Re: Public Utility Easement Vacation
To Whom It May Concern:
When the Plat for the Olson and Bush Industrial Park was recorded in 1997, there was a 10'
public utility easement that was in turn recorded on all the interior lot lines (please see attached
Plat). Van Auker Properties, the applicant, is requesting an easement vacation by the public
utilities between Lots 1 and 2, Block 1, of the Olson and Bush Industrial Park. Van Auker
Properties has plans to build a commercial building on the 2.20 acres, which will span the Lot
Line.
The affected parties of the Vacation of Easement will be Idaho Power Company, Cable One,
Qwest, Intermountain Gas Company, Nampa Meridian Irrigation District, and the Applicant. All
of the entities listed above have sent the Applicant relinquishment letters with respect to the
proposed Vacation of Easement, which are attached to the application.

WHEREAS, by subdivision pI, recorded in Plat Book 44, at Page 3581 through 3582 on April 10,
1978, as Instrument Nwnber 7818068, In the records of Ada County, State ofldabo, Olson and Bush Industrial
Park Subdivision, granted. to IDAHO POWER COMPANY an easement (the "Easement") for the construction,
operation and maintenance of certain power line facilities upon the following premises located in Ada County,
State ofIdaho, to-wit:
Olson and Bush Industrial Park Subdivision - Situated in the SE1f" Section 8, Township 3 North, Range
J East, B.M,Ada Coun~, Idaho.
AND, WHEREAS, it is no longer necessary or desirable that a certain portion of the Easement be
retained,
NOW, THEREFORE, in consideration of the premises, IDAHO POWER COMPANY does hereby
release and abandon that certain portion of the Easement over the following described lands:
The J O-ft public utility easement centered on the interior lot line of Lots J and 2, Block J, Olson and
Bush Industrial Park Subdivision.
ALL RIGHTS and privileges under the above.described docwnent in and to the remaining lands
covered by the Easement and any and all prescriptive or other rights the Grantee has acquired through
occupancy and use over time of said remaining lands shall remain and continue in the Grantee and shall not be
affected in any way hereby.

RE: Utility Easement/Olson & Bush Industrial Park
Dear Ron:
I am in receipt of your fax dated this day. Please be advised that the only easement that
Nampa & Meridian Irrigation District has jurisdiction of is the District's Evans Drain along
the north boundary of the above-named project.
The District's easement for the Evans Drain at this location is a minimum of sixty feet (60'),
thirty feet (30') to each side of the centerline. However please contact the District directly to
verify the width of easement necessary to operate, maintain and repair the Evans Drain. .
Nampa & Meridian Irrigation District has no jurisdiction of or comment on the utility or
drainage lines within the interior of the Olson & Bush Industrial Park.
