your project is in the approval process. Final approval can only take place when the final plat is

This project was put on hold and now has a different owner and different configuration.The
proposed Shafer View Ridge Subdivision now only includes parcel R7824220180 which is no longer
owned by Jim Chambers. Based on the email string below, is this sub name still valid or will we
need to reserve something not related to Shafer View? I believe the new owner would prefer to keep
the Shafer View nomenclature if possible.

Mary,
Breckon Land Design reserved Shafer View Terrace Subdivision on 10/02/2020. Since your owner had an
active interest in the name by owning a portion of Lot 4 Block 1, at that time our office allowed the
name since the original partnership that developed Shafer View Estates (Meridian 80 Partnership) no
longer appeared to be an active entity.
Since the new request for Shafer View Ridge Subdivision is a similar situation, and Shafer View Terrace
still appears to be in the approval process,the name could be approved.
In this case however, since the primary names are the same,to at least appear that the provisions of
Idaho Code 50-1307 have been considered we are going to require at least a signed, notarized and
recorded agreement between the developers of Shafer View Terrace and Shafer View Ridge, stating in
essence that each of the developers is acknowledging the other developments use of the name. In our
view this would also protect each of the projects against future challenges regarding the name
copyright.
As long as Shafer View North LLC will acknowledge the name Shafer View Ridge being used by James
Chambers and Jacalyn Thomason for their project, and Chambers and Thomason acknowledge the name
Shafer View Terrace is being used by Shafer View North LLC, I can reserve the name. If the developers
cannot work together on this, in my view it only reinforces the idea that there could be disagreements in
the future affecting both entities.
We will require this document be recorded prior to issuing the name reservation.
If the document cannot be recorded,then a new name will have to be chosen for the Chambers/
Thomason project.
