BE IT ORDAINED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF MERIDIAN, STATE OF IDAHO. That from the effective date of this Ordinance the following described platted property is vacated: That portion of East 4th Street lying between Blocks 7 and 8 of the Plat of Cottage Home Addition to Meridian, Idaho, as it runs from the southerly boundary line of Carlton Avenue (Carlton Street) to the northerly boundary line extended of the alley in said Blocks 7 and 8 of Cottage Home Addition. This Ordinance shall be in full force and effect 30 days from and after its passage, approval and publication as provided by law. The new rate -schedule will be ;as follows: 1) For pick-up from street or alley, $1.45 per month. (Former rate was $1.30.) 2) For carry out from other than alley or street, $1.95 per month. (Former rate was $1.80.) 3) Collection fee from duplex or apartment location, an increase of 15c per month above former rate. Under city ordinance, use of trash hauling service is required for all residences. Anyone desiring to change type of service—either from or to carry-out—is re- quested to ndtify the trash hauler and the Meridian city building not later than July 20, 1965--as the new rates will appear on the billing at the end of July. Meridian, Idaho Gentlemen: In April of this year I wrote you concerning the matter of the ordinance and granting of a franchise in your city for KTVB, Inc . , and Boise Valley Broadcas- ters, operating television station KBOI . Very shortly thereafter the Federal Communications Commission issued a "Notice of Inquiry and Proposed Rule Making Relating to CATV" issued April 29 , The proposals of the Federal Communications Commission, which had not previously determined that it assumed jurisdiction over these operations , were rather widespread. In addition to this , proposals of regulation of these enterprises have been made and hearings had in the Congress of the United States . Also, several lawsuits are pending relative to copyright violations, etc. , for determina- tion of these items . The League of National Cities has issued a special bulletin to its member cities making various recommendations concerning CATV, among them being, "Postpone final action on any CATV application until the FCC makes a final determination of its authority to regulate CATV." Our clients recommend that your city follow such recommendation, provided, however, that the application which we forwarded in April Mayor and City Countil June 10 , 1965 Page 2 remains in the status quo as having been filed. When the FCC situation has been resolved and/or Congressional action has been taken, we believe that all parties will be able to proceed more intelligently with proper franchise regulations . There may be other applications which desire immediate action, and should this be the case, we would appreciate being notified of any intention on your part so to do.
