Based on the submitted information, it has been determined that the proposed development will generate less than 10 additional vehicle trips per day (VTD); or improvements exist adjacent to the site and ACHD has no site improvement requirements attributable to this application. ACHD policy states that no site related improvements will be required for developments generating less than 10 additional VTD. If the site plan or use changes in such a manner that more than 10 additional vehicle trips per day are generated, then ACHD will review the site plan and may issue requirements based on the ACHD Policy Manual. ACHD policy requires that before any improvements of any kind are constructed or installed within the public right-of- way, apermit or license agreement permitting the improvements must be obtained. All future design plans and construction shall be in accordance with the Ada County Highway District Policy Manual,_ ISPWC Standards and approved supplements, Construction Services procedures and all applicable ACHD Ordinances unless specifically waived in writing by the District. The proposed amendment would allow a two foot (2') encroachment into the required front, rear and side yard setbacks for a variety of architectural structures such as covered patios, porches, and pop out windows. The amendment would also permit an uncovered balcony to project four feet (4') onto the rear yard setback. In addition to the encroachments, the amendment proposes a fifteen foot (15') front yard setback for side entry garages and living areas. The MCC currently allows a front yard setback of fifteen feet (15') for living areas in the R-4 and R-8 zones, but specifically excludes gazages from being included in the fifteen foot (15') setback allowance. The requested zoning amendmem does not violate any of the requirements of the Uniform/International Fire Code (UFC/1FC) or the Uniform/International Building Code UBC (IBC). Staff does not have any major objections to the proposed zoning amendment. The setback encroachments will allow for more flexibility in the design of homes built on narrow lots found primarily in higher density subdivisions, and the amendment may have the effect of creating a more inviting streetscape by encouraging the use of front porches and pulling the homes closer to the street. Although staff does not object to the intent or the content of the proposed zoning ordinance, we offer the following recommendations and revisions to the proposed zoning amendment for purposes of clarification and improvement (strike-though to be eliminated, bold is to be added): Mayor and Council November 26, 2002 Page 2 The proposed MCC 11-9-2D1b shall be revised to read as follows: ".... mayproiect up to ", two feet ~) into any required rear yazd. In addition..." 2. The proposed MCC 11-9-2D3 shall be revised as follows: "The following encroachments shall be permitted in ar}v the front vazd of the R-4, R-8 and R-15 zones. 3. The proposed MCC 11-9-2D3a shall be revised to read as follows: "...setback provided that the distance measured alone the inside edge of the drivewayfrom the property line to the garage is not less than twenty feet (20'). Side entry garages located less than twenty feet (20') from the property line shall include at least one window, no less than six (6) square feet in size, facing the street. 4. MCC 11-9-1(9) shall be modified to read as follows "The setback may be reduced to fifteen feet for living azeas .and side entr~garaees in accordance with MCC 11-9-2D3. ADDITIONAL CONSIDERATIONS As mentioned earlier, the proposed ordinance does not violate any of the requirements found in the Uniform (International) Fire Code, however the Meridian Fire Department does have reservations about adopting an ordinance that will reduce setbacks between buildings and thereby reducing the space in which they have to work in the event of a fire, and increasing the possibility of the spread of fire from one house to another. The fire safety issues regazding reduced setbacks or encroachments into existing setbacks can be exacerbated by allowing the encroachments in a subdivision that has already been approved with reduced setbacks. For example, several recent subdivisions have been approved with five foot (5') side yazd setbacks, regardless of whether or not the home is a one-story or two-story building. Therefore if two homes built side by side, and both aze two-story homes with two foot "encroachments" built opposite one another, the actual distance between each home would measure just six feet {6'). If a fence is built between the homes there would only be three feet (3') of side yazd area for a firefighter to conduct field operations, such as rescue and fire suppression pass though during a fire. Staff recognizes that the above scenario is a worst case scenario; however it is a possibility and the placement of a fence in between two, two story buildings with reduced setbacks is a definite probability. Special consideration should be made concerning the reduction of setbacks within future planned developments with regards to fencing between buildings and the proposed amendment to allow encroachments into already reduced setbacks. Architectural Projections. The suggested modifications will greatly increase the flexibility in home design and provide for more visually appealing street scenes by creating architectlral interest and minimizing the dominance of garage doors. Architectural projections have long been used to create visual interest. Bay windows, window seats, fireplace "pop-outs", porches, etc. have literally been used for hundreds of years in order to create architectural interest. This technique was utilized on small lots as well as lazge and is a primary reason for the popularity of historic homes throughout the country. An allowance for reduced setbacks for porches and side entry garages will greatly reduce the dominance of garage doors on the street scene in new subdivisions. In addition, it will allow homes to be situated closer to the street so as to help encourage interaction between neighbors. Locating homes behind garages, far removed from the street, has a tendency to eliminate the "human scale" factor that is essential for social interaction and a sense of community, the benefits of which generally include reduced crime and increased property value. The setback standards and zoning regulations implemented by the city need to be a dynamic tool capable of changing with time and the mazket conditions. As ]and becomes scarcer and lots become smaller, homebuilders are maximizing the building envelope and thereby foregoing the opportunity for modulating building elevations and facades. Approval of this ordinance amendment would allow for a reintroduction of architectural projections and details that create visual interest in our homes while maintaining compliance with local and national building codes.. We are planning on building homes in North Meridian projects in the near future and most immedeatly in Heritage Commons. These guidelines enable us to better utilize a smaller building envelope that is more common to us in today's Planned Developments. With development and infrastructure costs becoming so expensive, developers have to make lots smaller and more compact, forcing builders to rr~dmize the amount of building on each lot. This amendment would allow more flexibility in our housing designs to be able to include nice porches, columns, chimneys and other elements that add aesthetic curb appeal, while stiq mabmizing the effiaency of each lot. The concern is that the setback combined with the depth of the eaves will lead to decreased separation and rapid fire spread The fire department would like to request that all amendments to required setbacks meet the minimum requirements of the Uniform (International) Building and Fire Codes. 11-9-2: SUPPLEMENTAL YARD AND HEIGHT REGULATIONS: In addition to all yard regulations specified in the Zoning Schedule of Bulk and Coverage Controls and in other sections of this Title, the following provisions shall be adhered to: A. Visibility At Intersections: On a comer lot in any district, nothing shall be erected, placed, planted or allowed to grow in such a manner as to materially impede vision. (See figure in Section 11-20-2 of this Title for illustration.) B. Yard Requirements For Multi-Family Dwellings: Multi-family dwellings shall be considered as one building for the purpose of determining front, side and rear yard requirements. The entire group as a unit shall require one front; one rear and two (2) side yards as specified for dwellings in the appropriate district. C. Requirements For Nonresidential Uses Abutting Residential Districts: Screening and/or other buffer requirements, as stipulated by the Commission or Council, shall be provided. Said screening at a height of six feet (6'), maintained in good condition and free of all advertising or other signs; for screening required for parking areas, see subsection 11-13-4B of this Title. A 15 foot {15') front vard setback may be permitted for a residence provided that it is designed with living space floor area that projects anv distance in from the garage face to the front lot line c.
