RE: Bienville Square Subdivision - Access Variance
Mayor and Council:
As per legal and planning staff recommendations, we are resubmitting our Variance application
for a variance from Section 11-3H of the Meridian Unified Development Code, which prohibits
vehicle approaches to State highways.
Our current situation is a hardship in that we have no public street access other than the proposed
access to State Highway 55 (Eagle Road) for our development. We have discussed access to
Ustick Road with Landmark Development Group (the current owners of Sadie Creek Promenade
to the north) including street aligrunents and cross accesses. They have indicated that they are
not speculative developers and are not in a position to provide cross access until the development
oftbeir property. I have attached a letter from Tamara Thompson (Landmark representative)
dated June 30, 2006, reflecting their position. Since there is no assurance that access to Ustick
Road will occur in the near future if ever, our only access to a public street is SH 55 (Eagle
Road).
We have submitted the appropriate application for full access to SH 55 through ITD, which was
approved under Access Permit 3-05-066. Attached is the letter from ITD dated April 4, 2006
approving our permit with mitigating measures out lined in their approval letter of March 28,
2006, which we have agreed to comply with.
We understand the purpose for the cOlmecting streets paralleling the SH 55 to provide better
circulation and safety within the community. The use of connecting streets to shuttle traffic to
the 12 mile accesses to SH 55 is an excellent concept. The hardship we are experiencing is that a
collector street heading south from Ustick Road to the 'l'2 mile access is not possible due to
Carolyn Subdivision being located directly south of our property.
The access we are proposing to SH 55 is located at the Y4 mile point south of the intersection of
Ustick Road and SH 55. This access complies with ITD's Eagle Road Corridor plan and when
completed our full access will be reduced to a left in/right in/right out access, which we are
agreeable to. Such accesses have been approved by ITD to the north of this same intersection
where paralleling collector streets are possible and are being provided to the 12 mile accesses.
We have also amended our plan to provide for better circulation within our development in the
event Sadie Creek Promenade does not move forward with their development. These changes

are solely for circulation as discussed with your staff. We have also relocated the amenities
within the development to provide for the additional street system and to make them more
centrally located.
We hope that the City will be able to identify our hardships as outlined above and grant our
Variance, approving our access to SH 55 as did ITD with mitigating measures. We thank you in

COMMITMENT OF PROPERTY POSTING
Per Unified Development Code (UDC) 11-5A-5D, the applicant for all applications requiring a
public hearing (except for a UDC text amendment, a Comprehensive Plan text amendment
and/or vacations) shall post the subject property not less than ten (l0) days prior to the hearing.
The applicant shall post a copy of the public hearing notice of the application(s) on the property
under consideration.
The applicant shall submit proof of property posting in the form of a notarized statement and a
photograph of the posting to the City no later than seven (7) days prior to the public hearing
attesting to where and when the sign(s) were posted. Unless such Certificate is received by the
required date, the hearing will be continued.
The sign(s) shall be removed no later than three (3) days after the end of the public hearing for
which the sign(s) had been posted.
I am aware of the above requirements and will comply with the posting requirements as stated in
UDC 11-5A-5.

The following is to clarify our development intentions and timing on the SWC of Us tick
and Eagle.
My clients are not speculative developers so we are very mueh at the mercy oftcnant
interest and leasing. We arc actively marketing the property but at this time we do not
have any tenants. Frankly, the laek of access to andll-om Eagle Road has brought leasing
activities to a stand still.
As a development condition 0 f approval, the City of Meridian requires that we provide
cross access to your property across our project to Ustick Road. In the event we proceed
with development we will comply with those terms at that time. We are not in a position
to provide this cross access any earlier than with the development of the property.

Mr. Unger;
In regards to the installation of raised medians, one of the conditions for access approval
provided in our letter dated March 28, 2006; it has been determined this will not be a
requirement of your application. The installation of medians on Eagle Road will be
addressed through our future improvement project for the corridor. As a result, raised
medians are not one of the mitigating measures for access approval. All other conditions
mentioned in our 3/28/2006 letter are still required. If those conditions are acceptable,
please notify us in writing so that approval of your application can go forth; include a set of
your construction plans for Department review & approval prior to permit issuance.
Additionally, prior to final approval of your application, written assurance must be provided
to the Department on the participation with the Eagle Road & Ustick Road intersection
improvements currently under development with the W.H. Moore Company.

Your pennit application was presented to the Idaho Transportation Department (ITO)
executive permits meeting on 3/22/06.
The executive committee concurs with District Three Traffic assessment with regard to
the referenced development and is agreeable to approval of the access permit applica~~n
with the condition that the mitigating measures and considerations as outlined in this IEttter
are provided. "
Mitigating measures:
. Participate in the improvement of the Eagle Road and Ustick Road intersection lO
provide double left turn lanes and right turn lanes .on all approaches.
· Construct auxiliary lanes at propose accesses on Ustick and Eagle Roads.
. Reconfigure parking layout to provide a protected drive aisle at all approaches.
· Construct backage roads as required by the Ada County Highway District & City of
Meridian. .
· Any change to pavement marking shall be with durable pavement marking.
. Installation of median on Eagle Road,
. Relinquishment of other property access rights to Eagle Road.
