Final Plat Modification Application - Request
to Modify the Approved Fencing and
Landscaping for Madelyn Estates Subdivision

Staff has reviewed this submittal and offers the following comments:

The applicant, Pacific Landmark Development, has applied for a fmal plat modification to amend the
approved fencing and landscaping for Madelyn Estates (aka Basin Creek) Subdivision. The modification
request is to allow the following:
· Replace the approved, currently required, six-foot high masonry wall along the eastern
boundary of the subdivision adjacent to Locust Grove Road with a six-foot high ornamental iron
fence with decorative rock veneered columns spaced every 40 feet.
· Replace approximately 60 percent of the area indicated as sodded lawn on the approved
landscape plan with seeded lawn.
· Reduce the size of the approved/required picnic shelter by approximately 40% to coincide with
the concrete pad beneath it.
· Reduce the size of the approved/required seatwall surrounding the basketball courts by
approximately 50% to allow for better access to the basketball courts.
· To allow for a revised driveway location for the existing home on this site, a minor alteration to
the approved landscaping along Larkwood Street is proposed.
Madelyn Estates Subdivision is located at 5603 N. Locust Grove Road in T. 4N., R. IE., Section 30. The
fmal plat for the Madelyn Estates Subdivision has not yet been recorded.

STAFF ANALYSIS & RECOMMENDATION
UDC ll-6C-2B states: "It shall be the responsibility and liability of every applicant, and the owner of the
land being subdivided, to construct and install every improvement shown on the plat of the subdivision,
represented to be included in the subdivision at any presentation before the commission or the city
council, and all improvements required by the ordinances of the city specifically including the
requirements of this article, and this responsibility and liability shall be personal to the developer and the
owner and shall also run with the land, and this responsibility and liability shall be shown on the plat of
the subdivision. (Ord. 05-1170, 8~30-2005, eff. 9-15-2005)" Due to the fact that the applicant is
requesting to change some of the elements on the approved landscape plan, that were presented to the
City Council at a public hearing, this application to modify to the final plat landscape plan is required.

After a detailed review of any applicable landscaping and fencing standards, staff did not identify any
area where the above mentioned changes would conflict with any UDC standards or site specific
conditions of approval for this project. Staff also believes that the proposed modifications are minor and
should not have any detrimental or significant impact on the development, or the surrounding properties.
Furthermore, staff reviewed the meeting minutes for both the preliminary and final plat applications for
this property to identify if any of the requested changes would conflict with any testimony at the public
hearings for this project. No such testimony was found. For these reasons, Staff recommends approval
of the proposed final plat modification to amend the approved fencing and landscaping for
Madelyn Estates (MFP-06-006), as proposed by the applicant.
