Request to Modify the Recorded Development Agreement for The Tree Farm, by
Treehaven, LLC.
1. APPLICANT'S REQUEST & STAFF ANALYSIS
The applicant, Treehaven LLC, has submitted a Miscellaneous Application (MI) requesting modification
to a recorded Development Agreement (DA) for The Tree Farm. The subject DA applies to approximately
358.57 acres located on the north side of Chinden Boulevard approximately 1.l of a mile west of Black Cat
Road, extending east to approximately Ten Mile Road, in the R-2 (Low-Density Residential), R-8
(Medium-Density Residential), R-15 (Medium High-Density Residential), C-N (Neighborhood Business)
and C-C (Community Business) zoning districts.
UDC 11-5B-3.D.2 and Idaho Code 9 65-6711A provides the City the authority to require a property
owner to enter into a Development Agreement (DA) with the City that may require some written
commitment for all future uses. The subject Development Agreement for The Tree Farm was entered into
on August 23,2006, and was recorded on September 21,2006, as Instrument No. 106151218, records of
Ada County, Idaho. On December 12, 2006 the City Council approved a first amendment to the original
development agreement. The first amendment requested by the applicant included the addition of 4.08
acres of property along Black Cat Road. On January 23, 2007 the City Council approved a second
amendment to the original development agreement. The second amendment requested by the applicant
included the addition of a provision allowing for the installation of a mobile office building and septic
system to be used for a period of five years by the Jayker Wholesale Nursery. The applicant is now
proposing a third amendment to the DA by requesting to modify section 5.2, and exhibits Al and AZ. The
main purpose of the modification is to include revised zoning legal descriptions that help to clarify and
augment the approved concept plan for this site.
At the time this property was annexed and zoned the applicant did not have a detailed plat design that
depicted the exact location of roads and lots within the development. Due to that lack of detailed
information, the zoning district boundaries were drawn as a "best guess" based on future development
plans and the approved concept plan for this site. Now that those more precise locations are identified
(through the current preliminary plat application, PP-06-058) staff and the applicant believe it is
necessary to "clean up" the zoning designations to more accurately reflect the specific development that
is proposed with the current preliminary plat application.
Realigning the zoning district boundaries so that they do not bisect lots has various benefits including
but not limited to: 1) The setback requirements and use restrictions, as described in the UDC, are clear
and not confused by dual zoning designations; 2) The tax designation of the lot is not skewed by an
inconsistent zoning designation. Furthermore, UDC 11-1-5C1 states that where a district boundary
approximately follows a property line, such property line shall be construed as the district boundary.
Staff believes that zoning district boundaries should coincide with the proposed property (lot) lines or
the center lines of the streets adjacent to said properties. Due to the fact that the zoning boundaries are
only being adjusted slightly, and that revised boundaries would still be generally consistent with the
approved concept plan for this property, staff in consultation with the applicant and the legal
department, determined that a standard rezone application would not be necessary in this situation.

In place of the rezone application, it was determined that the most effective and efficient way to adjust
the zoning boundaries would be through a modification of the original development agreement on this
property. Through this request to modify the original development agreement, the applicant has
submitted new zoning legal descriptions that adjust the boundary lines to coincide with property lines or
the center lines of streets. NOTE: If the subject DA agreement is approved, new zoning ordinances will
have to be recorded for the subject property.
Modified language for the proposed third amendment to The Tree Farm Development Agreement is
provided by staff below.
Staff recommends that the Council direct the City's Legal Department to draft modifications to
the recorded development agreement for The Tree Farm as follows:
· Section 5 - Conditions Governing Development of Subject Property
This section of the recorded DA sets forth additional conditions and restrictions for the
property.
Section 5.2 ofthe recorded DA currently states:
"Developer will develop the Property generally in accordance with the Concept Plan, at
Exhibit C, unless otherwise modified by this Agreement. The parties acknowledge that
the designation of land uses on the Concept Plan is conceptual and is subject to change
as necessary to respond to market conditions, site conditions, and other development
considerations. Notwithstanding any land use designation shown on the Concept Plan,
any parcel may be developed, improved and used as is allowed by the underlying
approved zoning for such parcel. Specifically, Developer may develop the Property at
density levels consistent with the approved zoning."
Staff, through the applicant's submittal letter, is proposing to amend the above-
mentioned Section 5.2 ofthe DA with the following (changes in bold and underline):
"Developer will develop the Property generally in accordance with the Concept Plan, at
Exhibit C, unless otherwise modified by this Agreement. The parties acknowledge that
the designation of land uses on the Concept Plan is conceptual and is subject to change
as necessary to respond to market conditions, site conditions, and other development
considerations. Notwithstanding any land use designation shown on the Concept Plan,
any parcel may be developed, improved and used as is allowed by the underlying
approved zoning for such parcel. Specifically, Developer may develop the Property at
density levels consistent with the approved zoning as shown in Exhibits Al and A2."

This exhibit of the recorded DA shows the zoning legal descriptions of the subject
property.
Staff, through the applicant's submittal letter, is proposing to replace the above-
mentioned Exhibit Al of the DA with the revised legal descriptions provided by the

applicant. (See the revised zoning legal descriptions as submitted with this request to

This section of the recorded DA shows the zoning map ofthe subject property.
Staff, through the applicant's submittal letter, is proposing to replace the above-
mentioned Exhibit A2 of the DA with the revised zoning map provided by the
applicant. (See the revised zoning map as submitted with this request to modify the DA
(attached as Revised Exhibit AZ)).
There are no required findings for a miscellaneous application/development agreement
modification. Above, staff has provided the most pertinent facts and analysis related to the
proposed development agreement modifications. Staff is recommending approval of the
applicant's request to amend the Development Agreement for The Tree Farm, as
detailed by City Staff above.
2. LOCATION & SURROUNDING USES
The subject property is located on the north side of Chinden Boulevard, approximately 1.l of a mile west
of Black Cat Road extending east to approximately Ten Mile Road.
The following uses surround the subj ect property:
North - Phyllis Canal; Rural residential; Agricultural, zoned RR and R1 (Ada County)
South - Proposed Bainbridge Subdivision, zoned L-O and R-8; Several rural properties in Ada County,
zoned RUT
West - Agricultural and rural residential, zoned RR (Ada County)
East - One-acre lots in Spurwing Subdivision and WestWing Subdivision, zoned RR (Ada County)
3. OWNER OF RECORD
The property owner of record is Treehaven, LLC.
4. PROCESS FACTS
a. Miscellaneous applications are not currently addressed in Title 11 of the Meridian City Code.
It has been determined by the City's Legal Department that a miscellaneous application to
amend a recorded development agreement will in fact require a public hearing before the City
Council.
b. Newspaper notifications published on: February 19th and March 5th, 2007
c. Radius notices mailed to properties within 300 feet on: February 16th, 2007
d. Applicant posted notice on site by: March 3rd, 2007
5. RECOMMENDATION:
Staff recommends that an amendment to the recorded Development Agreement for The Tree Farm
Annexation (see AZ-06-004) be approved, as noted in Section 1 of the Staff Report above. Staff
further recommends that the Mayor and City Council direct the Legal Department to draft an
amendment to the Development Agreement for The Tree Farm that includes the modifications
listed herein, and that the current Owner/Developer, Mayor and City Clerk sign and then record

said document. Furthermore a new/revised zoning ordinance will need to be prepared by Legal
