Subject: Arnke Subdivision, Deletion of the fencing along the North and East Prope1iy
Lines.
As the owner of2070 W Pine Ave, Meridian and manager of2070 LLC, 1t IS my request
that the vinyl fencing proposed at the North and Eastern property line be changed to
"remain as existing chain link with privacy slats and vegetation vines. "
When this issue was first addressed I was thinking vinyl fence on the "external
boundaries" as the property lines exposed to the street view. The fencing on the east
property line belongs to the Seminary. The fence on the north property line belongs to the
school district and their policy is chain link with privacy slats regardless of what I install.
Needless to say two fences 6 inches apart are not needed. I discussed the replacement of
the existing fence with the owners and they do not want their fence replaced, The
seminary wants a fence gate in lieu of pipe bollards. They do not want their property to
be the short cut into the schoo1. I discussed this issue with Deputy Chief Joseph Silva and
he agreed that a chain link fence would be acceptable in lieu of pipe bollards,
The Developers agreement dated November 9th 2005, recorder # 105191337 does not
specifically identify the required fencing, however it was agreed upon within the
Conditions of Approval dated September 20, 2005 Item 1.1.14 (copy attached)
My specific request is to allow the existing fencing to remain and serve as the north
and east fence for the Arnke Subdivision. 1 will plant vegetation along the fence line
to add esthetic enhancement. Vinyl Fence will be installed along the front (southern
property line as well as west property which are exposed to the street views.
If the vinyl fence is installed along the north and east property line it will only serve as a
collection point for trash and debris to collect. Section 1.1.14 should be modified to
reflect your decision.

1. SUMMARY DESCRIPTION OF APPLICANT'S REQUEST

The applicant, Michael Arnke, has applied for Arulexation and Zoning (AZ), Preliminary Plat (PP), and
Conditional Use Penuit (CUP) approval of 18 building lots and 3 common/other lots on 2.06 acres. The
site is located on the north side of W. Pine Avenue approximately one-quarter of a mile west of Linder
Road. This site is currently rural residential with one single family residential building and accessory
buildings. The site has not been previously platted.
2. SUMMARY OF PLANNING AND ZONING COMMISSION HEARING
. On August 18, 2005, the Planning & Zoning Commission made a recommendation for approval
on the subject applicatioll, as reflected in the Clerk's record and the minutes and duly considered
the evidence and the record in this malter.
. Staff presenting application: Josh Wilson presented the application.
. In favor: Shawn Nickel, applicant's representative and Michael Arnke, applicant
. In opposition: None.

. Key Commission Changes to Staff Reconunendation:
o Accept changes to staff report as outlined in the memo from Josh Wilson, dated August
18, 2005, with the following changes:
. Modify Item #2 to include the requirement for a cross-access agreement with
the LDS church property to the east, prior to submittal of the final plat.
. Modify Item #4 to read "The request for the installation ofa security gate at the
entrance to the service drive from E. Pine Avenue is approved, and the applicant
shall work with Planning and Zoning staff to provide an acceptable escape route
for vehicles that do not have access to the development."

Prior to the City Engineer's signature of a final plat all structures not contained on a designated
lot shall be removed.
A landscape plan shall be submitted prior to final plat shOWing the landscaping in relation to the
changes required by this report.
Other than the changes listed above, the approved landscape plan is not to be altered without
prior written approval of the Planning & Zoning Department.
All road drainage shall be contained on site in the drainage lots as depicted.
Maintenance of all common areas shall be the responsibility of the Arnke Subdivision
Homeowners' Association.
