V AC-07-007 Vacation of 101,942 square feet of right-of-way (all of the existing Montvue Drive) in the Montvue Park Subdivision by Gardner Ahlquist Development. Staff has reviewed this submittal and offers the following comments: APPLICANT'S REQUEST The Applicant, Gardner Ahlquist Development, has requested the City's consent to vacate 101,942 square feet of right-of-way (all of the existing Montvue Drive) in the Montvue Park Subdivision. The Unified Development Code 11-5A-2, requires the City Council to hold a public meeting on requests to vacate right- of-way. Due to the fact that the final decision making body in right-of-way vacations is the transportation authority (ACHD), the City Council is only able to make a recommendation on the right-of-way vacation. ACHD requires the applicant to receive consent from the City Council with regards to right-of-way vacations as part of the ACHD vacation process. As the transportation authority ACHD is the [mal decision making body for this request. The subject right-of-way is commonly known as Montvue Drive and is located near the south east corner of the intersection of Eagle Road and Franklin Road. The majority of the lands adjacent to this portion of right-of-way are currently being considered by the city for Annexation, Zoning and Preliminary Plat (see AZ-06-065, PP-07-007). The second phase of this development, which includes the remainder portion of this right-of-way, has been submitted to the city for review but has not been assigned a hearing date. As part of these development applications, the applicant is proposing an alternate street network in this area that has prompted this vacation request. SURROUNDING USES North: Franklin Road and RC Willey Building, zoned C-G East: Touchmark Living Center, zoned L-O South: St. Luke's Regional Medical Center. Zoned L-O West: Eagle Road, Offices, and homes, zoned L-O and R-2 (Ada County) ANALYSIS Staff is generally supportive of this request to vacate this portion of right-of-way and replace it with a redesigned street network. With that said staff still remains concerned about the "no mans land" (see Exhibit A.3) adjacent to Lots 3 and 4, Block 1 that abuts the right-of-way used for the existing access point and frontage road that serves the homes with in the Montvue Park Subdivision. Due to the design of the existing frontage road, this right-of-way extends approximately 170 feet from the centerline of Eagle Road (SH 55) which is not consistent with the 70 feet from centerline that is established along the rest of this portion of Eagle Road (there is approximately 100 feet of surplus right-of-way). This vacation application does not specifically address this area and staff believes the applicant should provide the City Council with a clear plan as to how this area will be treated. RECOMMENDATION Staff recommends approval of application V AC-07-007 to vacate 101,942 square feet of right-of-way (all of the existing Montvue Drive) in the Montvue Park Subdivision.
