Re : Concern Regarding In - N - Out Burger Proposed at Ten Mile & Lost Rapids
Dear Commissioners ,
I am writing to formally express concern regarding the proposed In - N - Out Burger project at
the northwest corner of Ten Mile Road and Lost Rapids Drive . This location , bordered on
three sides by residential housing , poses significant traffic , noise , and community
compatibility issues— especially related to proposed late - night operations and delivery
schedules .
My family and I live at 6040 N Ten Mile Rd , just * * 33 yards from the proposed drive -through
speaker * *. We are a * * family of five with three young children * *, and we are extremely
concerned about the direct impact this project will have on our daily lives and well- being .
It 's important to note that * * In - N - Out is a California - based business with over $ 1 . 8 billion in
annual revenue * *. While their business success is admirable , they are * * not a local
neighbor * * and will not bear the daily consequences of this location choice— our families
will . There are alternate locations without 3 sides of residences .
According to the In - N - Out 's own focused traffic analysis , Ten Mile Road is already operating
at * * Level of Service ( LOS) E Unstable Flow* * during peak hours . LOS E means traffic is
operating at or near * * full capacity * *, with * * unstable flow * * and little room for disruption .
This is the final threshold before * * system failure ( LOS F) * *.
The project is expected to add * *2 , 457 external vehicle trips per weekday* *, increasing
congestion in an area already stressed by the nearby Costco development and its traffic
volumes .
Most concerning are the proposed " late - night hours**-1 : 00 a . m . on weekdays , 1 * 30
a . m . on weekends—with * *delivery activity scheduled after 2 * 00 a . m .* * This will bring .
- Noise from drive -through speakers , idling engines , and delivery trucks
- Bright lights throughout the night
- Constant activity mere feet from residential bedrooms
A commercial operation of this scale and intensity is * * inappropriate in a setting so tightly
surrounded by homes * *.
I respectfully urge the Planning and Zoning Commission to prioritize community health ,
neighborhood integrity, and residential peace when evaluating this proposal . A Denial of
conditional use will not keep In - N - Out out of the valley, they will just go to a more sensible
location less residential location .
