RE: Development agreement Modifica?ons to Jump Time MDA008

Meridian Planning and Zoning Commision,
On behalf of Babcock LLC, DRSA Design is submitting a request to modify the Original Macha
Retail Plaza (AZ-09-003) Development agreement. The request is to allow uses previously
prohibited under the previous modification to Jump Time MDA008.
We are requesting that section #6 of the development agreement be modified to allow for the use
of minor vehicle repair which #6 currently prohibits. The proposed modifications would read as
follows:
“The uses allowed pursuant to this agreement are those uses allowed in the C-C zoning district
listed in UDC Table 11-2B-2 except for the following: drinking establishments, fuel sales
facility, minor vehicle repair, vehicle washing facility, wireless communication facility and vehicle
sales and rentals.
With the previous modifications minor vehicle repairs were excluded from allowed uses due to
site circulation and lack of connectivity to neighboring sites. Recently the eastern cross access
easement has been improved which now provides secondary access to the site. Concerns of
one-way access have been reduced with this second access and safety concerns for numerous
cars crossing the site have been minimized.
Additionally, during our neighborhood meeting the representative of the eastern property was in
favor of the proposed modification to the DA.
