There is a one-year period if the project is denied. However, if the plan is substantially different, it would not need
to wait a year before resubmission. I have attached the code section below.
“Resubmitted. No application that has been denied by the Director, the commission, or the Council shall be
resubmitted, in substantially the same form for the same use, within one (1) year from the date of denial. The
Director may waive the one-year requirement and accept a new application, where the subject property is
affected by amendments to the comprehensive plan or to this title.”

Thank you for sending the updated plan over. After some discussion with Bill, we both think the application being
remanded back to P&Z is appropriate, given the significance of the changes. There are two options for this: staff
can recommend that the application be remanded back to P&Z, or you (the applicant) can request that it be

P&Z hearing date.
In addition, I do have some questions about the new plan.
Why is Lot 2 on an island? What is the purpose of the L-shaped open space? Could this be better achieved
by holding the corner of Hardiman and Adkins?
Can you please clarify which homes will be two-story and which will be one-story? I want to make sure this
is clear for the hearing.
Lot 2 will likely need the same 10-foot easement on the north boundary of the site. This will shift the
building footprint down.

Good Morning Nick,
I wanted to get this over to you with the revisions. The biggest changes are the reduction of lots
along the West and reworking the NE corner. We are proposing the addition of 23 homes, in
addition to the 3 existing. This density reduction should nearly match or be less than the
surrounding 1 mile radius area. We are not proposing any other modifications and do want to note
there are 2-story homes at the Northwest corner of the property and across the street to the
Northeast, we will not be proposing any restrictions to the homes outside the already set
zoning regulations.
I will not be present at the Council meeting due to a conflict of another hearing, however, our Team
will have another representative present to City Council. If you could let us know if there is any
format change and due date for our presentation?

I think this addresses some of the concerns that the neighbors had. I have a feeling the R-8 lots, if 2 story,
will still cause some concerns. However, you have made some significant changes and dropped the
density, which the council may appreciate. Open space will likely be another topic, but with larger lot sizes,
this should provide larger yards for residences.
Council will ultimately decide whether they want to send this back to P&Z. It is possible that they would
send it back, but I cannot guarantee it either way.
Overall, I think the changes will be better received than the previous plan and may ease some of the
concerns from the neighbors.

Good Morning Nick,
We are kicking around the attached idea. This buffers the neighbors with R-8 and pushes the
road against the North property line, I believe this puts our density less than the surrounding 1
mile radius density. We do lose 5 lots so, we do not want to have further restrictions on size or
stories of the homes on the table if we decide to proceed this route.
First, what are your thoughts? Second, would this need to go back to P&Z?
