Interest in Original Development Agreement..
Treehaven, LLC is the developer of The Tree Farm, which has been approved by the City
Council for annexation and zoning of 362.65 acres located north of Chinden Boulevard,
directly west of Spurwinl Country Club (AZ 06-004). The original Development
Aareement was approved by Meridian City Council on September 12, 2006 and recorded
with Ada County on September 21, 2<l>6 (Instrument No. 106151218).
Purpose of Modification.' "
Jayker Nursery will relocate form their current location at 4042 W. Chinden and will
occupy the site at 4740 W. Chinden to continue their operations. The new location area
is zoned as CC (Annexation and zoning approval AZ-06-004, Ordinance No. 06-1263).
The first phase preliminary plat for The Tree Fann development will affect the nursery
and its operations. This is the reason for the relocation at this time.
Treehaven, LLC is requesting a modification to th. current Development Agreement to
permit the installation of a double-wide mobile office building (24' X 64') for use as
office space on the property at 4740 W. Chinden. The existin! home at this location will
not be sufficient to satisfy the officI space and management needs of the nursery, thus the
need for the mobile office building. The nursery operations will share the current access
point off of Chinden Boulevard.
Jayker Nursery has boon in contact with Central District Health Department to discuss the
usage of the existi~ septic tank system at 4740 W. Chinden. The Health Department has
detennined that accessory use:ofthis system is not feasible and will require the
installation of a new system to support the mobile office building. The nursery has
applied for this new system with the Health Department and is awaitini approval of the
application. The application is cOl1tin~ht, of course upon the approval of this request for
modification to the Development Agreement.
Treehaven has leased 20 acres at this address to Jayker Wholesale Nursery, Inc. on a five
(5) year, non-ren.wabhJ l.ase. The nursery would like to place the mobile office building
at the new location in January 2007 until the <!nd ofthe:five year lease, at which time the
nurs~ry will vacate the property and relocate to a more permanent site.

"All future development of the Property shall be in accordance with the UOC as it exists
on the date of this A8reement; provided, however, that uses may be expanded but not
limited by any future amendment to the DOC, and the existing tree farm (nursery) may
continue to operate as it presently exists on the Property, includiD8 all existing structures
and access points. In addition. at a certain time as deemed necessary by the existing tree
