Dear Meridian City, This is Terry Harris, my wife and I live at 5259 W Ridgeside St, Meridian. We are temporarily serving a mission and will return at the beginning of next year. it is somewhat difficult to take care of business at home. I had asked my daughter and her husband to attend a meeting in our behalf, but they were unable to attend. I did send an email to Becky McKay, which she replied and pretty much dismissed my concerns. I do not agree on the developers conclusions, and I am thinking it is the effort of the developer forcing their will on home owner concerns, perhaps concluding we won’t fight back or dispute, or just give up! Our friends and neighbors have suggested I contact you with my concerns, since my previous efforts to Becky McKay seem to have fallen on deaf ears! My primary concerns with the Dayspring Subdivision are… We want side lot lines to align up with our existing lot lines. In my case, our back property would be adjacent to what looks like 3 new lots! You can read the email from Becky McKay, but she indicates that they feel that the 25 ft common lot is sufficient buffer. Of course she also includes in her buffer the NMID easement (where the canal is now). My problem with that is she calls the Common Lot is not common to us, and our property line which is on the south side of the canal is still “our property”. Just because there is an easement, does not mean it is common or public property. It is private property, and we own it. So the new development should align with existing property lines, which includes our property lines, and the transition to smaller lots should be within the new subdivision. Another question which they have not answered is what is the landscape plan for the new square footage of land created by filling in the canal? There is a significant amount of property which will grow weeds if not maintained. Since the new square footage property belongs to existing property owners, who is responsible for landscaping Maintenance and or irrigation? I suggested that a solid fence to obscure the sight line be installed on our south property line. This would be such as the fence on the north of seasons park. Looking into the back yards of our new neighbors is not desirable. Also, will there continue be an access road (on the easement) which is required for irrigation access and maintenance on the back of our properties? I don’t know what we can do from here. Can Meridian City help us? The Toll representative indicated a 25-foot-wide common lot will separate the existing lot from the proposed lots. The total width of the Nampa-Meridian Irrigation District easement is 60 feet in width. The lots along the south side of Ridgeside Street have a buildable depth of 90 feet with the remainder encumbered by the NMID easement. They believe the separation between lots provides for a buffer. I do provide the City of Meridian with comments received from the neighborhood meeting or other correspondence. Thanks and Happy Thanksgiving. Just to be clear, I am less concerned about fences. Although I might point out that the fence on the north side of the park which runs along a buried canal, is a solid fence. My primary concern is that property lines on the north side of the canal line up with the new proper lines on the south side of the canal. Higher density transition should happen within the new subdivision, not adjacent to our existing property. Are you passing this information to the Meridian City? If the lateral is piped, the City will allow a solid fence with a maximum height of 4 feet. Dayspring development by Toll Southwest LLC Issues and Questions: The notification of this neighborhood meeting has. 1. Lot lines will need to be changed for the lots adjacent to existing lots on the south side of the Tricia’s Crossing Subdivision, or more specifically the properties on the south side of Ridgeside Street. The proposed platt we received in the mail show 6 new lots adjacent to our existing 4 lots in Tricia’s Crossing. My particular lot (5259 W Ridgeside St.) shows there are 3 new lots adjacent to my south property line. This adjacent higher density will have smaller houses, and will cause a negative affect on my property value. The transition to smaller lots should be done within the new subdivision. Also, the previously proposed subdivision in this location did have new lot lines which lined up to our existing lot lines. Also this should require larger homes to be built on these new lots on the south side of the canal. This is consistent with the alignment of new proposed lot lines to the properties on the west side of the Seasons Park. This should be the same for the properties on the south side of Seasons Park. 1. The existing south property lines for the properties on the south side of W Ridgeside St, are on the south bank of the canal. (Refer to Assessor Online Property System) 3 4 The property owners on the south side of W Ridgeside St, are the owners of the land where the canal runs. Legal easements allow access for irrigation use, and canal maintenance. Other than irrigation and canal purposes, the property is owned by the homeowner on the north side of the canal. It is not property for public use, but falls under any law protecting privately owned property, with exceptions of the users for irrigation or maintenance purposes. Any new walking path would have to be on the south side of the existing canal location. 1. Question… Since a person has no control over activities or usage of another persons back yard, what are the fencing requirements for the back yards of the new development, in particular the ones adjacent to the canal?
