Formal Development Agreement for the Ferrington Heights Subdivision
Reasons:
The developer’s vagueness and unwillingness to answer questions and concerns particularly
pertaining to height, easements, property use and property rights.
A formal development agreement will provide certainty and clarity, thus leaving no room for
collective understanding or assumptions.
A 10-foot easement on Ferrington Heights Subdivision South, West and North
borders.
Reasons:
This easement is requested along those borders as these are directly along existing homes.
It would create a bu?er as these surrounding properties would be zoned for a lower density.
A 15-foot easement on Ferrington Heights Subdivision’s North border in which
it shares with existing home at the address 1111 N Adkins Ave.
Reasons:
1111 N Adkins Ave is zoned in Ada County and is R1. Due to this zoning the property is currently
home to: 3 mini Silkie goats, 11 free range hens, 1 Rooster, 2 Tom Turkeys, 3 Labrador Retrievers and
occasionally local coveys of Bobwhite Quail and California Quail. The extra 5 foot would help to
create more of a bu?er for land rights and usage.
This easement would help to reduce noise and smell from the animals for the future residents in
the proposed subdivision.
It also directly addresses concerns of existing residents.
A maximum number of stories limitation to 1 story. No building shall be
erected, placed, or altered to exceed one story in height above the finished
grade.
A specific vertical height limitation of 20 feet. The maximum height of any
building shall not exceed 20 feet measured from the finished grade to the roof
peak.
Reasons:
These limitations would help ensure Uniformity as Ferrington Heights Subdivision is surrounded by
single story homes. *See
These limitations would help protect and maintain Neighbor relations as the proposed subdivision
is surrounded by established home. These homes having been built in 1905, 1909, 1920, 1993 and
2001.
These limitations also help to Preserve the existing unique neighborhood character. The homes
directly surrounding the field and that are part of the existing and established neighborhoods fit
within these asked limitations.
These limitations also give Protection for existing residences and their property use and rights.
Ferrington Heights Subdivision to be limited to use of single family homes.
Reasons:
This limitation helps to preserve the character of the existing neighborhood homes. The proposed
subdivision is surrounded by existing homes, all of which are single family homes.
This limitation also helps to protect the property values of the existing homes and the future homes.
This limitation directly addresses concerns of privacy and other concerns raised by the current
residences.
