I want to actually clarify my meaning & amend my comment regarding to the parking concern voiced in the Staff
Report:
1. Modify note #6 to include a blanket shared parking agreement between Lot 1 and Lot 2, Block 1. We
do not necessarily want this easement to be blanket between the two lots. We want the ability of Lot 2
(KFC) patrons to park on lot 1, but not have lot 1 patrons parking on lot 2. Since there is significantly more
parking on lot 1, there should not be a need for patrons of lot 1 to be parking on the lot 2 (KFC) side.

Nick,
After going through the Staff report with my client, we had a couple of questions regarding some of the concerns
raised in the report:
1. Graphically depict the landscape buffer easements along S. Meridian Road and S. Main Street and
reference the instrument number for the ACHD license agreement for the landscaping within the right of
way in accordance with UDC 11-3B-7C.2a. We can abide by this, and once we go to ACHD for review, we
can supply the instrument number for the license agreement.

2. Include a note to reference the ownership and maintenance of the landscaping outside of the right
of way for Lots 1 and 2, Block 1. Is this simply saying "lot 1 is responsible for landscaping in lot 1... etc). Is
there specific language for this that we need to provide?
3. Modify note #3 to include Lot 2, Block 1 into the cross-access agreement (2024-074215) or amend
the agreement to include Lot 2, Block 1. Can do!
4. Modify note #6 to include a blanket shared parking agreement between Lot 1 and Lot 2, Block 1. We
do not necessarily want this easement to be blanket between the two lots. Is this required? We would
prefer to have parking inside lot 1 to only be used by patrons of lot 1, same for lot 2.
5. Remove plat note #8. This would be better achieved outside of the plat as a separate deed
restriction. No problem
6. Add a plat note stating direct access to S. Meridian Road and S. Main Street is prohibited. This
comment does not make any sense to us. As it sits, the subdivision does have direct access to S. Meridian
Road and S. Main Street, and is currently built to support this. Is the intention of this to limit direct access
for lot 2? Can you clarify this for me?
7. Add a plat note stating all lots are subject to private blanket easements for irrigation and drainage
to the benefit of all lots. No problem
