I am copying the City Clerk's office so that your comments can be included in the public record so that other council members have the benefit of your input. And, I wanted to let you know that due to a noticing error by the applicant, the City Council will be continuing the hearing to Tuesday, September 9, 2025. At tomorrow's City Council Regular Meeting, we will formally continue the hearing to that date. Please note that there will be no conversation about the application and no public testimony will be taken regarding the In-N-Out Burger (CR-2025-0002) application on August 12. Noticing for the new date of September 9, 2025, will be posted as required by City Code. Thank you, again, for sharing your comments. Good evening Councilman Whitlock. I am writing to express some concerns about an In-N-Out being built by the Costco at the corner of Ten Mile and Chinden. The Planning and Zoning Committee said no, and now they are appealing to the city council, which includes you. Please do not let the construction of this go through. That section of Ten Mile and Chinden is already busy enough with traffic because of Costco and the other businesses there. Chinden itself is already a busy as it is. There is also a risk of people parking in the church parking lot across the street due to a lack of parking that already exists. Customers and employees of In-N-Out and the other businesses in that commercial area are likely to hinder church goers of parking in the parking 1 lot of said church during hours of worship and other church functions. There is also the increased risk of disturbance for those in the apartment complex behind Costco and the surrounding neighborhoods due to noise late at night from employees, customers, and delivery vehicles. There are three schools close by, one of which is located just off Chinden in the Lochsa Falls subdivision. That is just up Chinden as you head towards Linder. This will create more traffic in that area during the school year. Rocky Mountain High School isn’t too far either, and if In-N-Out were to open in the proposed location, there would be an increased risk of accidents during lunch time as students rush down Chinden, Ten Mile, and through the neighborhood streets to quickly get to In-N-Out or one of the other restaurants in that area. Heroes Park is close by, which has a playground, basketball courts, and large soccer fields. Increased traffic can be a hazard for those going to and from the park via Ten Mile, as well as residents of the surrounding area. Those representing In-N-Out have said that traffic concerns should not be considered. That is a selfish, greedy way of saying they don’t care about the safety, time, and lives of members of this community, so long as they get their profit. I understand that with increased growth in the city there is going to be an increase in business. They can build an In-N-Out over in the commercial development off Ten Mile across from Scheels as you head towards the freeway entrance and exit. Please pass these concerns on to your fellow councilmen and councilwomen as you consider In-N-Out’s appeal.
