Dear Mayor Simison and City Council Members, I am writing to express my strong SUPPORT for granting In-N-Out Burger a conditional use permit at the upcoming hearing on September 9, 2025. As outlined in the Memo to Council, the Planning and Zoning Commission’s initial denial was based on two concerns: 1. The hours of operation potentially conflicting with the adjacent residential area to the west. 2. Anticipated tra?ic conflicts impacting the north-south private drive aisle serving the surrounding commercial area. Hours of Operation The applicant has proactively addressed the first concern by revising the proposed hours to close at midnight daily—matching the operating hours of the neighboring Burger King within the same shopping center. This adjustment demonstrates a willingness to align with existing community standards and should resolve any compatibility concerns. Tra?ic and Circulation The tra?ic-related objections appear to be based on speculative impacts rather than substantiated data. Neither ACHD nor ITD required a tra?ic impact study, as the public street network was already evaluated and mitigated during the original Costco development approval. Furthermore, the applicant voluntarily conducted a tra?ic queuing analysis, which confirms that the site can accommodate expected vehicle volumes without significant disruption to the private drive aisle. Additional queue observations from three existing area locations reinforce that the proposed site—twice the size of those other locations—can comfortably manage peak demand. Context and Continuity This application represents a logical next step in the development of the Lost Rapids mixed-use project, which began with Costco’s completion in 2020. In-N-Out Burger’s presence will enhance the commercial vitality of the area, provide new employment opportunities, and o?er residents a popular dining option—all within a framework that respects existing infrastructure and community character.
