RE: MI 07~003 removal ofltem 6.1 in the Development Agreement
Dear Mr. Berg and City Council Members:
My name is Diane Bagley. My family owns property and a building due north of
Sparrowhawk Subdivision at 1901 Lanark St., Meridian, ill 83642. We have owned and
operated this property as a rental since 1996.
As of May 2006 we had never had stormwater runoff enter our property, from the
Sparrowhawk property, despite a significant downward slope from south to north where
the two properties join. Last May, disturbance to the soil on the slope, by the
Sparrowhawk developers, and two rain storms caused large amounts of stormwater to
flood onto our property and into our rental building. Significant damage was incurred by
our tenant, and mold developed in our building.
In talking with Mr. Waldren and Mr. Sweig, they indicated that their grading of the slope
was intended to channel water into a retention pond at the base of their hill. It is clear
that the grading they preformed and the pond they installed were not adequate to retain
storm water on their property. In researching this matter, I talked with Bruce Spreklton at
the City of Meridian Public Works Department, and he indicated that the Sparrowhawk
Development did not have an approved grading plan for the changes they made to the
slope prior to the two floods.
Grading the slope and installing an inadequate retention pond, without prior City
approval, are of great concern to us as a neighbor of this development project. Therefore,
we encourage the City Council to deny the request to remove item 6.1 in the
Sparrowhawk Development agreement and hold this development to the highest standard
of oversight.
