Seel Subject: Development Agreement - Blue Marlin Please accept our application to modify the above referenced development agreement. As background information, Winston H. Moore owns 60 acres at the northwest corner of Ustick and Eagle. In early 2005, Mr. Moore submitted an application to annex and rezone the entire parcel to C-G. At that time we did not have any specific plans for the project, but felt it would be a commercial development based on strong interest from the retail sector. However, interested major retailers would not enter into serious discussions until the land was annexed and zoned for their use. Given the uncertainty of how the project would be developed, but the need to get the land annexed and rezoned, we agreed to a development agreement (dated April 12, 2005, instrument # 105048793) with the condition that HA conceptual master plan will be submitted with the planned development application or if the project is phased, a site specific plan will be submitted". The site specific plan would require a CU application. This development agreement was amended on April 13, 2006 to include 1.5 acres ofland and address landscaping requirements along the west property line (instrument # 106060856). We are now requesting that conditional use/planned development requirement be removed from the development agreement. In consideration for this modification we are proposing the following: .. We will submit the attached conceptual plan for the total project. Although the square footages are shown these are only estimates and will change depending on leasing. The lots fronting Eagle will be free standing buildings with uses allowed under the C-G zoning. The plan also includes design ofthe public road to the Meridian Planning & Zoning Department 9/13/2006 Page 2 project's north boundary} which has been reviewed by Ada County Highway District. .. The lots that border the west and north boundaries of the project will be free standing buildings. However} use restrictions will apply to this lots as listed in Exhibit A . .. The project will include five pedestrian walkways that provide continuity between the lots fronting Eagle and the main shopping center. In addition} as noted on the concept plan} we will construct three public gathering areas. An elevation of this sitting area is included. We believe these walkways will create a pedestrian fi-iendly center. We believe the concept plan combined with the restrictions on uses bordering the residential, the pedestrian friendly design and public gathering places should eliminate the concerns the Council had when they approved the annexation and rezone, and provide justification for now removing the conditional use requirement. Without this modification to the development agreement, we will need to submit a CD for every single project within CentrePoint Marketplace. The end result will be an ongoing burden on City Staff, Commissioners and Council. We thank you in advance for consideration of our request.
