A Meeting of the Meridian City Council was called to order at 6:13 p.m. Tuesday,
February 25, 2025, by Mayor Robert Simison.
Members Present: Robert Simison, Luke Cavener, Liz Strader, John Overton, Doug

RESOLUTIONS [Action Item]
1. Resolution No. 25-2502: A Resolution Establishing the Appointment
of Jimmy Smith to Seat 4 of the Meridian Arts Commission; and
Providing an Effective Date
Simison: No one signed up. So, with that we will move on to Item 1, which is
Resolution No. 25-2502, appointing Jimmy Smith to Seat Four of the Meridian Arts
Commission. As always sat down with the new chair of the Arts Commission and did
interviews of two well qualified candidates. They actually had a former commissioner
want to come back from -- one of the original members of the Commission, but he and
decided to go work on a separate project together and that was great, because it gets
two great people involved in the arts in our community. So, Jimmy -- he -- he is familiar
with the people there. He has actually been -- he's actually shown up at some of the
recent Arts Commission meetings and someone who has really shown a dedication to
getting involved in the arts in Meridian. Always interested in having someone whose
livelihood is around the arts. You know, sign painting is not maybe your traditional art in
a lot of ways, but it's -- it's definitely an artistic component and he is going to be working
on some of the arts across Treasure Valley that CBH is coming out. So, definitely, you
know, being part of it, but he has already shown a dedicated interest in arts in Meridian
by his -- by showing up when he has the time and interest in getting involved. So,
know he will be a great addition to the Arts Commission and happy to stand for any
questions or move forward with a motion on the resolution.

Strader: I don't have any questions. I don't know -- I would be happy to make a motion,
though, that we go ahead and approve Resolution 25-2502, establishing the
appointment of Jimmy Smith to Seat Four on the Meridian Arts Commission and
providing an effective date.

Simison: With that we will move on to Item 2, which public hearing for Pura Vida Ranch
Subdivision, TECC-2025-0001. We will open this public hearing with staff comments.
Allen: Thank you, Mr. Mayor, Members of the Council. The first application before you
tonight is a request for a time extension on the previously approved preliminary plat and
planned unit development for Peda -- excuse me -- Pura Vida Ridge Ranch. This site
consists of 26.34 acres of land. It's zoned R-8 and R-15. It's located on the south side
of East Lake Hazel Road, approximately a quarter mile east of South Eagle Road at
3727 East Lake Hazel Road. This property was annexed back in 2021 and a
preliminary plat was approved consisting of 157 building lots and 35 common lots with
certain deviations from UDC standards under a planned unit development. In 2022 the
director approved a two year time extension allowing until January 19th, 2025, to obtain
the City Engineer's signature on the first phase final plat and commence the permitted
use. No additional conditions were imposed with that extension. The applicant
submitted a request for a two year time extension on the preliminary plat and planned
unit development to obtain the City Engineer's signature on the first phase final plat and
commence the permitted use. The request was submitted prior to the expiration date as
required. With all extensions the City Council may require the planned unit
development and/or preliminary plan to comply with the current provisions of the UDC.
The reasons for delay in moving forward with this development are continued

coordination with ACHD on drainage issues, completion of the Lake Hazel Road bridge
-- bridge improvements associated with the culvert for Ten Mile Creek where it passes
under the road and floodplain development requirements. The subject time extension
until January 19th, 2027, is requested to commence the use, complete the infrastructure
improvements currently occurring in phase one and obtain the City Engineer's signature
on the final plat. Staff has reviewed the updates to the UDC since the time this project
was approved pertaining to open space and site amenities and found the project
exceeds the updated standards. Staff is recommending a new condition as a provision
of the time extension that requires the seven foot wide sidewalk planned within the
street buffer along Lake Hazel to be widened to ten feet in width consistent with the
current standards. There has been no written testimony on this application. The
applicant is in agreement with the staff report. Staff is recommending approval. Staff
will stand for any questions. The applicant is here to present tonight.

Cavener: Real quick. Sonya, making sure -- this is the first time extension request?
Allen: Mr. Mayor, Councilman Cavener, no, this is the second time extension. The first
one was approved by the director for two years.
Cavener: Thank you.
Simison: All right. Would the applicant like to come forward? Good evening.
Williams: Good evening. Thank you, Mr. Mayor, Members of the Council. Mike
Williams. I'm with South, Beck and Baird. Our location is 2002 South Vista Avenue in
Boise and I'm also a resident of the City of Meridian, so I do drive into Boise for work,
unfortunately. Sonya mentioned that requirement of a ten foot sidewalk adjacent to
Lake Hazel. I want to let the Council know that that ten foot sidewalk has already been
installed. We are in agreement with all the conditions that have been placed. The
question regarding if this is -- what number extension this is. As part of the first
extension the infrastructure had not been started on this first final plat. The
infrastructure on phase one is complete with the exception of the installation of asphalt
and as all of you are aware they shut down asphalt typically about November due to
temperature and we are anticipating that the batch plants will come back online in
March, so we can get paved. The applicant is already working with the City of Meridian,
as well as ACHD to go ahead and do a surety, so we can get that first final plat signed.
With that I would stand for questions.

Allen: Mr. Mayor, may I clarify with the applicant one thing, please? Mr. Williams
mentioned that a ten foot wide sidewalk has been constructed. I'm a little concerned
about that, because they were showing seven feet on their plans before. Was it recently
constructed after my staff report went out?
Williams: And, Mr. Mayor, Sonya, yes, it has.
Allen: Okay.
Williams: When we talked about it -- and I know when we talked about the staff report I
reached out to the applicant, because I was kind of freaked out myself --
Allen: Yeah.
Williams: -- and they had already installed the ten foot sidewalk and the one thing that
is sad about that installation is we are going to get to move it based on the fact of ACHD
in their right of way -- something wasn't quite organized, so they are going to move a
portion of that sidewalk based on what ACHD's requiring for their drainage, but we are
going to construct that ten foot sidewalk.
Allen: Okay. Thank you. I just wanted to clarify. I didn't want to have a condition
requiring him to do one thing if they would construct it or otherwise, so -- thank you.
Simison: Council, any additional questions or comments? I will just say I was actually
surprised when I saw this on there, because I had driven by there and seen the work
being done and so that's why I was like -- it was -- it was kind of like -- you know, you
normally don't see work being done on one that you are doing a time extension on, so --
Williams: Mr. Mayor, I would agree. Before I retired from a certain city that's your
neighbor after 19 years as being a planner, I was -- would have been as shocked as
you, but, yes, they are close to completion. All we have to do is asphalt, a couple of
retaining walls and they are actually changing a couple of the parking areas from
asphalt over to concrete just based on -- they would rather do that and not have to
worry about the maintenance in the future.
Strader: Mr. Mayor?
Simison: Council Woman Strader.
Strader: Any issues with the second condition of maintaining the vegetation on the
hillside? It seems like a safety concern.
Williams: Mr. Mayor, Council Woman Strader, great question. As part of the preliminary
-- original preliminary plat approval we are required to provide a WUI safety plan,
because there is definitely hillside on this and that will be incorporated into the CC&Rs
where the homeowners will be responsible for maintaining that. I have had -- I want to

say two or three conversations with one of your fire department staff, so we can work
through that as well to ensure that that's inserted and we get all their concerns
addressed.
Strader: Thank you.

sidewalk along East Lake Hazel Road and maintaining the vegetation on the hillside to
the Fire Department's standards.

3. Public Hearing for Chicken Bucket Subdivision (SHP-2025-0001) by
Focus Engineering, located at 667 and 663 S. Main Street in a part of
Government Lot 2.
A. Request: Short Plat to subdivide an existing parcel consisting of
1.15 acres of land into two (2) commercial lots for ownership
purposes.
Simison: Next up is Item 3, which is a public hearing for Chicken Bucket Subdivision,
SHP-2025-0001. We will open this public hearing with staff comments and dipping
sauce.
Napoli: Good evening, Mr. Mayor and Members of the Council. The next item on the
agenda is the short plat for Chicken Bucket Subdivision. The applicant requests to
subdivide an existing commercial property into two commercial lots for ownership
purposes. This site consists of 1.15 acres of land, zoned C-G, located at 667 South
Main Street. The property currently consists of two commercial buildings situated on a
single lot with no proposed changes to the current uses or tenants. The two -- the two
proposed properties meet the dimensional standards for the C-G zoning district, except
for the required 35 foot landscape buffer along Meridian Road and Main Street.
However, since this is an existing development with no proposed changes beyond the
subdivision, an alternative compliance application is not required at this time. Future
redevelopment with the subject -- with -- future redevelopment of the property will be
subject to UDC 11-313-2, which permits phased landscape improvements as cumulative
expansions occur. The city will monitor any future redevelopment, including additions,
new construction to ensure compliance with these requirements. The parking is in
compliance with the UDC for both lots. However, staff is recommending a shared
parking agreement to be entered into between the two lots. Access to this property is
provided via South Main Street and South Meridian Road and the plat note states that
there is a blanket cross-access easement between the lots. Staff is recommending
approval with conditions and has received written testimony from the applicant asking
for some clarification on staff conditions. Staff and the applicant have coordinated on
these and are in agreement. And I will stand for questions.

Engineering and Surveying representing our applicant today and we -- Mr. Mayor and
Council, we appreciate you taking the time to -- to review our short plat application for
Chicken Bucket Subdivision, the best name ever. We appreciate working with Nick. He
has been great to work with and I don't have anything to add to the -- to what he has
presented to the Council. I do want to -- to add, again, that we have reviewed all of the
comments and conditions and the applicant is -- is willing to address those and address
those appropriately as we have worked with Nick to -- to make sure that we -- we
understand how to move forward appropriately. So, again, I don't have anything to add
and I stand for questions.

Whitlock: Mr. Mayor and Trent, just out of curiosity, why is the desire to split that for
ownership purposes? It -- it's -- it's not a big lot.
Smith: No, it's not a big lot and -- and I'm not fully in understanding of -- of the
ownership, but I think a portion of it is planned to -- to acquire a new owner and so this
is preparing that lot to -- to do so.

WHEREAS,the Meridian City Code § 2-2-1 establishes the Meridian Arts Commission, its
members and terms of their appointments; and
WHEREAS, the City Council of the City of Meridian deems it to be in the best interest of
the citizens of the City of Meridian to approve the appointment of Jimmy Smith to Seat 4 of the
Meridian Arts Commission as recommended by Mayor Simison and described herein;
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF MERIDIAN CITY, IDAHO:
Section 1. That, effective immediately, Jimmy Smith is hereby appointed to Seat 4, which
term shall expire on February 28, 2028;
Section 2. That this Resolution shall be in full force and effect on March 1, 2025.

Why you interested in serving on a board or commission .
I am very interested in promoting and improving public art. As a Sign Painter I am very invested in keeping our public
spaces infused with color and community. Public art is the best way that we can relate to each other and our surrounding
community and take pride in our public spaces. By taking pride in our public spaces we preserve and pay homage to the
intent and purpose laid in by our forefathers who built them . Also by promoting tasteful and meaningful public art
projects in our communities we also improve the quality of life for those who live in them When we can also employ local
artists in those communities we further invest in their future. I would greatly appreciate being considered for a seat on
the Meridian Arts Commission to be of service to the city and the community.

a chance to shape how communities grow , preserve natural spaces , and maintain a
balance between development and the environment . Idaho , in particular, is
experiencing a lot of growth , so there ' s a big need for thoughtful planning to
ensure that new development doesn ' t outpace infrastructure , resources , or the local
character.
For someone on a planning and zoning commission , there ' s an opportunity to
influence things like land use regulations , zoning ordinances , and growth
management policies . It ' s a way to make sure that development aligns with
community values , environmental considerations , and long-term sustainability.
Plus , the ability to help solve practical problems — like making sure there ' s enough

Size of property, existing zoning, and location: This site consists of 26.34 acres of land, zoned R-8 & R-15, located on the south
side of E. Lake Hazel Rd., ¼ mile east of S. Eagle Rd. at 3727 E. Lake Hazel Rd.
History: This property was annexed in 2021, and a preliminary plat was approved, consisting of 157 building lots and 35 common lots,
with certain deviations from UDC standards under a planned unit development. In 2022, the Director approved a 2-year extension,
allowing until January 19, 2025, to obtain the City Engineer’s signature on the first phase final plat and commence the permitted use.
No additional conditions were imposed with the extension.
Comprehensive Plan FLUM Designation: MHDR
Summary of Request: The Applicant submitted a request for a 2-year time extension on the preliminary plat & planned unit
development (H-2020-0064) to obtain the City Engineer’s signature on the first phase final plat and commence the permitted use. The
request was submitted prior to the expiration date. With all extensions, the City Council may require the planned unit development
and/or preliminary plat to comply with the current provisions of the UDC.
The reasons for delay in moving forward with this development are continued coordination with ACHD on drainage issues, completion
of the Lake Hazel Rd. bridge improvements associated with a culvert for Ten Mile Creek where it passes under the road, and floodplain
development requirements.
The subject time extension until January 19, 2027, is requested to commence the use, complete the infrastructure improvements
currently occurring in Phase 1 and obtain the City Engineer’s signature on the final plat.
Staff has reviewed the updates to the UDC since the time this project was approved pertaining to open space & site amenities and
found the project exceeds the updated standards. Staff is recommending a new condition as a provision of the time extension that
requires the 7’ wide sidewalk planned within the street buffer along Lake Hazel is widened to 10’ consistent with current standards.

Comprehensive Plan FLUM Designation: Commercial
Summary of Request: The applicant requests to subdivide an existing commercial property into two commercial lots for ownership
purposes.
The property currently consists of two (2) commercial buildings constructed in the early 2000s, which are situated on a single lot. The
purpose of the subdivision is to separate these existing buildings for ownership purposes, with no proposed changes to the current
uses or tenants.
The two proposed properties meet the dimensional standards of the C-G zoning district, except for the required 35-foot landscape
buffer along Meridian Road and Main Street. However, since this is an existing development with no proposed changes beyond the
subdivision, an alternative compliance application is not required at this time. Future redevelopment will be subject to UDC 11-3B-2,
which permits phased landscape improvements as cumulative expansions occur. The city will monitor any future redevelopment,
including additions and new construction, to ensure compliance with these requirements.
One space per 250 square feet of gross floor area is required for each building. The southern building is roughly 3,900 square feet
which requires 16 parking stalls. The applicant has subdivided the property to incorporate 17 parking stalls exceeding the requirement.
The northern building is roughly 3,700 square feet which requires 16 parking stalls. The applicant has provided 48 parking stalls
exceeding the requirement. Staff is recommending that a shared parking agreement be entered into and plat note # 6 includes a
shared parking agreement with the shared parking between Lots 1 and 2, Block 1. on Lot 2.
Access to this property is provided via S. Main Street and S. Meridian Road. The plat notes state there is a blanket cross-access
easement between Lot 1 and Lot 2, Block 1 to allow for access to both sites on either drive aisle. Since this is a blanket easement, it is
not depicted on the plat.

III. STAFF ANALYSIS
Comprehensive Plan and Unified Development Code (UDC)
A. General Overview
The UDC states that approval of a planned unit development and preliminary plat shall become
null and void if the applicant fails to commence the permitted use as set forth in UDC 11-513-6F
and obtain the city engineer's signature on the final plat within two(2)years of the approval of
the preliminary plat as set forth in UDC 11-6B-7C. If phased, each phase must be signed by the
City Engineer within two (2)year successive intervals. The Applicant may request an extension
of up to two(2)years if such request is filed before the termination period. With all extensions,
the City Council may require the planned unit development and/or preliminary plat to comply
with the current provisions of the UDC.
The Director approved a 2-year time extension for the preliminary plat and planned unit
development on December 15, 2022,which extended the original approval to January 19,2025.
The reasons for delay in moving forward with this development cited at that time are as follows:
continued coordination with ACHD on the drainage issues associated with the site; completion of
bridge improvements associated with the culvert for Ten Mile Creek drain where it passes under
Lake Hazel Road that are the responsibility of the developer of the property to the north(Orchard
Creek);vertical construction isn't allowed until the bridge is constructed and floodplain
development requirements are met; and the design of the roads for the subdivision is contingent
upon the bridge construction and resulting changes in the floodplain and a lengthy approval
process is anticipated with ACHD on the construction plans.
A second 2-year time extension is requested to commence the use and complete the infrastructure
improvements currently occurring in Phase 1. The extension would give the Applicant until
January 19,2027 to commence the permitted use and obtain the City Engineer's signature on the
final plat.
Since the preliminary plat was approved,there have been some updates to the UDC regarding
sidewalk widths along arterial streets and minimum open space and site amenity standards, as
follows:
• The minimum open space requirement changed from 10%,which required a minimuin of
2.63-acres to be provided,to 15%,which requires a minimum of 3.95-acres to be
provided. The amount of open space that was approved(i.e. 4.9+-acres or 18.57%+)
exceeds the current standard.

• The minimum site amenity requirement changed from one(1)qualified amenity to five
(5)amenity points. The previously approved amenities [i.e. a 10'wide 1,631+/-foot long
(1/3 mile) segment of the City's multi-use pathway system along the east boundary
adjacent to the Ten Mile Creek; a 16' x 16' shelter with a picnic table on Lot 10,Block 3;
an 8' x 12' arbor with 2 benches on Lot 1,Block 10; an arbor with 2 benches on Lot 8,
Block 5; and a dirt trail and paved 5' wide pathway on the hillside on Lot 8, Block 5]
meet and exceed the new standards at 5 pts. for the 1/3 mile of multi-use pathway,2 pts.
for the picnic area on a site 5,000 s.f. or greater in size,2 pts. open space commons
shelter(i.e. arbor with benches),and 2 pts. for trails/paths.
• A 7-foot wide detached sidewalk was approved within the street buffer along E. Lake
Hazel Rd. A 10-foot wide detached sidewalk is currently required.
As a conditions of the subject time extension,Staff recommends a 10-foot wide detached
sidewalk is provided in lieu of a 7-foot wide sidewalk along E.Lake Hazel Rd.; and
vegetation on the hillside is maintained regularly to prevent a fire hazard.

B. History and Process
The preliminary plat and planned unit development(PUD) (H-2020-0064)was approved by City
Council on January 19,2021.An administrative time extension(TED-2022-0009)for two(2)
years was approved by the Director on December 15,2022,which extended the PUD and
preliminary plat to January 19,2025.No new conditions were added as a provision of the time
extension. A final plat(FP-2021-0043)has been approved for the first phase of development but
has not yet received City Engineer signature; a modification to the final plat was approved(MFP-
2022-0001). The subject time extension application was submitted prior to the expiration date.
IV. CITY/AGENCY COMMENTS & CONDITIONS
A. Meridian Planning Division
1. Applicant shall comply with all terms of the annexation and zoning(Development Agreement
Inst. #2021-042520),preliminary plat,planned unit development(H-2020-0064), final plat
(FP-2021-0043), final plat modification(MFP-2022-0001)and previous time extension
(TED-2022-0009).
2. A ten(10)foot wide detached sidewalk shall be constructed along E. Lake Hazel Rd.
3. The vegetation on the hillside shall be maintained regularly to prevent a fire hazard.
4. The Applicant shall commence the permitted use and obtain the City Engineer's signature on
the first phase final plat on or before January 19, 2027; or, apply for a time extension prior to
that date as set forth in UDC 11-5B-6F and 11-6B-7, in order for the planned unit
development and preliminary plat to remain valid.

improvements as cumulative expansions occur. The city will monitor any future
redevelopment,including additions and new construction,to ensure compliance with these
requirements.
C. Design Standards Analysis
1. Landscaping (UDC 11-3B):
i. Landscape buffers along streets
A 35-foot wide street buffer is required adjacent to S. Main Street and S. Meridian Road,
arterial streets and designated as entryway corridors. This buffer should be landscaped
per the standards listed in UDC 11-3B-7C. The existing site is nonconforming with this
standard due to a mix of road widening projects and code changes since the original
entitlement of the property. Due to the existing nature of the site and no proposed
changes beyond the subdivision, staff recommends an alterative compliance application
not be required until future redevelopment. UDC 11-3B-2 allows for phased landscape
improvements as cumulative expansions occur. Staff will monitor these thresholds and
ensure compliance with the UDC.Additionally, the maintenance of the landscaping
along the frontage of each lot should state the responsible party for the maintenance of
these improvements in accord with UDC 11-3B-7C2.a and 11-3B-13.
ii. Tree preservation

A Tree Mitigation Plan should be submitted with the final plat signature application
detailing all existing trees and methods of mitigation outlined by the City Arborist before
any trees are to be removed as set forth in UDC 11-3B-1OC.5.
No trees are proposed to be removed with this application. However, any future changes
to the landscaping will require tree mitigation.
2. Parking (UDC 11-3C):
i. Residential parking analysis
Off-street parking is required to be provided in accord with the standards listed in UDC 11-
3C-5. One space per 250 square feet of gross floor area is required for each building. The
southern building is roughly 3,900 square feet which requires 16 parking stalls. The
applicant has subdivided the property to incorporate 17 parking stalls exceeding the
requirement. The northern building is roughly 3,700 square feet which requires 16 parking
stalls. The applicant has provided 48 parking stalls exceeding the requirement. Staff
recommends plat note# 6 include a shared parking agreement between Lots I and 2, Block 1.
Transportation Analysis
3. Access (Comp Plan, UDC 11-3A-3, UDC 11-3H-4):
Access to this property is provided via S. Main Street and S.Meridian Road. The plat notes
state there is a blanket cross-access easement between Lot 1 and Lot 2,Block 1 to allow for
access to both sites on either drive aisle. Since this is a blanket easement,it is not depicted on
the plat.
D. Services Analysis
1. Pressurized Irrigation(UDC 11-3A-15):
Underground pressurized irrigation water is required to be provided to each lot within the
subdivision as set forth in UDC 11-3A-15.
2. Storm Drainage (UDC 11-3A-18):
An adequate storm drainage system is required in all developments in accord with the City's
adopted standards, specifications and ordinances. Design and construction shall follow best
management practice as adopted by the City as set forth in UDC 11-3A-18.
3. Utilities (Comp Plan, UDC 11-3A-21):
Connection to City water and sewer services is required and are available to be extended by
the developer with development in accord with UDC 11-3A-21 and Goals 3.03.03G&
3.03.03F.Urban sewer and water infrastructure and curb, gutter, and sidewalks are required
to be provided with development of the subdivision.
III. CITY/AGENCY COMMENTS & CONDITIONS
A. Meridian Planning Division
1. If the City Engineer's signature has not been obtained within two(2)years of the City
Council's approval of the short plat,the short plat shall become null and void unless a
time extension is obtained,per UDC 11-6B-7.
2. The short plat and landscape plan prepared by Evan J. Wood, on 11/26/2024, included in
Section VI.A, shall be revised as follows:
- Graphically depict the landscape buffer easements along S. Meridian Road and S.
Main Street and reference the instrument number for the ACHD license agreement
for the landscaping within the right of way in accordance with UDC 11-3B-7C.2a.

- Include a note to reference the ownership and maintenance of the landscaping outside
of the right of way for Lots 1 and 2,Block 1.
Modify note#3 to include Lot 2,Block 1 into the cross-access agreement(2024-
074215) or amend the agreement to include Lot 2, Block 1.
- Modify note#6 to include a blanket shared parking agreement between Lot 1 and Lot
2,Block 1.
- Remove plat note#8. This would be better achieved outside of the plat as a separate
deed restriction.
Add a plat note stating direct access to S. Meridian Road and S. Main Street is
prohibited.
- Add a plat note stating all lots are subject to private blanket easements for irrigation
and drainage to the benefit of all lots.
3. Future development shall comply with the dimensional standards listed in UDC Table I1-
2B-3 for the C-G zoning district.
4. Staff's failure to cite specific ordinance provisions or conditions from the previous
approvals noted above does not relieve the Applicant of responsibility for compliance.
B. Ada County Highway District(ACHD)
IV. FINDINGS
A. Short Plat
In consideration of a preliminary plat,combined preliminary and final plat,or short plat,the
decision-making body shall make the following findings:
I. The plat is in conformance with the comprehensive plan and is consistent with this unified
development code;
The Comprehensive Plan designates the future land use of this property as Commercial, the
current zoning district of the site is C-G. Staff finds the proposed short plat complies with the
short plat standards listed in UDC 11-6B-5. The proposed development does not comply with
the dimensional standards of the C-G zoning district listed in UDC Table 11-2A-5 as the sites
do not have the 35 foot landscape buffer required. Due to the existing nature of the
development with no proposed changes beyond the subdivision, an alternative compliance
application is not required at this time. Future redevelopment will be subject to UDC 11-3B-
2, which permits phased landscape improvements as cumulative expansions occur. The city
will monitor any future redevelopment, including additions and new construction, to ensure
compliance with these requirements.
2. Public services are available or can be made available and are adequate to accommodate the
proposed development;
Staff finds that public services will be provided and are adequate to serve the proposed lots.
3. The plat is in conformance with scheduled public improvements in accord with the city's
capital improvement program;
Stafffinds all required utilities will be provided with lot development at the developer's
expense.

4. There is public financial capability of supporting services for the proposed development;
Staff finds that the development will not require major expenditures for providing supporting
services as services are already being provided in this area.
5. The development will not be detrimental to the public health, safety or general welfare; and
Stafffinds the proposed development will not be detrimental to the public health, safety or
general welfare.
6. The development preserves significant natural, scenic or historic features.
Staff is not aware of any significant natural, scenic or historic features associated with short
platting the structure on this site.
IV. ACTION
A. Staff:
Staff recommends approval of the proposed short plat with the conditions noted in Section VII of
this report and in accord with the Findings in Section VIII.
B. City Council:
Action Pending.
