Anderson. I have resided at 120 N Nola Road with my wife Dorothy since 1992. Our residence is located adjacent to the subject property on the northwest side of this development. I have tried to follow the activity in the Sparrowhawk Subdivision very closely since it began. I have routinely found the developer very uncooperative. This entire process has been very unpleasant and often unproductive. I would like to encourage the City Council not to grant Mr. Waldren his request of removal of item 6.1 in the development agreement that discusses conditional use permit review by the City of Meridian. There are several items which have not yet been addressed in the previous agreement. In fact some of the work that has been performed, still continues to cause problems for me as well as my neighbors. The following are some examples: 1. The drainage from the site is to be retained on site. This has not been done. In fact new drainage routes have been installed which have caused some flooding. 2. The gravity flow irrigation line did not work well at all last summer. There were several instances of flooding, and we missed our water rotation several times while they tried to fix it. We were sometimes 30 days without water. To date, there is still uncertainty as to whether or not the irrigation lines put in place by the developer can make it through the upcoming water season. 3. There was destruction of my personal property. The developer nearly had my entire south fence line tom down before I stopped the demolition crew. The developer's employee explained to me the City of Meridian had instructed them to remove the fence. I had to take time off work and travel to Meridian to visit with city representatives only to [md out this wasn't true. They had not asked for the removal of my fence. In addition to all of these points, I have concerns what types of business the developer may sell to. Continued review by the City of Meridian will help as an incentive to the developer to comply with the full terms of the development agreement and protect my property and the quality of the neighborhood.
