ORDER REVOKING
CONDITIONAL USE PERMIT
The above entitled matter came on for public hearing on February 11, 1997,
before the City Council, at the hour of 7:00 o'clock p.m., the Applicant appeared
through its representative, Steve Williams and Melissa Leclerc, the Planning and
Zoning Commission of the City of Meridian duly considered the evidence and
approved the Conditional Use Permit Findings of Fact and Conclusions of Law and
Decision and Recommendation.
IT IS HEREBY FOUND:
1. That the previous owner of the property in 1997 was Joan D. Priest who
sold the property to D.D.&,F., an Oregon general partnership, on April 15, i997,
recorded Warranty Deed as Instrument No. 97029709, records of Ada County,
Idaho. At that time, the application for the conditional use permit was to develop
said property by Prestige Care, Inc. for an assisted living facility.
2. That D.D.& F., an Oregon general partnership, sold a portion of the
property on June 12, 2000, to D.W. Inc., an Idaho corporation, who is the present
owner of said property, recorded Warranty Deed as Instrument No. 100047144, Ada
County Recorder's office on June 16, 2000.
IT IS HEREBY ORDERED:
1. That the original conditional use permit for the subject property is
hereby revoked due to the fact that it is physically impossible to construct the
assisted living facility that was contemplated under the original conditional use
permit.
