-- To whom it may concern. My name is Matt Rodriguez a ( native Idahoan ). I live in the Bainbridge
neighborhood that backs up to the empty lots and the Costco at the intersection of Ten mile and
Chinden. My voiced concerns are regarding the In and Out Burger that potentially might be going in at the
intersection of lost rapids and Tenmile. It has come to my attention that the surveys done by the
business were survived incorrectly during low period times and only through a 3 day period. Also during
the months of december in which that intersection and business is naturally slower during that time of
year. It comes with great concern that the operating hours of this business are far beyond the hours of a
residential neighborhood for safety. ITD along with the ACHD had reviewed tenmile traffic as a whole in
the year 2024, resulting this stretch of the road a grade of an F. The traffic alone will result in congestion
in this area which is already a concern for children going to and from school. Reviewing their other local
locations, they are constructed in and around proper business parks due to the size of the expected
traffic from walking and driving patrons. It is a notated fact that once these restaurants start conducting
business, there is an increased number of cited crimes including but not limited too car break ins,
property damage, theft and armed robberies.Please google this! Last year this company decided to close
its very 1st ever location in the state of california DUE to CRIME. I ask for the city to take in these
considerations from the hard working Americans that only wish to raise our families in a safe residential
environment. We are asking that the proposal from the city be DENIED and moved to a more proper
location. The business model of operating hours of being open until 1AM are propeostures. If you have

our office. As you may be aware, the City does not determine which food service or business locates at a property,
the City regulates the land use of various properties while businesses decide to locate at given sites or areas
based on market conditions.
Because this project is part of an open application, the Mayor and City Council members are prohibited from
commenting outside of the public hearing. We take public feedback seriously and want you to know that we have
