Meridian, ID 83642 Idaho Falls, ID 83401 To Whom It May Concern: This Narrative is being provided to describe the proposed development of Lofty Creek Park Live/Work at the property indicated above and the reasoning for a Development Agreement Modification and Rezone request. The proposed initial phase of the development includes three 5-Plex Live/Work structures at the west side of the property, with the buildings backing to S. Wells St. The live/work buildings make up 12,084 gross square feet each, with two-story units containing private rooftop patios and ranging in size from 2,346 to 2,418 square feet per unit. The individual units are arranged with commercial "work" space on the first floor and residential "live" space on the second floor. The live/work buildings are proposed to be developed as condominium units, with lot lines separating each unit along the party walls. The building is planned to be completed as a shell structure, with future owners determining individual plan layouts. Portions of the site are already developed with sewer and road base. The development is proposed to be completed in phases, with the three live/work buildings being completed under the 2997 E. DEERHILL DR. Future phases, 2B & 2C, include options for additional live-work buildings and a hotel on the east side of the parcel. Phases are described in more detail below in the rezone description. The overall design of the building type is sleek and contemporary, with clean lines and minimal ornamentation. The fagade, although generally rectilinear, is broken up by modulating vertical elements, such as the alternating dark and light panels, which add rhythm and visual interest. The fagade is also broken up horizontally by step-backs, pop-outs and the stacking of varied cladding types. Building cladding materials include modern, contemporary finishes such as stucco, cultured stone, composite wood, dark bronze window and door frames/flashing and standing seam metal roofing elements. The use of varied window arrangements/types, window grids and awnings work to indicate the residential use of the building. The Development Agreement Modification proposes adjustments to "4. USES PERMITTED BY THIS AGREEMENT" (Subsections 4.1.1 & 4.1.2) by removing the "multifamily development" use and replacing it with "live/work". The Modification will also clean up an outdated zoning designation of C- G as well as removing the L-0 zoning designation to coincide with the proposed Rezone. Previous: Per the First Amendment To Development Agreement#AZ-04-029 (Cottonwood Lane, dated 04/20/06 and recorded 05/11/06) between City of Meridian and William E. Colson, Owner/Developer, Section 4: 4. USES PERMITTED BY THIS AGREEMENT.• 4.1 The uses allowed pursuant to this Agreement are only those uses allowed under "City's Unified Code codified at Meridian City Code Section 11-2B-2 which are herein specified as follows: 4.1.1 The primary use on the Property zoned C-G shall be a hotel, motel or restaurant. 4.1.2 The primary uses on the portion of the Property zoned L-O shall be multifamily developments and/or office centers. Proposed: 4.1.1 Rezone of 6.00 acres from L-O to C-C for a mixed use development. The primary uses on the Property shall be live/work developments, office centers and/or a hotel. This application for a Development Agreement Modification is accompanied with a Rezone Application, requesting the zoning change from L-0 (Limited Office) to C-C (Commercial Business). The files, checklists and permits included in this package cover the second phase of the development previously referred to as Creek View. The first phase, being the new Holiday Inn Express, was completed in 2023. 2997 E. DEERHILL DR. MERIDIAN, ID 83642 OFFICE: (208)918-0851 CELL: (208)871-2124 01 CORNER OFFICE DESIGN This second phase shall now be called Lofty Creek Park and will be broken into three subphases: Phase 2A through 2C and will be planned and constructed on Parcel R5443010239. The Parcel (R5443010239) is requested to be rezoned from L-O to C-C and is approximately 6 acres. The Five Mile Creek/Canal runs through the parcel along with the flood plain and floodway attached to it and will be taken into consideration during the design of each of these phases to follow all required standards. The public multi-use walking path will be designed to follow the bank and will be coordinated with the controlling Canal Companies, designed and built with each phase. The General Description of each sub phase is as follows: Phase 2A will include approximately 1.65 acres of Parcel R5443010239 and is intended to be three total 5-Plex live/work condo buildings. A Short Plat will be performed to separate Phase 2A from the remainder of the parcel. Phase 213 will include some of the remaining 4.61 acres of Parcel R5443010239 and will include the option for additional live/work units. Phase 2C will include the final portion of the existing parcel and is expected to include the necessary parking and support infrastructure for a proposed hotel. The proposed Development Agreement Modification and Rezone will allow the owner maximum flexibility in developing the site with a live/work product as well as protecting the option for building additional live/work buildings and a hotel based on future market conditions.
