On behalf ofRaHis -Capital, Inc. please accept the application for a Final Plat
'"Modification for the Tapestry Subdivision located on 675 S. Linder Road. Specifically,
the approved landscape plan dated October 13,2006 requires minor revisions r~arding
the fence heights and existing tree mitigation.
Approved Fencing:
The fences between Lot 2 and Lot 3, Block 1; between LoCI. and Lot 2, Block.Q; and
between Lot 2 and'tot3, Block 2; are aM shown as 4' v1nyl fence on the approved
landscape plan.
Requested F encinR;:
The aforementioned locations are requested to be r~ised to 6' vinyl fence with 3' step-
downs within 20' of the right-of-way. All of the locations are rear/side yards that would
prefer privacy and are not located adjacent to pathways.
Approved Tree Miti2ation:
The approved landscape plaI\-,indicates 3.existing trees "to remain" with all others to be
removed with no specific mitigation.

According to Elroy Huff last year prior to the preliminary plat submittal and reaffirmed
on April 11, 2007 with onsite inspections, all of the existing trees onsite ~ either dying,
.
hazardous, or within the proposed ACHD ROWand all may warrant removal without
mitigation. As such, two trees shown on Lot 1 and Lot 2 of Block 2 as ''to remain",
should have been labeled ''to be removed". Also, two trees shown within the ACHD
~right~f.:;Way as ''to be removed" are tall pine trees that wiH:he'incorporated into the
landscaping to be provided,-under::an ACHD license.agreement and will safely remain
until ACHD widens Linder Road. One existing tree will also remain as labeled on the
planWiiliin Lot 2, Rlock 1. As stich, the i*'OPosed'humBe~fex4sting,trees,io,-.retuai~~$~
is identical to the'number of trees on the approved landscape plan to remain (3), 'in
different locations.
In addition, we are proposing one new tree be add~~o",the)andscape plan, ~OD~:.the~Uth
property line of Lot 1, Block 2, to fill the gap where one ''to remain" tt:ee,Was"t'emoved
per Mr. Huffs prior approval, but was not shown as such on the approved landscape plan.
In addition, due to ACHD construction plan and license agreement comments received
after landscape plan approval, one proposed tree was removed from Lot 9, Block 2 due to
the seepage bed setback requirement of 10 feet.
