V AC-07-004 t otGridl!'t '\ '- '"""0, I ~ ,lal STAFF REPORT TO: FROM: Vacation of the water service line and meter easement located on Lot 15, Block 1 of Bonito Subdivision NO.3 Staff has reviewed this submittal and offers the following comments: DESCRIPTION The Applicant, Toothman.Orton Engineering, has requested the City's consent to vacate the platted water service line and meter easement located on Lot 15, Block 1 of Bonito Subdivision No.3. Because the subject vacation is only for a City of Meridian water line easement, the City of Meridian is the only entity required to provide consent for the relinquish of the easement. The Unified Development Code 11-5A-l, requires the City Council to be the decision making body on vacations applied for in the City of Meridian. The subject water easement is shown on the recorded plat for Bonito Subdivision No.3, Recorders Book Number 94, Page 11520. The applicant states that the proposed vacation of the easement is due to the relocation of the water service line for Lot 15. The water service line required relocation and the easement vacated because of a change in the building footprint, which placed the building foundation within the recorded water service line easement. The Applicant has included a legal description and an exhibit map of said easement in the subject application. The Meridian Public Works Department and the Planning Department have no objection to the relinquishment of the subject easement, provided that during the civil site plan review with the proposed building an easement protecting the newly proposed water service shall be dedicated. LOCATION AND ZONING The subject site is zoned C.G and is located at 2971 E. Copper Point Drive, south of E. Overland Road and west of S. Eagle Road, in Section 20, Township 3 North, Range 1 East. SURROUNDING USES North - Commercial uses, zoned C-G South - Commercial uses, zoned C-G East - Commercial uses, zoned C.G West - Commercial uses, zoned C-G OWNER OF RECORD The owner of record ofthe subject property is Dave Evans, 7761 E. Riverside Drive, Boise, Idaho 83714.
