Thank you for the opportunity to comment on this variance application. ITD has received an
application for a right in access at this location :&om Jacksons. At this point the Director has denied the
application for a variance from ITD Rule. The matter is on appeal to the District Court. The denial was
based in part on consistency with local Planning and Zoning actions and in part on the safety of the traveling
public
ITD currently has a project to construct a right turn lane for northbound traffic to turn onto Pine
Avenue. Any access from this turn lane could result in operational problems with the future turn lane. The
official position of ITD as expressed by the Director is if the approach is approved the improvement project
for the Eagle Road Pine Avenue intersection will have to be reevaluated to determine whether the dangers
created by the new approach outweigh the benefits of the turn lane from Eagle Road to Pine Avenue.
