Police and Fire Dept. expressed concerns over the maintenance and safety of the area directly surrounding the Cell tower site. The Fire Dept. was specifically concerned with the weeds and debris that has historically accumulated On the site. I have spoke with both Joe Silva with the Fire Dept. and Bob Stow with the Police Dept. and have agreed to clean up Existing debris on the site as well as maintain and mow the weeds to mitigate any potential fire hazards. Gemstar Prop. Has contracted with Lawn Co. to mow weeds as necessary, the first mowing will take place next week once the site Dries up following the recent rain showers. Furthermore I spoke with Joe and Bob in regards to safety concerns of Individuals attempting to climb and/or vandalize the cell tower and guide wires. Currently there is 6' chain link fencing With three (3) strands of barbed wire along the top surrounding the cell tower and guide wires. Gemstar will ensure The fencing is in good quality as well as additional sign posting nno trespassing - private property" on the fencing as Well as the entrances to the lot the tower is on. Both Joe and Bob agreed that this would be the best course of action In mitigating these concerns. Letters from the Turtle Creek and Tumble Creek BOA's as well as individual home owners have expressed the Concern of Sundial Subdivision hooking up to the Pressurized Irrigation Systems. Currently our property has 1.88 project acres of water within the Nampa Meridian Irrigation Dist. And 8.47 project acres Of water within the Settlers Irrigation dist. Nampa Meridian Irrigation Dist. Owns and operates both Turtle Creek's and Tumble Creek's Pressurized Irrigation Systems. There are currently three (3) Pressurized Irrigation stubs to our property that Where installed to service our property in the future when developed. In speaking with John Anderson of Nampa Meridian Irrigation Dist., he is proposing that we create a loop system of the two through the Sundial Subdivision in turn creating one Large system which may Help current pressure issues. John will also be meeting with Settlers Irrigation Dist. Next week to discuss the process of Transferring our project acres out of Settlers and into Nampa Meridian. Gemstar is aware that we will be responsible for all costs associated with upsizing of pumps and distribution lines that are affected by our development to the system to ensure overall system quality as directed by Nampa Meridian Irrigation Dist. Existing Gravity Irrigation Ditch on the Northwest corner of our property that services the adjacent 2.1 2/15/2007 Page 2 of3 acre parcel (parcel #S1202244230). I have spoke with the owner(s) of the 2.1 acre parcel and have agreed to work with them, the Irrigation Dist., and our engineer to Ensure there service is not impacted and delivery points/quantities remain the same. Design concerns of Stub Street to the 2.1 acre parcel (parcel #S1202244230) and mitigating the potential for a double Fronted lot directly to the South of this parcel. Staff has suggested that we shift the proposed stub streetto the North 10' ofwhere it intersects with the 2.1 acre parcel. This Change will avoid creating a double fronted lot within the Field Meadows Subdivision to the north of the 2.1 acre parcel in the Event that it is developed in the future. Gemstar agrees with this and will make the changes to the final plat. Fencing: Staff recommends that the applicant discuss any additional perimeter fencing plans they may have, at the Public Bearing. Gemstar plans to complete any perimeter fencing that is not currently in place during the development of Sundial Subdivision. Furthermore, Gemstar realizes that this project is completely surrounded by houses and plans to install temp. construction fencing Prior to start of construction were no existing perimeter fencing exists, this fencing will remain in place until permanent fencing is Installed. CC&Rs: Both Turtle Creek and Tumble Creek BOAs have expressed concern with Sundial Sub having its own CC&Rs Rather than annexing into one of the existing. Gemstar Properties has provided both HOAs a copy of the draft CC&Rs for the Sundial Subdivision for review. Although Gemstar is prepared to establish an independent HOA and CC&Rs for the Sundial Subdivision an invitation to Turtle Creek HOA has Been extended to start talks to potentially annex. We have also met with James Hall of the Turtle Creek HOA and agreed to start Talks to potentially annex. At this point Tumble Creek HOA has not approached Gemstar to start talks. James Hall with Turtle Creek Has noted our expectations for amendments we would want done to their CC&Rs and is expected to schedule a meeting to discuss Turtle Creeks willingness to meet these expectations. In closing, Gemstar Properties LLC is in agreement with the City of Meridian Staff Report, the Meridian Public Works Conditions, and ACBD Condition. I would like to also thank Staff for the great work they have done on this project and We look forward to a successful project.
