Lucy Leavell (File No. CUP-02-040).
We have reviewed the above-referenced submittal and offer the following comments, as
conditions of the applicant. These conditions shall be considered in full, unless expressly
modified or deleted by motion of the Meridian City Council:
APPLICATION SUMMARY & BACKGROUND
The applicants, Bill and Lucy Leavell, have requested the rezone of a rectangular piece of
property, located at 1425 N.E. Fifth Street (just north of the existing Creekside Arbour
Apartment Complex, zoned R-1S), from an R-8 zone to an R-40 zoning classification. The
adopted Comprehensive Plan's Future Land Use Map depicts the subject property as "High
Density Residential".
In conjunction with the applicant's rezone request is a request for conditional use permit to place
forty-eight apartments on the subject property. The proposed apartment complex consists of six
(6) individual, two-story apartment buildings, with eight (8) apartments in each building. There
are 48 dwelling units on 1.99 acres, with an approximate density of 24 units per acre.
It appears that the legal description submitted with the application is accurate and meets the
requirements of the City of Meridian and State Tax Commission. .
LOCATION & SURROUNDING USES
The subject property is located approximately 1/3 of a mile east of Meridian Road on the south
side ofFairview Avenue.

OWNERS OF RECORD
The applicants are the owners of record and they have consented to the submission of this
application.
STANDARDS FOR ZONING AMENDMENT
The Commission and Council shall review the particular facts and circumstances of each
proposed zoning amendment in terms of the following standards and shaJl fwd adequate
evidence answering the. following questions about tbe proposed zoning amendment (11-15-
11):
A. Will tbe new zoning be barmonious with and in accordance with tbe Comprehensive
Plan and, if not, bas there been an application for a Comprebensive plan
amendment;
Staff finds that the adopted Comprehensive Plan's Future Land Use Map delineates the
subject property as "High Density Residential". The requested R-40 zoning is
harmonious with the "High Density Residential" designation and is in accordance with
the overall goals and policies of the Comprehensive Plan. "High Density" is described in
the Comprehensive Plan as allowing multiple family dwellings containing over eight (8)
dwelling units per acre (page 95).
B. Is the area included in the zoning amendment intended to be re-zoned in the future;
Staff fmds that the proposed zoning amendment complies with the intended zone(s)
supported by the Future Land Use Map. Staff does not anticipate that the property will be
rezoned in the future.
C. Is the area included in tbe zoning amendment intended to be developed in tbe
fashion that would he allowed under tbe new zoning;
Staff finds that the applicant has submitted detailed development plans for the subject
property; and that if the property is developed in accordance with the requested
Conditional Use Permit the new apartment complex would be allowed under the new R-
40 zoning designation.
D. Has there heen a change in the area or adjacent areas which may dictate that the
area sbould be rezoned;

The recent adoption of the Comprehensive Plan changed the land use designation of the
property from "Existing Urban" to "High Density Residential" on the City's Future Land
Use Map. Furthermore this is being developed as part of an existing apartment complex
to the south.
E. Will the proposed uses be designed, constructed, operated and maintained to be
harmonious and appropriate in appearance with the existing or intended cbaracter
of the general vicinity and tbat such use will not change the essential character of
the same area;
Staff finds that all development on the subject property will be in harmony the existing
(high density residential) and intended (high density residential) character of the area.
The design and the construction of the proposed apartment complex are very similar to
the existing apartments in the general vicinity and will not change the essential character
of the area.
F. Will not be hazardous or disturbing to existing or future neighboring uses;
Staff finds that the re-zone to R-40 should not be disturbing to existing or future
neighboring uses. Specific uses allowed (either permitted uses or conditional uses) within
the R-40 zone may be disturbing to future or existing neighbors; however each
development will be required to comply with the approval requirements of the MCC.
The Commission and Council should carefully consider all public testimony, oral and
written, before making this finding.
G. Will be served adequately by essential public facilities and services such as
higbways, street, police, and fire protection, drainage structures, refuse disposal,
water, sewer or that the person responsible for the establishment of proposed
conditional use shall be able to provide adequately any sucb service;
Staff finds that the proposed uses will be adequately served by all essential public
services and facilities noted above.
H. Will not create excessive additional requirements at public cost for public facilities
and services and will not be detrimental to tbe economic welfare of the community;
Staff finds that the requested uses will not create excessive additional requirements at
public costs for public facilities and services. Additionally, staff finds that the proposed
rezone would not be detrimental to the economic welfare of the community.
I. Will not involve uses, activities, processes, materials, equipment, and conditions that
will be detrimental to any persons, property, or general welfare by reason of
excessive production of traffic, noise, smoke, fumes, glare or odors;

Staff finds that the proposed R-40 zoning designation of the property does not inherently
allow uses that will generate activities, processes, materials, equipment, and conditions
that are detrimental to the general welfare of the community.
J. Will have vehicular approacbes to tbe property wbicb sbaIl be so designed as not to
create an interference witb traffic on surrounding public streets;
Staff finds that the proposed R-40 zoning will not interfere with general traffic patterns
on any public streets. The lot does not have direct lot access to Fairview Avenue;
however a shared access to Fairview Avenue (to the north of the subject property) has
been approved of by ACHD as part ofan earlier apartment development proposal.
K. Will not result in the destruction, loss or damage of a natural or scenic feature of
major importance.
Staff does not find that any natural or scenic feature will be lost, damaged or destroyed
by approval of this rezone.
L. Is tbe proposed zooing amendment in the best interest of the City;
Staff finds that the zoning amendment would be in the best interest of the City by
allowing a property owner to make improvements to the property that would otherwise
not be allowed without the zoning amendment.
CONDmONSOFAPPRQVAL
I. Development of the property shall be in conformance with the Meridian City Code and
the conditions of approval for Conditional Use Permit File No. CUP-02-040.
STANDARDS FOR CONDITIONAL USES
The Commission and Council shall review the particular facts and circumstances of each
proposed conditional use in terms of the following and may approve a conditional use permit if
they shall find evidence presented at the hearing(s) is adequate to establish (11-17-3):
A. That tbe site is large enough to accommodate the proposed use and all yards, open
spaces, parking, Iandseaping and other features as may be required by this
ordinance;
Staff finds that the subject property is large enough to accommodate the required parking
(96required spaces, 100 provided), and the required landscaping, open space and other
development features required of an "Apartment" use by this ordinance.
Some minor changes will need to be made to bring the proposed use into compliance
with the MCC, however the site is large enough to accommodate the required changes.
B. That the proposed use and development plan will be harmonious witb the Meridian

Comprehensive Plan and in accordance with the requirements of this Ordinance;
The current Comprehensive Plan Land Use Map designates the property as "High
Density Residential". Staff finds that the requested apartment complex use is a
"Conditional Use" according to MCC 11-8-1, signirying that, if approved by the City
Council, the use will be harmony with the Meridian Zoning Ordinance and the
Comprehensive Plan.
C. That the design, construction, operation, and maintenance wiD be compatible witb
other nses in the general neighborhood and with the existing or intended character
of the general vicinity and that such use wiD not adversely change the essential
character of the same area;
Staff finds that the proposed development will not change the existing or intended
character of the general vicinity (currently a mix of medium and high density residential
and commercial uses).
D. That the proposed use, if it complies with all conditions of the approval imposed,
wiD not adversely affect other property in the vicinity;
The Commission and Council should rely upon public testimony to determine if the
development will adversely affect the other property in the vicinity. Staff does not
anticipate any adverse effect on nearby properties.
E. That the proposed use will be served adequately by essential public facilities and
services such as highways, street, police, and fire protection, drainage structures,
refuse disposal, water, sewer or that the person responsible for the establishment of
proposed conditional nse shall be able to provide adequately any such services;
Staff finds that the proposed development will be adequately served by the essential
public facilities and services listed above.
F. That the proposed use will not create excessive additional requirements at public
cost for public facilities and services and will not be detrimental to the economic
welfare of the commnnity;
Staff finds that the proposed use would not be detrimental to the economic welfare of the
community, nor would it create the need for any new facilities or services to be paid for
by the public.
G. That the proposed use will not involve activities or processes, materials, equipment,
and conditions of operation that will be detrimental to any persons, property, or
general welfare by reason of excessive production of traffic, noise, smoke, fumes,
glare or odors;

Staff finds that no excessive traffic, noise, smoke, fumes, glare or odors will result from
the proposed use.
H. That the proposed use will have vehicular approaches to the property which shall be
so designed as not to create an interference with traffic on surrounding public
streets;
Staff finds that the proposed use will not create significant interference with any traffic
on the surrounding public streets.
L That the proposed use will not resuk in the destruction, loss or damage of a natural,
scenic or historic feature considered to be of major importance.
Staff finds that no natural or scenic feature will be lost, damaged or destroyed by issuance
ofthis conditional use.
SITE SPECIFIC REOUlREMENTS
1. Landscaping shall be installed as submitted with the following corrections/changes:
a. Replace the rock in the perimeter planter beds with bark or other organic material as
required by the Landscape Ordinance.
b. Add a minimum 50 square foot planter, with a 2" caliper tree, in between the three
trash enclosures and the sidewalks to provide a landscaping break within the linearly
arraigned apartment parking.
2. All exterior lighting, whether attached to the building or located within the parking lot,
shall be down-shielded or otherwise altered so that the light does not spill over onto
adjacent properties or right-of-way. All parking lot lighting shall be in accordance with
Ordinance 11-13-4C.
3. All signage shall be in accordance with the standards set forth in Section 11-14 of the
City Zoning and Development Ordinance. All signage is subject to design review and
shall require separate permits. Temporary or portable signs shall be prohibited, and shall
be removed upon 3 days notice to the applicant.
4. All construction and site improvements shall conform to the requirements of the
Americans with Disabilities Act.
5. All parking and areas of circulation shall be improved with a hard surface in accordance
with MCC l1-13-4.D, and shall be installed and striped in accordance with the submitted
site plan, ADA and MCC 11-13-4.F.
6. A drainage plan designed by a State of Idaho licensed architect or engineer is required
and shall be submitted to the City Engineer (Ord. 557, 10-1-91) for all off-street parking

areas. Storm water treatment and disposal must be designed in accordance with
Department of Environmental Quality 1997 publication Catalog of Storm Water Best
Management Practices for Idaho Cities and Counties and City of Meridian standards and
policies. Off"site disposal into a surface water is prohibited unless the jurisdiction which
has authority over the receiving stream provides written authorization prior to
development plan approval. The applicant is responsible for filing all necessary
applications with the Idaho Department of Water Resources regarding Shallow Injection
Wells.
7. Trash: The trash enclosure shall be enclosed on at least 3 sides by a solid wall or sight
obscuring fence at least four feet in height in accordance with Ordinance 11-12-1C.
Coordinate location and construction requirements with Sanitary Services, Inc.
8. A Certificate of Zoning Compliance and a Building Permit shall be obtained prior to the
start of construction
9. Water and sewer service shall be from extensions of existing mains adjacent to the
subject property.
RECOMMENDATION
Staff recommends approval of the rezone and conditional use permit requests with the
aforementioned conditions of approval.

The following will be the requirements and/or concerns to provide minimum levels of fire
protection for the proposed project:
1. That a fire-flow consistent with Appendix ill-A of the Uniform Fire Code be
provided to service the entire project. Fire hydrants shall be placed an average of
400' apart. 1997 UFC Appendix ill-A
2. Operational fire hydrants are required before combustible construction begins.
UFC 901.4.2 & 901.3
3. Acceptance of the water supply for fire protection will be by the Meridian
Water Department.
4. Final approval of the fire hydrant locations shall be by the Meridian Fire Department
submitted thru the Public Works Department.
5. All radii for internal & external roads sha1l be 28' inside and 48' outside radius.
6. The proposed project will have an unknown transient population and will have an
unknown impact Meridian Fire Department requests for service. According to a
report completed by Fire & Emergency Services Consulting Group in February of
2000 our requests for service are projected to reach 2800 in the year 2005 and 3800
by the year 2010, this is up from 2069 responses in the year 2000.
7. The proposed project lies outside the five-minute response zone goal. Achievement
of this goal is subject to budgetary constraints and is intended to enhance the
probability of a favorable outcome on a request for Basic Life Support. The budget
constraints are typically defined as cllpital outlay for facilities that are located within
1.5 miles from a given location and ~ciep.t operational funds to staff the facilities.
A fire station is scheduled. to becofi\8:iperational in the fall of 2003 in this service
area.
8. The fire department requests that any future signalization installed as the result of
the development of this project are equipped with Opticom Sensors to ensure a safe
and efficient response by fire and emergency medical service vehicles. This cost of
this installation is to be borne by the developer
9. All buildings containing 6 or more units will be required to be fire sprinklered.

Dear Planners:
The Meridian School District has experienced phenomenal student growth the last ten
years. The high schools, middle schools, and elementary schools throughout the district
are operating over capacity.
Approval of Creekside Arbour II Subdivision will have a significant impact on school
enrolhnents at Meridian Elementary. Meridian Middle. and Meridian High School.
We can predict that these homes, when completed, will house twelve (12) elementary
aged children, eight (8) middle school aged children, and eight (8) senior high aged
students. Additional students will further compound the current overcrowded situation.
Residents cannot be assured of attending the neighborhood school, as it may be necessary
to bus students to other schools across the district.
School capacity is addressed in Idaho Code 67-6508. The Meridian School District is
currently operating beyond capacity. Future development will continue to have an impact
on the district's capacity. If you have any questions, please contact me at 888-6701.

The Ada County Highway District (ACHD) staff has received and reviewed the application and site
plan for the item referenced above and is submitting this no review letter in response to the lead
agency's request for comment.
Based on the submitted information, it has been determined that the proposed development will
generate less than 10 additional vehicle trips per day (VTD); or improvements exist adjacent to the
site and ACHD has no site improvement requirements attributable to this application. ACHD
policy states that no site related improvements will be required for developments generating less
than 10 additional VTD. If the site plan or use changes in such a manner that more than 10
additional vehicle trips per day are generated, then ACHD will review the site plan and may issue
requirements based on the ACHD Policy Manual.
This development is estimated to generate 318 additional vehicle trips per day based on the
Institute of Transportation Engineers Trip Generation Manual. As of July 1999 the traffic count on
Fairview Avenue east of 1st Street (Main Street) was 30,734 vehicle trips per day.
ACHD policy requires that before any improvements of any kind are constructed or installed within
the public right-of-way, a permit or license agreement permitting the improvements must be
obtained.
All future design plans and construction shall be in accordance with the Ada County Highway
District Policy Manual, ISPWC Standards and approved supplements, Construction Services
procedures and all applicable ACHD Ordinances unless specifically waived in writing by the District.
Meet District drainage requirements per section 8000 of the ACHD Development Policy Manual.

Please contact the office for determination of possible road impact fees, prior to obtaining a building
permit. These fees are collected in accordance with Ordinance #195, the Ada County Highway
District Road Impact Fee Ordinance.

District for its review on the above-referenced development. If this development is under a
"rush" to be finalized, I would recommend that you submit a cashier's check, money order or
cash as payment of the fees in order to speed the process up. If you submit a company or
personal check, it must clear the bank before processing the application.
Should this development be pianning a pressure urban irrigation system that will be owned,
operated and maintained by the Irrigation District, I strongly urge you to coordinate with John P.
Anderson, Water Superintendent for the Irrigation District, concerning the installation of the
pressure system. Enclosed is a questionnaire that you must fill out and return in order to initiate
the process of contractual agreements between the owner or developer and the Irrigation
District for the ownership, operation and maintenance of the pressure urban irrigation system.

Planning & Zoning Committee Members:
In March of 200 I I had conversations wi th and wrote a letter to the Meridian Building
Department concerning drainage onto my property (see copy of letter enclosed). This
took place during the development of Creek Side Arbor Phase II.
There are no easements on or across my property to accommodate drainage.
There is a drainage pick-up point at the intersection of Gruber and East Third Street
(west side of my property). The most logical solution would be to tile across my
property to the pick-up point. The ACHD, the City of Meridian and the Leavell's need
to address the problem.
I will not support more development of the Leavell's land until such time as the
drainage problem is cured.

RE: Creek Side Arbor Phase II - Road Drainage
Dear Mr. Watson:
On March 7, 2001, per our telephone conversation, I expressed concern about the
drainage of Badley Street being transferred to my property. I sold property in January
1993 to Bill & Lucille Leavell for the purpose of Badley Street being extended from 2%
Street. Completion of Badley until the development of Creek Side Arbor Phase II,
drainage was on Leavell's land. It is my understanding that part of Badley Street is
private. Show me a law that supports road drainage without benefit of a drain bed.
Per our conversation on the 71.h, you said that testimony was given that I had been
contacted and agreed to the road drainage to my property. That is not correct. I would
encourage disclosure of the individual that made that statement. The statement should
have. been a written document with my signature to give merit to the decision-making
process.
You made reference to a "historic drain ditch" that existed to remedy drainage. That
drain ditch has been inactive for many years (approx. 20 yrs. since fill dirt was added
to my property and surrounding property). In May of 1999 the Nampa & Meridian
Irrigation District expressed no interest or concern about the ditch (see enclosure). The
ditch has been partially backfilled for years.
Suppose for a moment that the drain ditch was still active. Again, show me a law that
supports street drainage into a ditch or canal.
My concern is future development of my land. I will not accept responsibility for
drainage of Badley Street or any other development. I anxiously await your response.
