Re: Driveway Misrepresentation
Dear City Clerk,
At the August 21, 2025 Planning & Zoning hearing, an incorrect statement was entered into the
record regarding my property at 1251 NW 4th Street.
o Commissioner Perreault asked how our driveway was approved at “11 feet.”
o Staff (Sonya Allen) responded that it was “11 feet” and “substandard.”
Correction for the record:
o Our driveway is a total of 12 feet wide, not 11. It consists of 11 feet of concrete with
unpaved extensions on either side.
o The City of Meridian approved it in 2000 when our home was built and issued a certificate
of occupancy, confirming compliance with the standards in effect at that time.
o Both driveways on the south side of NW 4th Street — ours and our neighbor’s — were
constructed at 12 feet in width and approved for occupancy.
o Historically, both the City of Meridian and Ada County Fire & Building standards allowed
12-foot driveway widths for single- and two-dwelling access. This was standard for rural
and infill areas where driveways were long but served only two homes.
o A driveway approved by the City cannot now be retroactively labeled “substandard.”
o Any further reference to our driveway as “substandard” is factually false and legally
unsupportable, given that the City itself approved it and issued a certificate of occupancy.
Reliance on such a statement would render the record inaccurate and expose the City’s
decision to challenge as arbitrary and capricious.
o If this misstatement is not corrected, any reliance on it in future findings would constitute
reliance on false evidence, subjecting the City’s decision to reversal on appeal.
I respectfully request that this correction be entered into the record and addressed at the
September 18, 2025 continuation hearing so the Commission and City Council are not relying on
false or misleading statements.
