Location: approximately 1,200 feet east of the intersection of Franklin Road and Eagle Road. .
Applications: preliminary plat
Highlights of Proposed Development: The preliminary plat proposes 8 lots With a mix of C-G
and I-L lots. Portions of this site have already been developed, including the Ashley Furniture
Building on the southwest corner of the property (proposed Lot 4, Block 2) and the Lanark
Warehouse complex at the north end of the site (proposed Lot 1, Block 1).
Other: In 2004, the current property owner applied for and received approval for an
administrative lot split (MI-04-007) on this property. The purpose of that one time split was to
create the 3.74 acre parcel on which the Ashley Furniture store now sits and a 35.55 acre parcel
on which the Lanark Warehouse building now sits. As part of that parcel split the applicant
agreed to subdivide the entire property and include both the 3.74 acre parcel and the 35.55 acre
parcel as lots in a future subdivision. The applicant submitted the subject subdivision to fulfill
that requirement.
Commission Recommendation: approval at their December 7, 2006 public hearing.

Key Commission Changes to Staff Recommendation:
i. The 35-foot wide street landscape buffer along Franklin Road can be constructed on a lot
by lot basis.
11. The 25-foot wide landscape buffer between uses can be reduced to 10 feet. (Note: Staff is
concerned that the City is routinely reducing the required buffer for this particular
applicant without providing alternative standards.)
111. Prior to submittal of the Final Plat application for this project, the applicant shall receive
City Council approval for a rezone application on this property. The rezone application
shall at a minimum adjust the zoning district boundary lines on Lot 3, Block 2 and Lot 3,
Block 1 to coincide with the proposed northern lot lines.
Outstanding Issue(s) for City Council:
i. The revised landscape plan and preliminary plat submitted by the applicant still does not
clearly show the required 35-foot wide street landscape buffer along Franklin Road
exclusive of ACHD right-of-way, as required with Conditions 1.1.4 and 1.1.10.
