SUBJECT: . TE-07-001 Request for an eight month time extension to record the fmal plat for Secret Garden Subdivision We have reviewed this submittal and offer the following comments: APPLICATION SUMMARY The applicant, Oliver Cleaver, has requested approval of an eight month time extension to record the final plat for Secret Garden Subdivision. The final plat consists of 6 single-family residential building lots, 1 commercial office building lot, and 1 common area lot on approximately 1 acre in the R-8 and L-O zones. The final plat (FP-04-077) for Secret Garden Subdivision was approved by the Meridian City Council on January 4,2005. In 2006, the applicant applied for, and the Planning Director granted, a one year time extension to record the final plat which expired on January 4,2007 (TE-05-015). NOTE: As required by the UDC, the applicant submitted the subject time extension request prior to the above-mentioned expiration date. The applicant states that the delay in recording the plat is due to a fall-out between him and Pinnacle Engineers. The applicant further states that it is his responsibility to see this through and he intends to do so. The applicant states that all that is left is to submit water and sewer easements along with shared parking cross-access easements, and to finalize the CC&R' s that are currently in fmal draft form, which should be completed and submitted to the City by January, 2007. However, as ofthe print date of this report, the applicant has not submitted the remaining items to the City but the applicant states that he is almost ready to do so. For the reasons stated above, the applicant is unable to meet the time requirements specified in Unified Development Code (UDC) 11-6B-7 and is requesting an eight month time extension to record the tinal plat. The City of Meridian's Unified Development Code (UDC ll-6B-7C) allows the Director to authorize a single extension of time to record the fmal plat, not to exceed 18 months, when the applicant files a written request for an extension prior to the expiration of the plat. Additional time extensions up to 18 months as determined and approved by the City Council may be granted. With all extensions, the City may require compliance with the current provisions of the UDC as a condition for granting a time extension (UDC 11-6B-7C). Staff believes that there are no additional conditions that should be added to those approved by the City Council with the final plat for this subdivision. LOCATION The property is located on the east side ofN. Locust Grove Road, approximately Vz mile south ofE. Ustick Road, in the NW ~ of Section 5, T.3N., R.IE. STAFF RECOMMENDATION Staff recommends approval of an eight month time extension to record the final plat for Secret Garden Subdivision to expire on September 4,2007.
