The protest filed with the lity lerk, concerning L.I.D. #1, was explaired by Elwyn
Larson, attorney representing Ediiii a Henson, u ho claimed that notice to be mailed to party
of L.I.D. w2911and 50-2910 were in arror, and also noted that Mrs. Henson' property
did rot ab tt the line improvement.
The M or commented concern ng the protest by explaining the mane r of her hook up
being to a line owned by Earl Co yell and not her own line all th way to the trunk or
lateral line.
Severa issues were explained almost the same as appeared in the fledFrotest, by
` Mr. rson nd answered by the Mayor Ind City Attorney.
The Ci y Attorney, John Child, discussed the protest *section by section, in answer
to Mr . Lars n.
Consid rable discussion was held concer ing aspects of this 'Local Improvement
Dist ict and explainations of statute statutez and intentions. The Counc 1 feels that the line
is necessary for the growth of M ridian and that it must be a program that s uld
succ ed is evidenced by only one prot st being registered at this hearing.

AN ORDINANCE ANNEXING CERTAIN REAL PROPERTY WHICH I5 DESCRIBED AS' THE NEB OF THE
NWA OF SECTION 12, TOWNSHIP 3 NORTH, RANGE 1 WEST, B.M. , IN ADA COUNTY, STATE OF
IDAHO, TO THE CITY OF MERIDIAN, WHICH PROPERTY IS ADJACENT AND CONTIGUOUS TO THE
CITY OF MERIDIAN, ADA COUNTY, IDAHO.
WHEREAS, The' City Council and the Mayor of the City of Meridian, have con-
cluded that it is in the best interests to said City to annex to daid City certain
real property which is described as the NEB of the NW}4 of Section 12, in Township
3 North, Range 1 West, B.M. , in Ada County, State of Idaho, which said property
lies adjacent and contiguous to the City of Meridian, Ada County, Idaho, and;
WHEREAS, The Joint Class A School District No. 2, Ada and Canyon Counties,
State of Idaho, having given its written consent for the annexation of said pro-
perty, the Joint Class A School District No. 2, Ada and Canyon Counties, State of
Idaho, being the legal titleholder of the said property and said property con-
taining more that five (5) acres.
NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF
MERIDIAN, ADA COUNTY, IDAHO, UNDER AUTHORITY OF SECTION 50-303, IDAHO CODE:
Section 1. That the aforementioned real property which is described s

be, and the same is hereby annexed to and made a part cif the City of Meridian, Ada
County, Idaho.

agencies and offices as required by law and according to the practices of the
Clerk.
Section 3. This Ordinance shall be in full force and effect from and after
its passage, approval and publication as required by law.
Passed by the City Council and approved by the Mayor of the Casty of
Meridian, Ada County, Idaho, this 4th day of October, 1965.

Dear John:
Enclosed is a description for a proposed sewer line easement to
the Henson and Banks property across the Coryell property, and also a
description to the DeWard property across the Coryell property. The
descriptions are shown in red pencil on the enclosed map.
Following are general descriptions of the improvements as needed to
be included in the revised Resolution of Intention for the LID:
On page 2 of the Resolution, after Section 2(2), insert the
following:
(3) Along an easement beginning at a point approximately
340 feet South of the North line of Section 18, Township 3 North,
Range 1 East, Boise Meridian, and 325 feet East of the West line
of said Section 18 and running in an Easterly direction 15 feet,
more or less, to a point of ending.

(4) Along an easement beginning at a point approximately
383 feet South of the North line of Section 18, Township 3 North,

COMES NOW EDNA E. HENSEN, by and through her attorney,
A. ELWYN LARSON, of Nampa, Idaho, and shows as follows :
I.
That she is the owner of the following described real
property located in the City of Meridian, County of Ada, State
of Idaho, to-wit :
All that part of Lot 1 , Sec. 18, T. 3N. 1 R. 1E. 1 of
the B.M. , in Ada County, Idaho, described as follows :
Commencing at the NW corner of Lot 1 in Sec. 18, T.
3N. , R. 1E. , B.M. , and running thence South along the
West line of said section a distance of 328.8 feet to
a point , the real place of beginning; thence North

That she has received a Noiice from Harold J. Cox, City
Clerk of Meridian, Idaho, wherein she was advised that the City
Council of Meridian, Idaho, had adopted an Amended Resolution
declaring the intention of the City Council to create a Local
Improvement District ; that she anticipates that the Local Im-
provement District so intended to be created will encompass the
real property now owned by her and subject said real property

to any valid assessments made pursuant to law by reason of the
creation of said Local Improvement District.
Ill.
That the said Edna E. Hensen does hereby protest the
inclusion of her said real property within the boundaries of
said proposed Local Improvement District No. 1 for the follow-
ing reasons :
1. That the formation of any such district as has been
proposed will be unlawful and improper if based upon the resolu-
tions heretofore passed by this Council, as to -,--he real property
owned by the said Edna E. Hensen, or any other real property,
for the reason that neither the original Resolution nor the
Amended Resolution relating to said proposed Local Improvement
District No. 1 have contained an accurate description of the
property to be encompassed within the boundaries of the pro-
posed Local Improvement District No. 1 .
2. That the formation of any such district as has been
proposed, insofar as the same might include the real property
hereinabove described, would be unlawful and improper for the
reason that said Resolution and Amended Resolution heretofore
passed relating to said district declare said improvements as
proposed to be original improvements , when in fact, said im-
provements as proposed would be re-improvements of the real
property hereinabove described for the reason that said real
property owned by the protestant , Edna E. Hensen, is already
serviced by a sanitary sewer Line presently operating in good
condition, said existing line being a part of the city of
Meridian Sanitary sewer system.
3. That the formation of any such proposed district ,
which will include the real property owned by the protestant
which is hereinabove described, will be improper and unlawful
if the creation of said district and the assessment of costs

thereunder shall fail to credit -the property owned by the pro-
testant with the value of the existing sanitary sewer facility,
that is to say, notwithstanding the foregoing points of protest,
any assessment which might otherwise lawfully be made by virtue
of a Local Improvement District as proposed would be improper
without the Council of the City of Meridian giving full recog-
nition to the value of the existing sanitary sewer improvements
in calculating the amount of benefits which would otherwise be
derived from the proposed improvements as the same relate to
the real property oP the protestant.
WHEREFORE, having shown good and sufficient reason for
the exclusion of the protesLant ' s property from the boundaries
o' said district , the protestant , Edna E. Hensen, doe: hereby
respectfully request that upon a hearing of the within protest ,
the City Council of the City of Meridian,$da County, Idaho,
exclude the above described real property from the boundaries
of the proposed Local Improvement District No. 1.
