and appropriate action was taken (special minutes attached).

MINUTES OF A REGULAR MEETING OF THE MAYOR AND COUNCIL
OF THE CITY OF MERIDIAN, ADA COUNTY, IDAHO E
HELD ON 2 AUGUST, 1965, AT 8 : 00 O'CLOCK P.M.
The Mayor and Council of the City of Meridian, Ada County,
Idaho , met in Regular Meeting at the regular meeting place in the
City Hall in Meridian, Idaho, on 2 August, 1965 , at 8: 00 o 'clock,
P.M. , pursuant to previous order of the Council and as authorized
by statute, there being present upon roll call the following
members of the Council, constituting a quorum and being a majority )
of the Council, viz :

The meeting was called to order by the Mayor who announced
that one of the purposes of this meeting was to hear protests ,
if any, of the creation of a Local Improvement District for the
construction of sanitary sewers with the necessary manholes and
appurtenances along certain public sewer easements and in parts
of certain streets within the said City, to be known as LOCAL
IMPROVEMENT DISTRICT NO. 1.
The Clerk informed the Mayor that 4ZL. protests had been
filed, and that this number of protests constituted less than
two-thirds of the abutting, adjoining, contiguous, and adjacent
lots andlands within the proposed district.
WHEREUPON the following Resolution was introduced by Council-
man who moved its adoption, which motion was
seconded by Councilman thereupon at the direction
of the Mayor said Resolution was read in full by the Clerk, the

BE IT RESOLVED by the Mayor and Council of the City of

Meridian, that they have examined the Affidavit of Publication of
Notice of Intention which is on file in the office of the City
Clerk, relative to the creation of proposed Local. Improvement
District No. 1 for the consturtion of sanitary sewers with the
necessary manholes and appurtenances , along certain public sewer
easements and in parts of certain streets within said City, in the
City of Meridian, Idaho. That the City Clerk mailed a copy of thel
Notice of Resolution and Notice of Hearing Protests to each owner
within the proposed District, and that an Affidavit of Mailing of
Notice of Resolution of Intention to create said Local Improvement
District No. 1 is on file in the office of the City Clerk, and
that said Resolution of Intention passed by the City Council on
12 July, 1965 , be, and the same is hereby confirmed.

The foregoing Resolution having been considered by the members

of the Council present, and the passage of the Resolution having

been moved and seconded, the same was submitted to an AYE and NAY

vote of the members of the Council present, which vote , being
recorded by the Clerk, resulted as follows :

The Council further found that the Resolution of Intention
to be proper, that the District will be for the best interests of
the property affected and the City and that there is reasonable
probability that the obligation of the District will be paid.
Upon motion duly made, seconded and carried unanimously,
the meeting adjourned.

Gentlemen;
At the request of the City Clerk, Mr. Harold Cox, an inspection
was made July 28, 1965, of the Leona Kennedy property located at 322
East Idaho Street in Meridian by sanitarians of this department .
The house is of board and batten single wall construction with
no lock on the front door allowing easy access. The inside is lined
with cardboard cartons. The floors are badly rotted and in weakened
condition. There are no fixtures in the toilet and the orangeburg
toilet stub is open to the atmosphere which could allow dangerous
and explosive sewer gases to accumulate inside. The cellar door is
in a weakened condition and there is danger of it collapsing under
even light weight. The cellar contains several inches of water and
the true condition of the floor joists could not be determined
because of this. However, from the give and slope of the floor when
walking upon it, there is danger of it breaking through.
This house in our opinion is an attractive nuisance and health
hazard due to the defects outlined and should be condemned and
removed

Gentlemen:
I have inspected the premises of 322 East Idaho Avenue and find
the building; in such a state of disrepair that it could never be ren-
ovated to a livable condition.
The structure itself is of slab and batting single wall construc.
tion with no upright bearing, wall studding. The ceiling insulation
is paper and card board nailed here and there. The walls show little
or no attempt at insulation of any k;--d. The floor is bi~ealcing down
with dry rot with several holes now visable. There is a celler under
the structure that stands with water and the richetty outside, ground
level, doorway entrance would collapse if stepped on and could cause
children or anyone to fall down and into the water of the teller.
The plumbing fixtures hav_ all, been removed leaving the openings
with the danger of sewer gas and continual odor problems. The sewer
lines are of orangeberg and show Flaking and decomposition (ordinance
requires cast iron) .
The chimney consists of steel stove pipe held up by guy wires and
a single roof Jack.
The building is left open and unlocked an windows are broken
allowing easy access for children who could fall through the floor.
The roof is sagging in several places and the interior si;ows in-
dication that very little weather is turned by this roof.
The building, as it stande,now, is of little or no value to anyone
and would be too costly to renovate.
I recommend that the building :,e torn down, removed and the hole
filled as a safety precaution.

RESOLUTION OF INTENTION

A resolution declaring the intention of the City Council of
the City of Meridian, Idaho, to construct sanitary sewers, with
the necessary manholes and appurtenances, along certain public
sewer easements and in parts of certain streets within said City;
to create Local Improvement District No. 1 for Meridian, Idaho,
for the purpose of making said improvements; to defray the cost
and expenses of said district and of said improvements by special
assessments to be levied and assessed upon the property benefited
by such improvements; declaring said improvements to be original
improvements; stating the estimated total cost of such improvements
and the kind and character thereof; fixing a time in which protests)
against the proposed improvements or the creation of such district
may be filed in the office of the clerk; fixing a time when such
protests shall be heard and considered by the council ; and direct-
ing notice thereof to be given.
Whereas, the City Council of the City of Meridian, Idaho ,
deems it to be for the best interests of the City to construct
sanitary sewers, with the necessary manholes and appurtenances,
within the corporate limits of the City and along the public sewer
easements and parts of streets hereinafter particularly described;
and
Whereas, the City Council of the City of Meridian, Idaho ,
deems it necessary and desirable to create "Local Improvement
District No. 1 for Meridian, Idaho, " for the purpose of making
said improvements and providing for the payment of the cost and
expenses thereof ; and
Whereas, the estimated total cost of said district and of said
improvements is the sum of $13,500. 00, of which cost, in the

judgment of the City Council of the City of Meridian, it is f air
and equitable that no portion thereof be borne by the City from f
its general funds; and
Whereas, the City Council proposes to defray the cost and

expenses of said improvements to the extent of $13,500.00 by
special assessments to be assessed against the property benefited
by such improvements and included in the improvement distract to
be formed;
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF
THE CITY OF MERIDIAN, IDAHO:
Section 1. The City of Meridian, Idaho, does hereby declare
its intention to construct sanitary sewers, with ihe necessary
manholes and appurtenances, along certain public sewer easements
and in Darts of certain streets in the City of Meridian as herein-
after set forth and to create a local improvement district in the
City of Meridian to be known as "Local Improvement District
No. 1 for Meridian, Idaho, " the cost and expenses of which are to
be levied and assessed upon the property benefited by such
improvements.
Section 2. The points between which said improvements are
to be made are stated to be the following:
(1) Along aneasement from the existing eight--inch
sewer line on Cottonwood Avenue (U.S. Highway No. 30) , beginning
at a point that is approximately 325 feet East of the Northwest
corner of Section 18, Township 3 North, Range 1 East, Boise
Meridian; thence in a Southerly direction 1280 feet, more or
less, to a point of ending which is 315 feet East of the Westerly
boundary of said Section 18, said point being in the right of
way of the street running along the Southerly boundary of Lot 1
of said Section 18.

(2) Along an easement beginning at a point approximately!
995 feet South of the North line of Section 18, Township 3 North,
Range 1 East, Boise Meridian, and 315 feet East of the West line
of said Section 18 and running in an Easterly direction 240 feet,
more or less, to a point of ending near the Easterly right of way
line of East First Street, said point being approximately 1002
feet South of the North line of said Section 18 and 555 feet East
of the West line of said Section 18.
Section 3. Protests against said proposed improvements or
the creating of such district to be formed may be filed in the

this resolution and of the time within which protests against said
proposed improvements or the creating of such district may be
filed and the date when such protests will be heard and considered
by the Council describing the general character of the improve-
ments proposed to be made and the estimated total cost thereof and
shall therein refer to this resolution on file in his office for
further information in regard thereto. Said notice shall be
published in one (1) issue of the weekly paper, The Meridian News--
Times, the official newspaper of the City of Meridian; and a copy
of such notice shall be mailed to each owner of property located
within the limits of said proposed improvement district if the
owner be known or to his agent , if his agent be known, addressed
to such person at his post office address, if known, or if his
post office address be unknown, to the post office in Meridian,
Idaho. The Clerk shall cause the last publication to be made,

The Clerk having read the foregoing Resolution of Intention
in full and the same having been considered and discussed by the
members of the Council present at said meeting, the motion for
the adoption of said Resolution of Intention was seconded by
Councilman b-yj ly4. V4.Yro and the adoption thereof was sub-
mitted to the members of the Council present , and upon an AYE and
NAY vote duly had and recorded by the Clerk, the vote thereon
resulted as follows :

NOTICE IS HEREBY GIVEN that on the 12th day of July, 1965:
the City Council of the City of Meridian, Idaho, adopted a
Resolution declaring the intention of the City Council to create
a Local Improvement District in the City of Meridian; and,
NOTICE IS FURTHER GIVEN that the time within which protests
may be filed against said proposed improvement or against the
creation of said District has been fixed as the 2nd day of August,
19657 at 8 :00 o ' clock P.M. , and that a hearing will be held by
the City Council on all protests so filed, on the 2nd day of
August, 1965, at 8 :00 o' clock P.M. , at the City Hall in the City
of Meridian, Idaho ; and,
NOTICE IS FURTHER GIVEN that the general character of the
improvements or improvements proposed to be made, are the construct-
ion of sanitary sewers with the necessary manholes and appurten-
ances, along certain public sewer easements and in parts of
certain streets within said City, and the estimated total cost
thereof is $13,500.00.
REFERENCE to said Resolution, which is on file in the
