Re: Request For a Conditional Use Permit to Allow a Group Childcare Home for up to
12 Children at 410 E. Edgar Court, Located in an R-8 Zooe by Kathy Jordan
(File No. CUP-02-038).
We have reviewed this submittal and offer the following comments, as conditions of the applicant.
These conditions shall be considered infull, unless expressly modified or deleted by motion of the
Meridian City Council:
APPLICATION SUMMARY
The applicant, Kathy Jordan, has requested approval of a group childcare home at 410 E. Edgar
Court. Approved group childcare homes may care for up to twelve (12) children each day and
requires the approval of a conditional use permit in the R-8 zone prior to beginning the daycare use.
In 1997, the applicant was approved for a family childcare home permit to care for up to five children
in her home at the subject property. The applicant maintained the daycare permit at her home until
1999, when she opened a commercial daycare at 1131 Cherry Lane, dba "Kinder Kollege."
Presently, the applicant has decided to leave the daycare operation on Cherry Lane and is looking fur
a different location to either construct or locate a new daycare facility. Several months ago the
applicant attempted, unsuccessfully, to obtain a conditional use permit to move the daycare to 1930
N. Linder Road (File No. CUP-02-021). Until the applicant can find a suitable location for a new
daycare facility, she wishes to use her own home as a daycare facility for up to twelve children. This
will allow her to maintain and serve a portion of her clientele and to continue providing work for two
employees.
The lease for the Kinder Kollege day facility on Cherry Lane ended on November 30th and the
applicant began running the daycare at her home, without a conditional use permit, starting on
Monday, December 2, 2002. Code Enforcement received a complaint and has visited the home to
noritY the applicant that the operation of the daycare without a permit is illegal, and is pWlishable
as a misdemeanor. At the time, no action had been taken by the applicant to cease operation of
the daycare.

LOCATION & SURROUNDING USES
The subject property is located at 410 N. Edgar Court, approximately V. ofamile east of Meridian
Road and 50 feet south of Us tick Road.
The following uses surround the subject property:
North - Ustick Road and rural residential land, zoned RUT (Ada County).
South - Single-family dwellings, zoned R-8.
East - Single-family dwellings, zoned R-8.
West - Single-family dwellings, zoned R-8.
STANDARDS FOR CONDmONAL USES
The Commissioo and Council shaD review the particular facts aod circumstances of each
proposed cooditiooal use in terms of the foUowiog and may approve a conditional use permit
if they shall fiod evideoce presented at the hearing(s) is adequate to establish (11-17-3):
A. That the site is large enough to accommodate the proposed use aod aU yards, open
spaces, parkiog, landscapiog aod other features as may be required by this ordioante;
Staff finds that the subject property is large enough to accommodate the requested
childcare use, however parking for the proposed use appears to be limited to on street
parking and pick up. With two staff members and the homeowner's own vehicles parked
in the driveway and/or garage, there will not be any room for customer parking in the
driveway, and will therefore be required to park in the street. The MCC does not prohibit
street side parking and loading for residentially located childcare facilities. However,
additional parking in the street may adversely affect neighboring residential uses.
B. That the proposed use aod developmeot plao wiD be harmonious with the Meridian
Comprehensive Plan aod io accordaoce with the requiremeots of this Ordioaoce;
The current Comprehensive Plan Land Use Map designates the property as "Medium
Density Residential". Stafffinds that the requested childcare use is a conditional use
within the Meridian Zoning Ordinance and is in hannony with the Comprehensive Plan.
C. That the desigo, construction, operation, aod maioteoaoce will be compatible with
other uses io the general oeighborhood aod with the existiog or intended character
of the general vicinity aod that such use will oot adversely change the essential
character of the same area;
Staff finds that the proposed daycare use may have the effect of changing the residential
character of the existing neighborhood by bringing in non-residential traffic into an

existing residential subdivision. F onnal complaints have been registered with the Meridian
Code Enforcement Officer by neighbors of the applicant regarding extensive on-street
parking, frequent trips by child-transport vans and other nuisance matters related to the
illegal daycare operation.
Staff recommends that the Commission and Council carefully consider public testimony
offered at the public hearing prior to making this finding.
D. Tbat the proposed use, if it complies with all conditioos of the approval imposed,
will oot adversely alTect other property io the vicioity;
Commission and Council should rely upon public testimony to determine if the
development will adversely affect the other property in the vicinity.
E. That the proposed use will be served adequately by esseotial public facilities aod
services such as bighways, street, police, aod tire protectioo, draioage structures,
refuse disposal, water, sewer or that the person respoosible for the establishmeot of
proposed conditional use shall be able to provide adequately aoy such services;
Staff finds that the proposed development will be adequately served by the essential public
facilities and services listed above.
F. That the proposed use wiD not create excessive additional requirements at public
cost for public facilities aod services and will oot be detrimental to the ecooomic
welfare of the community;
Staff finds that the proposed use would not be detrimental to the economic welfare of the
community, nor would it create the need for any new facilities or services to be paid for by
the public.
G. That the proposed use will oat iovolve activities or processes, materials, equipment,
and cooditioos of operation that wiD be detrimeotal to aoy persoos, property, or
general welfare by reason of excessive production of traffic, ooise, smoke, fumes,
glare or odors;
Staff finds that excessive traffic, noise (if children are properly supervised), smoke, fumes,
glare or odors will not result from the proposed childcare use.
H. That the proposed use will have vehicular approaches to the property which shan be
so designed as not to create an interference with traffic 00 surrouoding public
streets;

Staff finds that the proposed use will not create significant interference with any traffic on
the surrounding public streets.
L That the proposed use will oat result io the destructioo, loss or damage of a oatural,
sceoic or historic feature coosidered to be of major importance.
Staff finds that no natural or scenic feature will be lost, damaged or destroyed by issuance
of this conditional use.
SITE SPECIFIC REOUIREMENTS
I. All landscaping shall be continuously maintained and any dead or dying vegetation shall be
replaced upon request from the City.
2. No signage is permitted as part of this application. If any is proposed it shall be in compliance
with the City of Meridian's Sign Ordinance. Temporary or portable signs or banners are
prohibited, and will be removed upon 3 days notice to the applicant.
3. All construction and site improvements shall conform to the requirements of the Americans
with Disabilities Act and the UBC (1997 Uniform Building Code). The UBC defines all
buildimls used in the daycare of6 or more children as an E-1II occupancv and must then meet
all standards as set forth in the UBC for such an occu!,ancy.
4. The applicant shall meet all of the licensing requirements of the State ofIdaho prior to
beginning operation. A copy of the State license shall be submitted to the Clerks office for
inclusion in the City's records.
5. Prior to any use of the residence as a group child care home, the residence shall be inspected
by the Meridian Fire Department and Meridian Planning & Zoning Department for
compliance with all relevant city ordinances and conditions.
6. Pursuant to the applicant's letter submitted with the application, no more than 12 children per
day may be cared for by the applicant at her home located at 4 ION. Edgar Court.
RECOMMENDATION
Staff is concerned by the fact that the applicant is knowingly violating existing City Code by
operating the daycare without a conditional use permit at this time. Staff cannot recommend
approval of this application for the daycare use at this location because of the existing violation.
Staff recommends that the City Council and the Planning and Zoning Commi~sion rely on public
testimony regarding affect the proposed daycare/existing illegal daycare facility will have on the
existing residential neighborhood.

Business Use of Common Areas
I am responding to your inquiry about the possible effect
on the insurance coverage of the Association if a business
used the common areas owned by the Association. I was able
to speak with Angela Webb with State Farm Insurance.
She indicated that your liability policy could be affected
if a resident operated a business from a home in the
Association and were to use the common areas for a business
related activity. If an event occurred from use of the
common areas, it is probable that the Association would be
named in any litigation. A first claim made against the
Association would result in an increase in your premium by
20 percent. A second claim would result in the cancellation
of your policy. Securing a liability policy for your
Association could be difficult. Chubb Insurance and Pipal
Anderson Insurance companies no longer insure homeowner
associations and she was not aware of any other insurance
companies that provide homeowner association insurance.
She encouraged you to take action to prevent the use of the
common areas by a business.

time for commercial or business activity.

The Board of Directors for Bedford Place has received notification that a resident of the
Association has filed an application with the City of Meridian to operate a Day Care
Center business from their home on E. Edgar Court. The application indicates they will
provide care to a minimum of twelve (12) clients.
The Board of Directors met to discuss this matter and concluded that having this business
as proposed would not be in the best interest of the subdivision. The principal concerns
the Board identified are:
Cl It would increase traffic on our streets as non-residents drive into the
subdivision.
Cl It creates a traffic hazard; cars must use a cul-de-sac to access and egress
the proposed Day Care facility.
Cl It could cause of decline in property values.
Cl There would be increased noise.
Cl Neighbors are opposed to the Day Care Center.
Cl There is inadequate parking to accommodate staff and visitors.
Cl The restrictive covenants specifically prohibit commercial or business
activity at properties within the subdivision.
Cl The restrictive covenants prohibit exterior modifications to a Lot without
the prior approval of the Architectural Review Committee and the type of
improvements that might be necessary to modifY the property for a Day
Care Center are inconsistent with the standards of the Association.
Cl The application does not limit the number of clients that may use the Day
Care Center, it only states there will be a minimum of twelve (12) clients.
Cl The subdivision was intended for single family residential use.
Cl The operation of a business at the property would cause a decline in the
appearance of the residence.
Cl Allowing one business in the subdivision could open the door to other
home based businesses. Ibis would erode the quality of life for all
residents.
Cl The business is not harmonious with the esthetic qualities of the
subdivision.
The Board of Directors recommends that members of the Bedford Place
Homeowners Association oppose the application of the permit to operate a
Day Care Center on E. Edgar Street. Attend the hearing on December 19,

The Ada County Highway District (ACHD) staff has received and reviewed the application and site plan for the Item
referenced above and is submitting this no review letter in response to the lead agency's request for comment.
Based on the submitted information, it has been determined that the proposed development will generate less than 10
additional vehicle trips per day (VTD); or improvements exist adjacent to the site and ACHD has no s~e improvement
requirements attributable to this application.
ACHD policy states that no site related improvements would be required for developments generating less than 10
additional VTD. If the site plan or use changes in such a manner that more than 10 additional vehicle trips per day are
generated, then ACHD will review the site plan and may issue requirements based on the ACHD PolicyManual.
ACHD policy requires that before any improvements of any kind are constructed or installed within the public right-of-
way, a permit or license agreement permitting the improvements must be obtained.
All future design plans and construction shall be in accordance with the Ada County Highway District Policy Manual,
ISPWC Standards and approved supplements, Construction Services procedures and all applicable ACHD Ordinances
unless specifically waived in writing by the District. Meet District drainage requirements per section 8000 of the ACHD
Development Policy Manual. Contact District staff at 387-6170 for details.
Please contact the office for determination of possible road impact fees, prior to obtaining a building permit. These fees
are collected in accordance with Ordinance #195, the Ada County Highway District Road Impact Fee Ordinance.

My son has been going to Kinder Kollege for almost a year. I have seen him
grow and learn in this time. The teachers at Kinder Kollege have been wonderful to my
son. The teaching that is done there is exceptional such as: Infant sign language, forgien
language, and many other activities. As a parent that has to take a child to daycare
I want nothing but the best for my son, I have found that at Kinder Kollege. It would be
wonderful if they were able to expand into a bigger daycare. Having more space for the
children could have even a greater gain for my son and all of the other children.

It is the opinion of myself and my wife that the Kindergarten College (operated bv Kathv
Anderson) is a completely worry free daycare. Kindergarten College is one of only a select few
deemed suitable for our children. Not only is it a clean and healthy environment, but the
children are also occupied with learning activities and regimens, We have used Kindergarten
College for two years and feel that we get personal care not just the typical sterilized chain
store service. Our children enJoy interacting with the other children at Kindergarten College
and consider them friends All in all Kindergarten College rates an A+ In mv opinion

Dear Kinder Kollege,
We just wanted to let you know how pleased we are with all the teachers
and the everyday atmosphere that exists at Kinder Kollege.
We have noticed how many of the teachers are committed to the one on
one care that we so desire for our two boys. The manners the boys
continue to use shows that your staff is concerned about raising good well-
mannered children.
The hands-on experience the boys have every day they spend with your
staff helps them to understand many of the small daily detailed items we
would focus on ourselves and we feel it is wonderful for the children. We
appreciate the fact we know the boys aren't just sitting in a room watching
TV. day in and day out and that they are actually getting out into the
community and seeing and experiencing such learning experiences as the
grossology museum and the weekly activities of the tumble bus.
I would hope that you continue to teach the Spanish and sign language.
We enjoy the thrill the boys have when they are able to teach something to
us.

Re: Letter of Recommendation for Kinder Kollege
To Whom It May Concern:
I want to start off by saying that my husband and I feel very blessed to have found
Kathy and her staff at Kinder Kollege. Our little gir( Riley, is two-years old and
loves going to Kinder Kollege. Our first experience with daycare in Meridian was
. absolutely horrible so when we found Kinder Kollege it was as if our prayers had
been answered. I feel completely comfortable leaving her there every morning
because I know that she is in great hands. They constantly have activities going for
the children which keeps their minds stimulated and their bodies active. Our /title
girl even knows a few different words in sign language. Riley has gotten to take
part in a couple of the outings at Kinder Kollege, such as going to Zoo Boise, and at
least once a week they all walk to the park. She also loves Thursdays because that
is when the Tumble Bus comes. Kathy and her crew have always been extremely
dependable, cooperative and flexible with us and our needs.
Bottom line... I can't communicate enough to you how lucky we are to have found
Kinder Kollege and I would recommend anyone to toke their child(ren} to Kinder
Kollege.

To Whom It May Concern.
My son who is three years old and my daughter who is eight years old
have been attending Kinder Kollege for one year and they both love it.
The staff is very dedicated to meeting each individual child needs. They
have very flexible hours, reasonable rates with flexible payment schedules, and
they serve very nutritional meals for breakfast. lunch, and also at snack time.
During the school year Kinder Kollege has very structured and fun class
times, with classrooms that will best fit your child's age group.
My son has learned so much, for example: his a. b.c' s, how to speak in
Spanish, his colors, and even some sign language. When my daughter attends
Kinder Kollege after school, they tudor her in subjects that she is struggling with
in school.
During the summer they go in field trips to the Idaho Botanical Gardens
and the Zoo just to name a few. They also attend swimming lessons, go to the
park, or sometimes you will walk up to a water fight.
I can not imagine other parents disagreeing with me when I say this truly
is a safe and great place for your children.

RE: Kinder Kollege
To whom it may concern:
When I was asked if I would write a letter of reference for Kathy Anderson Jordan, I
accepted without hesitation.
I have been taking my son Jared to Kathy's. full-time 7:15a-5:45p. for almost two years.
June will be the two year mark.
Kathy has been a godsend for my family and me. Jared had been kicked out of three
daycare facilities by the time I found Kathy through childcare connections. Kathy was
more than willing to give Jared a trial run.
Jared loved Kathy immediately. He is very excited to go to her place and gives her lots
of hugs and kisses when he has to leave at the end of the day. Jared had a hard time
playing with other children and often had many confrontations during the day.
Kathy alwavs explained his day to me in a way that said we will try again tomorrow and
I am sure it will be better, She never gave up hope on Jared. In a very memorable
instance she had indicated to me that some of the parents expressed their lack of patience
for Jared's behavior and she in return explained to them that if she gives up on him so
will the next person and the next and the next. It needs to stop somewhere and she was
willing to keep trying. even if this meant he had to be her shadow. In September, 3 1>2
months after starting with Kathy, Jared was diagnosed with ADD/ADHD, and put on
medication. life began to take on some normalcy and Jared was a new kid.
If it wasn't for Kathy's patience. understanding, love and care for Jared, he would have
been cast out to start over again and be rejected once more-he could not have taken
that rejection again. I am very grateful for everything she has done and continues to do
for Jared.
Kathy's daycare facility is one that provides for fun learning and social interaction with
other children. The daycare is always clean and full of smiling faces. There are many
pictures and paintings on the wall to display the children's works of art and they will
gladly show you which one is theirs.
Jared expresses his love for Kathy even at our home and often asks on Saturday and
Sunday why he is not going to Kathy's today. This bond and stability helps Jared cope
with the many struggles he still has today.
