I am writing to express my concern and opposition to the In-&-Out (I&O) fast food location located near the Costco at Lost Rapids and Ten Mile roads. My concerns are as follows:  I&O has requested to be open until 2 AM. This will be disruptive to nearby homeowners with constant traffic, noise associated with the traffic and lights that will shine and disturb residents far into the night.  Costco will again petition the city to allow semitruck deliveries to Costco along Tree Farm and Lost Rapids past the current 10 PM cutoff.  ‘Customer flow’ information that I&O provided is flawed. It compares our neighborhood area with ten California-based locations, none of which is located in residential or semi-residential areas.  The ‘traffic study’ that I&O paid for and provided is similarly flawed. It looks only at the Ten Mile/Lost Rapids intersection on three days in early December. It does not consider the various choke points with the accident-prone entrance north of the intersection, does not consider the Chinden/Lost Rapids traffic, and does not include the weekly event traffic for eight months out of the year for Hero’s Park or the 60-plus vehicles for four days a week parked at Keith Bird Park and along Lost Rapids. It does not consider the Adero Park subdivision that will be presented in May that will add 270 homes between Bainbridge & Walmart. My opposition is only focused on this specific location; sites less than a mile away in any direction are preferable to this one and removes the restaurant from almost every neighborhood concern. The city can and should deny the requested location, order a city sponsored traffic analysis, or approve the request with conditions to restrict lights and noise infiltration to mitigate the adverse effects on the community.
