Hi Bill:
Toll Brothers asked Givens Pursley to review the Record of Survey (ROS)you sent over for the portion
of Day Springs north of Ustick. We have worked with Pioneer Title and Ada County PDS to gather
additional facts we are hopeful address any questions the City may have about the property. Our
research indicates there was never any effort, at any time, by a prior developer to intentionally create an
illegal out parcel. Instead,Parcel A and Parcel C (as shown on the ROS)have been single-family home
sites for the Rambo family who have been involved with the subject property for over 60 years.
Title History:
• On January 2, 1962, Morris and Dixie Rambo purchased all 40 acres shown on the ROS (see
instrument no. 874221 attached).
• On March 8, 1979, Morris and Dixie Rambo conveyed to their children, Craig and Deborah
Rambo,what would eventually become Parcel A on ROS (see instrument no. 7912771 attached).
• On February 8, 2005,Morris and Dixie Rambo conveyed Parcel B, as shown on the ROS,to
Jade Eagle,Inc. Morris and Dixie Rambo,retained Parcel C for themselves,which they still own
today(see instrument no. 105024239 attached).

• On March 17, 2005, Morris and Dixie Rambo recorded a quitclaim deed adjusting the boundary
line of Parcel A(see instrument no. 105043670 attached).
Development on Parcel A and Parcel C:
In 1979, Craig Rambo sought, and Ada County approved, a zoning certificate for Parcel A to construct a
residence on the property (see attached materials for App.No. 79-04-OA). In 1995, Craig Rambo sought,
and Ada County approved additional permits on Parcel A to construct an 1,800 SF outbuilding (see
attached materials for App. No. 95-10-CU). Today, Parcel A has a single-family residence and
outbuildings on it. Consistent the 1979 zoning certificate,the Ada County Assessor's records indicate
the home was constructed in 1979. Parcel A is now owned by John Wardle. In 2018, Ada County
authorized a building permit on Parcel A filed by Right Now, Inc. for a water heart pump. Parcel A is
recognized as a legal lot by Ada County. Parcel C has two single-family residences located on the
property. Ada County records indicate these were constructed in 1900 and 1950 respectively.
Day Springs Project:
Toll Brothers has designed Day Springs so that Parcels A and C can easily develop in the future. The
Day Springs project will provide Parcel A with frontage on a local public road and will stub a public
road to Parcel C for future connectivity and access. A snapshot of the Day Springs site plan for this area
is below. We added some rough concepts to illustrate future access and development options Parcels A
and C.
Toll is seeking annexation and subdivision of Parcel B (as shown on the ROS) only. The owners of
Parcel A and Parcel C have declined to consent to annex or be part of a plat at this time. Parcel B by
itself meets the requirements for annexation in UDC § 1-11-4:the land is within the City's AOI,
contiguous to city limits, and the owner is consenting to annexation in conformance with I.C. § 50-222.
Hopefully this information addresses any questions the city had about the property history. Please let us
know if there are any remaining questions or concerns.
