FP-01-006 ORDER OF CONDITIONAL APPROVAL OF FINAL PLAT This matter coming before the City Council for Final Plat approval pursuant to Meridian City Code § 12-3-7 on May 15, 2001, and the Council finding that the Administrative Review is complete which has included certain conunents and conditions as stated in a letter to the Mayor and Council from David Mclrdnnon, Planner for the Planning and Zoning Department, and Bruce Frecldeton, Engineering Technician III, listing 5 General Comments and 12 Final Plat Comments, which are herein found fair and reasonable, and that Shari Stiles, Planning and Zoning Administrator, and Gary Smith, Public Worlcs Director, both commented at the hearing, and Matt Schultz appeared and testified on behalf of the Applicant, and the ORDER OF CONDITIONAL APPROVAL OF -- FINAL PLAT FOR MURDOCH SUBDIVISION NO. 2 BY: HOWELL-MURDOCH DEVELOPMENT CORP. (FP-01-006) PAGE 1 OF 3 Council having considered the requirements of the preliminary plat the Council takes the following action: IT IS HEREBY ORDERED THAT: 1. The Final Plat of "MURDOCH SUBDIVISION NO. 2", as evidenced in Plat beating the File name: "PLAT SHOWING MURDOCH SUBDIVISION NO. 2, A PORTION OF THE SW 1/4, NE V4, SECTION 18 TOWNSHIP 3 NORTH, RANGE 1 EAST, BOISE MERIDIAN MERIDIAN, ADA COUNTY, IDAHO 2001, 11643FPI.DWG, 3/23/01, SHEET 1 OF 2, HOWELL- MURDOCH DEVELOPMENT CORPORATION OWNERJDEVELOPER, J-U-B ENGINEERS, INC.", Howell-Murdoch Development Corporation, Developer, is Conditionally Approved subject to those conditions of Staff comments as set forth in the Memorandum to the Mayor and City Council from Bruce Freckleton, Engineering Technician III, and David Mclrdnnon, Planner for the Planning and Zoning Department, dated May 10, 2001, listing 5 General Comments and 12 Site Specific Comments, a true and correct copy of which is attached hereto marked Exhibit "A", and consisting of 3 pages, and by this reference incorporated herein, with the additional requirements from the action of the City Council at their May 15, 2001 meeting, as follows, to-wit: Final Plat Comments: ORDER OF CONDITIONAL APPROVAL OF -- FINAL PLAT FOR MURDOCH SUBDIVISION NO. 2 BY: HOWELL-MURDOCH DEVELOPMENT CORP. (FP-01-006) PAGE 2 OF 3 1.1 (Number 2.) Delete the second sentence so that 2. shall read as follow: 2. The City of Meridian shall be added to the signature page of the final plat as one of the landowners. Add note to the face of the plat that states that the City of Meridian owns this lot. 1.1.2. (Number 4.) Delete the word etc. so that 4. shall read as follows: 4. A letter of credit or cash surety in the amount of 110% shall be required for all landscaping, pressurized irrigation, sanitary sewer, water, and street lights, prior to signature on the final plat. 1.2 Meridian Fire Chief, Kenny Bowers, requires all codes, including fire hydrants, water supply and fire sprinkler systems, shall be met. 1.3 The Nampa & Meridian Irrigation District requires the final plat shall indicate the relocation of the Nampa and Meridian Irrigation District's Hunter Lateral, and that all License Agreements shall be in place. 1.4 The Central District Health Department requires after written approval from the appropriate entities are submitted, they can approve this proposal for central sewage and central water; that plans must be submitted to and approved by the Idaho Department of Health and Welfare, Division of Environmental Quality for central sewage and central water; that run-off is not to create a mosquito breeding problem; and it is suggested that stormwater be pretreated through a grassy swale prior to discharge to the subsurface to prevent impact to groundwater and surface water quality; or if other means of pretreatment of storm water discharge is provided, then Applicant shall furnish to the Public Works Department a copy of the proposed Operation and Maintenance Manual, including a schedule of regular maintenance for the drains. The engineers and architects should obtain current best management practices for stormwater disposal and design a stormwater management system that is preventing groundwater and surface water degradation. Manuals for guidance: 1.4.1 State of Idaho Catalog Of Stormwater Best Management Practices For Idaho Cities And Counties. Prepared by the Idaho Division Of Environmental Quality, July 1997. 1.4.2 Stormwater Best Management Practices Guidebook. Prepared by City of Boise Public Works Department, January 1997. 2. The final plat upon which there is contained the Certification and signature of the City Clerk and the City Engineer verifying that the plat meets the City's requirements shall be signed only at such time as: 1. The Plat dimensions are approved by the City Engineer; and 2. The City Engineer has verified that all off-site improvements are completed and/or the appropriate letter of credit or cash has been issued guaranteeing the completion of off-site and required on- site improvements. We have reviewed this submittnl and offer the following comments, as conditions of the applicont. These conditions shall be considered in full, nnless expressly modified or deleted by motion of the Meridian City Council: LOCATION Thc parcel is located on the west side of Locust Grove Road, ¼ rvaqe south of Franldin Road. SURROUNDING PROPERTIES North: Proposed Woodbridge office building, zoned L-O and Medim011t Subdivision, zoned I-L. South: Vacant land, zoned RUT (,~Ma County). East: Woodbridge Subdivision, zoned R4. West: Murdoch Subdivision No. I, zoned C-G and Idaho State Police headquarters, zoned FINAL PLAT COMMENTS Sanitary sewer to this site shall be via extensions ~om existing mains in Locust Grove Road and Murdoch Subdivision No. 1. Water service to this site shall be via extensions ~om existing mains in Locust Grove Road, Murdoch Subdivision No. 1, and Medimont Subdivision Subdivision de~i~ner to coordinate msba Si~ing and roufi~ with the Public Works Department. The lots vdthin this development will be subject to applicable latecomer fees. Latecomer fees shall be due and payable prior to signature on the final plat. The City of Meridian shall be added to the signature page of the final plat as one of thc landowners. A corrected legal desuxipfion shall be included to reflect that the City of Meridian owns land to be recorded as Lot 8 of Block 2. The landscaping of the common areas shall be installed as submitted on the landscape plan (LD.1, 4-17-01). Three copies of deta~ed irrigation performance specifications shall be submitted for approval by the planning and Zoning staffprior to signing offon the Final Plat. A letter of credit or cash surety in the mount of 110% will be required for all landscaping, pressurized irrigation, sanitary sewer, water, etc., prior to signature on the final plat. In accordance with City Ordlnan~e 12-13-$-1, underground year-round pressurized irrigation must be provided to all common lalldscap~ aroes on site. Applicant .qhall be required to utilize any existing surface or well water for the primary source. If City water is proposed as a secondary source, developer shall be responsible to pay water assessments for the common landscaped areas. Applicant has not indicated whether the pressurized inigation system within this development is to be owned and malnIained by an association or the Nampa & Mea'idian Irrigation District. If the system is being proposed as a private system, plang and specifications for the irrigation system shall be reviewed by the Public Works Depm~uuent as part oftbe development plan review process. Buffers between land uses on the southern subdivision boundary will be handled on a site-by- site basis as development occurs. Sidewalks ~hall be detached a minimum of 5-feet from the future edge of curb along Locust Grove Road. A waiver has been granted by the City Council to the Meridian Police Station property. The proposed piping of the Hunter Lateral shall extend upstream to the existing check structure in order for the piping to be acceptable. Coordinate fire hydrant placement with the City of Meridlan Public Works DeparUnent. 2. Two-hundrecl-fffiy-watt high-pressure sodium streetiights will be required at locations Mayor & City Council May 11, 2001 Page 3 designated by the Public Works Department. All streetlightq shall be installed at subdivider's expense. Typical locations are at street interse~ious nnd/or fire hydrants. AH irrigation ditches, laterals or en~ql~ exclusive of natural waterways, intersecting, crossing or lying adjacent and contiguous to the area being subdivided shall be tiled per City Ordinance 124-13. The ditches to he piped should be shown on the site plans. Plans will need to be approved by the appropriate irrigation/drainage disttict, or lateral users association, with written confirmation of said approval submitted to the Public Works Depat'm~ent. The applicant has requested a waiver of this requirement along the Hunter Lateral Any existing domestic wells and/or septic systems within thi~ project will have to be removed t~om thek domestic service per City Ordinance Seetious 9-14 and 94-8. Wells may be used for non-domestic purposes such as landscape irrigation. 5. Five-foot-wide sidewalks and pedestrian walkways ~hali he provided in accordance with City Orrllnance Section 12-5-2~K.
