The homeowners of Turtle Creek subdivision and Tumble Creek subdivision have concerns on the impact of the proposed Sundial Subdivision and the manner in which the process has proceeded up to this point. Turtle Creek HOA and Tumble Creek HOA have been working together to fact find and address the concerns of the 450+ homeowners that will be impacted by this proposed development. James Hall, a representative of Turtle Creek HOA and another Turtle Creek homeowner met with a representative for Gemstar Properties L.L.c. There was found to be commonality in our and Gemstar's concerns regarding the following issues. However, many of these issues still need to be visited. The leading concern is the impact Sundial will have on the property values of the established homes in the subdivisions involved. The proposed subdivision will be finishing what was to be our fourth phase, originally recorded by the Turtle Creek developer. This includes: four lots in our N. Cinnamon PI. cuI de sac; two lots in our W. Whitelaw Drive cuI de sac; and the adjoining lots to our homes on N. Marburg Ave. as well as W. Fieldstream Dr. We extended a proposal to Gemstar that would defer their CC&R setup costs to us if they would incorporate into our homeowners association. We did this so that we could keep the continuity and standards that we have worked hard to enforce so as to solidify the property values of our homeowners. We were refused and told they had already been written. When Gemstar had the neighborhood meeting in January 2007, per the request of the Planning and Zoning Commission, it was implicitly implied that the homes in our subdivision and CC&Rs were "substandard". We are concerned with the type and quality of homes that could be built within 200 feet of the existing tower. With regards to the tower is it favorable for the developer and/or the existing homeowners and future homeowners to have this tower in place? Is there a way to facilitate the removal/moving of the tower to satisfy the developers need to complete his proposed development, alleviate the eyesore and safety hazard for the existing and future homeowners, and not compromise the quality of service that the lessee extends to their customers? We also have questions regarding the taxing of the pressurized irrigation system that this development will create. Turtle Creek already has water pressure issues as well as Tumble Creek. Tumble Creek had recently spent a large amount of money in order to try and improve the flow of water, but still are battling the water pressure issue. We have questions on how Sundial, with 28 homes in Phase 1 and a small number of homes planned for Phase 2, is proposing to populate and finance a homeowners association that would be able to uphold and enforce the CC&Rs as well as do the required maintenance on the common areas. We ask that you come and look at the proposed site of the Sundial development as well as the Turtle Creek and Tumble Creek subdivisions in order to visualize the impact we foresee. We have submitted about 400 signatures of homeowners that feel this is a matter of importance and needs to be reviewed carefully. City of Meridian CIty Clerk Office, I wish to take this opportunity to express my opposition to the Proposed rezoning from R4 to R8 for the Sundial Subdivision. As the subdivision is currently designed all access to Sundial is thru the Turtle Creek Subdivision. The average sized lot in Turtle Creek is 8000 sq ft. Several of the homes proposed for construction will be on streets who's existing homes are on average sized lots. By allowing the rezoning toR8, undersized lots will mean shoe box type homes will be built that won't fit the overall appearance of the surrounding areas. In short these undersized lots will detract from the neighborhood and negatively affect home values. Several months ago Gemstar Properties,LLC had a neighborhood meeting in the Turtle Creek Subdivision to explain its plans for the tower area (Sundial Subdivision). An overwhelming majority expressed two concerns. 1. Redraw property lines to conform to the 8,000 sq ft standard. 2. Incorporate the Sundial Subdivision into the Turtle Creek Home Owners Association. Gemstar Properties LLC promised to look into the 2 areas and do what they could. The primary reason there is a great deal of concern with the Home Owners Association is that some of the new homes would be built on existing streets who's homeowners are part of the Turtle Creek Home Owners Association. For instance, on Cinnamon Place there are 8 existing homes, Sundial would add 4 more. With 2 sets of home owner associations 8 homes are subject to one standard CCR and enforcement and 4 homes are subject to another set of standards and enforcement. In addition, ALL access to the Sundial Subdivision is thru the Turtle Creek Subdivision. Essentially the Sundial Subdivision is an infill development. As the City of Boise discovered a little late, the standards used in the surrounding area must be used in the infill development. It is clear to me now that Gemstar Properties LLC essentially wasted our time in the neighborhood meeting and only said what we wanted to hear to end the meeting and go on with what they planned regardless of our concerns. ~tL~ Gary A. We look fOrward to the developing of this land due to the fact that It has been an eyesore to the neighboring homes in Turtle Creek for the last few years from the laek of upkeep and lack of weed control. To Whom It May Concern, Since the inception of Turtle Creek we have taken pride and work hard to enforce the curb appeal by enforcing the covenants, conditione and restrictions (CC&R's) fOr the protection of property values and the esthetics of our subdiVIsion. Tumble Creek Subdivision has been just as proactive in their enforcement of the CC&R's and has very similar CC&R's to Turtle Creek. On that note we would like to extend the offer of deferring some, or all of the oosts that will be incurred in the process of writing, reviewing, and recording of the Sundial CC&R's If you would allow Turtle Creek to Incorporate Sundial Into Turtle Creeks association and take on the name of ''Turtle Creek". The concem of over half of Turtle Creek homeowners has been voiced to the Board of Directors by way of signatures on a petition that will be sent to the Planning and Zoning meeting, is to keep the continuity of the neighborhood and the lot sIze intact. Turtle Creek would like to dIscuss the sizing of lot 1 & 2 of Block 1 and lot 22 of BloCk 2. We feel there is an abrupt change in the continuity of the lot sizes from Turtle Creek into Sundial. The Board of Directors for Turtle Creek would like to ask for the opportunity to explore some options with you as soon as possible. The Turtle Creek Subdivision is located between Cherry and Ustick roads to the West of Linder Road. We live in the Turtle Creek Subdivision and have enjoyed the safety and security of knowing that our neighbors (within the subdivision) all are being held to the same standard of our current Codes Covenants and Regulations (CCR's). It is my understanding that the proposed Sundial Subdivision is possibly going to be granted R-8 zoning and the developer is unwilling to incorporate our current CCR's in the new proj ect. We don't want to see the property developed into housing for the following reasons: 1) It doesn't seem safe to build in the "fall radius" of the tower 2) There may be a concern about "RF" (radio frequencies) from the tower 3) We don't want the extra traffic on our neighborhood streets 4) We don't want a subdivision within our subdivision (especially one that won't abide with our same CCR's) 5) We believe that this Sundial Subdivision would possibly decrease our current property values Please take our concerns into consideration as you make decisions about this proposed development. The 155 signatures attached were obtained in the Tumble Creek Subdivision prior to this notification. However, we felt it was of importance that Planning and Zoning, of the city of Meridian be made aware of the number of residents who still have concerns regarding the proposed development. This only addresses the rezoning issue, but upon obtaining these signatures other concerns were expressed. These concerns included the following: the status of the tower, the placing of a separate subdivision within two existing subdivisions and its impact of having the main ingress and egress routes to Linder and Ustick Roads be through the Tumble Creek Subdivision, also the added strain an additional subdivision will have regarding water pressure from the Nampa Meridian Irrigation District. January 15, 2007 Meridian City Council, Gem Star Development, and Other Participating Parties: We, the signers of this petition, wish to express our disapproval of Application RZ06-0 11 and its proposed zoning change for the future Sundial Subdivision. As homeowners in the Tumble Creek subdivision, we are opposed to the negative impact 'this change will have. We are against this rezoning for three main reasons: First Sundial is an area that does not have direct access to any main roads, thus all traffic to and from the development will be through the neighboring subdivisions. Increasing traffic flow through our neighborhood will only decrease the safety of our residents. Second, the smaller size of dwellings that will result with this rezoning decreases the value of our properties. Third, smaller dwellings lend themselves to income/rental properties. Such properties often bring with them a number of problems. This proposed zoning change will negatively impact our neighborhood and has no benefits for the surrounding homeowners. We therefore wish to go on record as being strongly opposed to the suggested change. We encourage the City of Meridian to make their decision based on the needs of the existing neighborhoods. At the neighborhood meeting it was told to us that Gemstar wanted to hook onto Tumble Creek's secondary water system owned by Nampa & Meridian Irrigation Company. Our Tumble Creek secondary irrigation system has been a problem ever since conception. The pump is very inadequate and we have had problems with water pressure especially since the Latter Day Saints church on U stick hooked onto the same system. OUf subdivision is very concerned that when Gemstar hooks onto the system none of us will have enough pressure. It is our belief that Gemstar should be responsible for upgrading our pump ensuring flow of summer water to all the homes in both subdivisions. I am personally concerned about the construction equipment moving the material off of Linder down Tumble Creek drive South on Roughstone Way into the Sundial development. We do not want the dump trucks turning in our subdivision being overloaded and dropping debris onto the roads. We end up having to clean up the mess. We are already getting traffic coming off Linder and Ustick cutting through our subdivision during congested times in early morning and evening. They speed through our subdivision not stopping at stop signs. I am very concerned about the extra traffic that Sundial will create. It is our belief that Gemstar should be responsible for upgrading our pump ensuring flow of summer water to all the homes in both subdivisions. I am personally concerned about the construction equipment moving the material off of Linder down Tumble Creek drive South on Roughstone Way into the Sundial development. We do not want the dump trucks turning in our subdivision being overloaded and dropping debris onto the roads. We end up having to clean up the mess. Weare already getting traffic coming off Linder and U stick cutting through our subdivision during congested times in early morning and evening. They speed through our subdivision not stopping at stop signs. I am very concerned about the extra traffic that Sundial will create. These signatures were obtained prior to this notification. However, we felt it was of importance that not only Planning and Zoning, but also the City Council be made aware of the number of resident's who still have concerns regarding the proposed development. This only addresses the rezoning issue, but upon obtaining these signatures other concerns were expressed. These concerns included the following: the status of the tower, the placing of a separate subdivision within an existing subdivision, as well as its impact regarding the enforcement ofCC&R's on homes that finish out our subdivision's cul-de- sacs on Cinnamon & Whitelaw but fall under separate CC&R's that mayor may not be enforced by the new subdivision's homeowners association. As homeowners immediately adjacent to, or in the vicinity of the proposed development, we are particularly aware of the way in which it may affect both the value of our property and the nature of the surrounding neighborhoods. Our main concern is the type of residential zoning being requested by the developer. Our understanding is that he has asked for the zoning to be changed to R8. This would be a substantial departure from all of the surrounding neighborhoods. In fact, within the vicinity bounded by Linder, Ustick, Ten Mile, and Cherry Roads the only area zoned R8 is the Tully Cove subdivision, everything else is zoned R4. Tully Cove, with its duplexes and direct access to/from Linder Road, is truly its own distinct community. Such would not be the case with the Sundial subdivision, as the developer's plan calls for single-unit homes. Also, the only ingress and egress routes are through the Turtle Creek subdivision. Anyone who lives outside of the neighborhood would understandably assume Sundial is a continuation of Turtle Creek.
