I sent your email over to the Jacksons team. Their real estate team is going to pursue the property owner again as
the PBA will need to be completed one way or another. They have informed me that they do want to pursue the PBA
first with the County and come back to the City with a complete package. Please use this email as a formal
request to withdraw the application. We will resubmit once the BPBA is completed. Thank you for your patience
and working through this with us. Let me know if you need anything else.

Please let Jacksons know that Staff will recommend denial of the application without an approved PBA in the
County as we’ve discussed previously. The City can’t condition annexations per state law. We’d have to include it
as a DA provision which would require annexation of the property. Planning Staff doesn’t feel it’s in the best

interest of the City to move forward with annexation of the property without a PBA to ensure the road can be
constructed and access can be provided to the site with development.
Please discuss with Jacksons and confirm if they want to proceed as-is.

Please see the attached. Jacksons would like to request the property boundary adjustment with the northern
property be completed as a condition of approval of the annexation. So, prior to recording the annexation and
formalizing that, a property boundary adjustment would need to be approved and recorded with Ada County.

In speaking with the Jackson's team, they would like to move forward with being heard on June 5th. The January
th
29 site plan I sent to you via email is the most recent, and we would like to continue moving forward with this
layout as requested. We also appealed ACHD's decision in their Staff Report. I have attached the narrative that
was submitted to ACHD with our appeal. ACHD informed us they will not make a decision on the appeal until City
Council has made their decision. If there is anything we need to do in preparation for the hearing, please let me
know.

I'm waiting to hear back from the Jackson's team on how they plan on moving forward. At this time, a PBA has not
been submitted to the County, so that's pretty much a guarantee we won't be ready for the June hearing. I'll let you
know if they plan on withdrawing, or if they have any other thoughts.

Hi Connor & Scott,
I just wanted to follow-up after our meeting last Wednesday and memorialize in an email what was discussed and
the path forward on this application.

Staff feels it’s preliminary and not in the best interest of the City to annex this property at this time without the
necessary right-of-way (ROW) to extend Overland Rd. for access to/from the site, which lies on the adjacent
property to the north. Staff recommends the applicant work with the property owner to the north (parcel
#R7569810030) to complete a property boundary adjustment in Ada County to include the land necessary to meet
ACHD’s minimum requirements for the extension of Overland Rd. to the west with development of this property.
Due to the topography in this area, engineering is necessary to determine the best location for the extension of
Overland Rd. Although the extension of Overland Rd. to the west is listed in the CIP, ACHD has not yet completed
engineering to determine the alignment of Overland between Ten Mile & Black Cat Roads. Because this property is
the first to redevelop on the west side of Ten Mile in this area and access via Overland is needed to serve the site,
the Applicant should perform the necessary engineering to determine alignment of the road between the west
boundary of Lot 1 and the west boundary of Lot 2 in conjunction with the ultimate alignment of Black Cat. If it’s
determined that Overland should extend along the north boundary or through the subject property, the road and
associated infrastructure improvements will be required to be constructed as part of the subdivision
improvements. If it’s determined that Overland should extend to the northwest, the adjacent property owner will
be responsible for the extension of that portion of the road if not already constructed by ACHD at the time of
redevelopment of the property. The Applicant should share their engineering findings with ACHD and gain
acceptance of the proposed location of the road.
Please either request continuance of this project to a much later hearing date to allow time for the PBA to be
completed in the County; or request withdrawal of the application in order to complete the PBA and resubmit an
updated application once the PBA has been finalized. It might be better to withdraw & resubmit when you have
everything ready to go. The City Clerk needs a response from you by 3:00 pm this afternoon. The existing or
future application, as applicable, will need to be updated with all new information to reflect the additional
property.
