to work with Mr. Ahlquist and his group on this
proposed development. We are supportive of his development plan as submitted, and
would like to strongly encourage this development to move forward while maintain
primary access from Eagle Road through the existing Montvue Drive.

COMMITMENT OF PROPERTY POSTING
Per Unified Development Code (UDC) 11-5A-5D, the applicant for all applications requiring a
public hearing (except for a UDC text amendment, a Comprehensive Plan text amendment
and/or vacations) shall post the subject property not less than ten (10) days prior to the hearing.
The applicant shall post a copy of the public hearing notice of the application(s) on the property
under consideration.
The applicant shall submit proof of property posting in the form of a notarized statement and a
photograph of the posting to the City no later than seven (7) days prior to the public hearing
attesting to where and when the sign(s) were posted. Unless such Certificate is received by the
required date, the hearing will be continued.
The sign(s) shall be removed no later than three (3) days after the end of the public hearing for
which the sign( s) had been posted.
I am aware of the above requirements and will comply with the posting requirements as stated in
UDC 11-5A-5.
