PORTICO PLACE SUBDIVISION

LOCATED ON THE PROPERTY LOCATED AT 1780 EAST MCMILLAN ROAD
Portico, LLC is requesting to subdivide the approximately 5.17 acres located at 1780 E McMillan
Road. The purpose of the subdivision is to divide the property into 26 lots for residential homes and 3
common lots which will result in a density of 5.03 homes per acre. There are companion applications
for Annexation! Rezone and Preliminary Plat.
The surrounding land is as follows:
North: Vacant Land and a short section of Sheridan Place Subdivision
East: Sheridan Place Subdivision
South: McMillan Road and Idaho Power Substation
West: Vacant Land and Two Single Family Homes; It is our understanding that a commercial
project is being proposed at the northeast corner of Locus Grove and McMillan.
CONCEPT
The subdivision is to have 26 buildable lots on 5.17 acres with an existing home to remain on Lot 17
Block 1. A large Common Area has been designed for the center of the project.
AL TERNA TIVE COMPUANCE
The City has designated McMillan Road as a Gateway Street which the code stipulates as a 35 foot
wide landscape buffer. Because a 35 foot landscape buffer would come within inches of the existing
home, Portico, LLC is requesting an Alternative Compliance to make the landscape buffer 25 feet
wide on the south side of the home where it faces McMillan. Because a large living room widow,
some bedroom windows and the front door face McMillan, we are requesting a 10 foot set back rather
than a 4 foot since it will create more privacy for the home and more room for better access. We
would then identify the west side of the home which faces Beethoven to be the front of the house.
This would leave the McMillan or home's south side as a side yard with a minimum set back of four
feet. For public safety, we have angled the fence at 45 degrees to prevent any places where someone
could hide.
As an alternative, Portico purposes to do additional landscaping the entire length of the McMillan
landscape buffer. Portico is purposing to plant 42 additional shrubs and an additional 3 trees over and
above code requirement.
If the Alternative Compliance is not granted the set backs to the existing home would not meet
Unified Development Code set back requirements.
Because Portico, LLC is requesting that the current resident Mrs. Buckley be able to continue having
direct access from McMillan Road to her garage, two landscape plans have been submitted. When she
not longer lives in the home the direct access would be eliminated.

Mrs. Buckley has lived in the home for almost thirty years and is legally blind. Even though she can
n~t drive she is requesting that her home not be modified until she can no longer live there. She
knows where everything is located and does not want any changes. Portico, LLC at one time proposed
to relocate her garage doors to the west side of her garage, but she declined because she did not want
any changes or her home disrupted by construction.
One of the landscape plans shows the landscaping with the direct access to McMillan and is labeled
"Sheet Number L 1.1, McMillan Access." A second plan showing the landscaping with the McMillan
access eliminated and is labeled "Sheet Number L1.2, No McMillan Access." '"
In purposing the McMillan access for Mrs. Buckley, one of the issues that must be resolved is a how
the City will know when Mrs. Buckley no longer lives in the home. To address this we recommend
that Portico bond for the elimination of the McMillan access and the addition of landscaping. Since
Portico owns the home, it would know when Mrs. Buckley moves from the home. And Portico would
be motivated to have the bond released. If approved Portico would ask that these improvements not
be a requirement prior to the signing of the final plat, buildi~ permit applications or Certificates of
Occupancy.

DESIRABILITY OF THE REZONE

This application is requesting the rezone to allow medium density residential housing on this parcel
of land. The property is near the corner of Locus Grove and McMillan. We have received a
notification of a neighborhood meeting to develop that corner as a commercial project. With a
commercial project to the west and low density residential housing to the east, Portico Place would
provide a transition between the two uses.
Even if this proposed commercial project does not move forward it seems likely that some type of
commercial use would be developed on that corner.
PLAN CONFORMITY

City of Meridian Comprehensive Plan, July 2002
Goal V: Offer a diversity of housing types for a greater range of choice. Objective A:
Encourage quality housing for all economic levels in a variety of areas.
The requested zoning change allows the project to provide a ranle ofhousi~ that is
not widely available in this area of Meridian. The change of zoning to R-8 allows the
project to develop smaller lots with good quality with homes. The density is
proposed to be 5.03 homes per acre which is at the lower end of what is allowed in
Medium Density Residential (4 to 8 homes per acre).

The Future Land Use Map identifies these parcels as being Low Density Residential
(R-4). As allowed, a single step up to Medium Density Residential (R-8) is consistent
with the Future Land Use of these parcels.

NEIGHBORHOOD MEETING
Invitations for a neighborhood meeting were sent to 28 neighbors on September 18 for a meeting held on
September 27. No one attended the meeting. However, one phone call was received from Gibson Homes,
who had purchased a number of the adjacent lots in Sheridan Place Subdivision. The caller did not have
any objections to the proposed project.
LOT AREA, SETBACKS, BUILDING HEIGHTS AND STREET FRON.T AGE

With the approval of the Alternative Compliance, the lots areas, setbacks, building height and street
frontage will be in compliance with the City of Meridian Unified Development Code for Medium-Density
Residential District (R-8).

There will be.31 acres of use able open space which is 6.0% of the subdivision. UDC requirement i~ 5 %.
There is an additional .25 acres of open space for landscaping which brings the total open space to 10.8%.
The &enities include a central common area with extensive landscaping and a number of pathways
leading to a Gazebo.
SERVICES
The homes in the proposed subdivision would all be connected to City of Meridian water and sewer
servIces.

RE: Soil test holes on Portico Place Subdivision site
On November 12,2004 three test holes were excavated on the site of the above
referenced property. Two of the test holes were located in the proposed road
right of way to be evaluated for load bearing capability. These holes were
excavated to a depth of approximately 5 feet. The other hole was located in the
proposed area of a storm drain facility and was excavated to a depth of 14 feet.
This soil profile was also utilized in evaluation of the site for roadbed
construction.
Test hole RI-04 had a silty clay loam texture with an estimated 27 to 30 percent
clay in the 11 to 23 inch zone of the profile. This layer was sampled for R-
value testing ~d should represent the south half of the parcel. Test hole R2-04
is locatedlllear the north boundary of the property and has a silty clay loam soil
with 35 to 40 percent clay. This layer was also sampled to represent the north
part of the property.
Samples were delivered to the Materials Testing & Inspection lab for testing.
Those sample results are displayed in the table below. The 200 PSI design
values are included in the table. Copies of the MTI test results are attached.

Both test values are quite low and will likely require a full roadbed section be
constructed to provide suitable bearing strength. Test hole THI-04 also has a
silty clay loam layer at 18 inches with an estimated 30 to 32 percent clay which

is very similar to the tested samples and helps support those values. A 200 PSI
design value of no more than 10 should be utilized for the entire project.
Test hole THI-04 was placed to evaluate for storm drain suitability. No free
water or evidence of wetness was observed in the pit to a depth of more than 14
feet. Three test holes measured on the property just east of Portico Place were
dry to a depth of 15 feet for a entire 2003 irrigation season. Some 20 other test
holes within ~ mile of the site also remained dry to 15 feet. Based on that data
and characteristics in this profile, I would not expect any free water above a
depth of 15 feet on this property.
