I am copying the City Clerk's office so that your comments can be included in the public record for the benefit of other Council members. Due to a noticing error by the applicant, we will not be taking any action on this agenda item this evening - other than to continue the hearing to Tuesday, September 9, 2025. There won't be any other conversations about the matter or testimony taken. Public notices of the new hearing date on September 9 will be posted as required by City Code. Councilman Whitlock, I respectfully ask that you and the other council members support the City Planning and Zoning Commissions decision and deny the appeal of In-n-Out Burger to build a restaurant at Ten Mile and Chinden Blvd. In-n-Out says traffic should not be considered but it has to be. When their location at Fairview and Eagle opened it created a tremendous amount of traffic congestion. With the growth and current infrastructure, traffic congestion is important. Ten Mile and Chinden already has an E grade. I’m sure it’s not too far from F. In-n-Out has stated that their hours of operation and receiving deliveries is standard across all locations and adherence is vital to their business operations. That does not sound like they are willing to compromise. 1 That area is primarily residential and not commercial. The traffic and noise generated by their hours of operation would be a great disturbance to the neighborhoods and residents and their quality of life and safety should be the primary consideration and they too are overwhelmingly opposed to In-n-Out building on that location. Please listen to the citizens of the city whom you have been chosen to represent and serve and deny their appeal.
