Counsel from Kurt is that a plat amendment is required to remove the easement because it was created by a
plat. He further counseled that Water/Public Works must agree to the easement vacation in writing. He did not
think that anything formal was needed to express that agreement,so this email should suffice and you could
attached it when you submit your application in PDox.
So,to that end, Public Works does agree to the vacation of the portion of the water easement over Smitchger
Subdivision North depicted on the attached document and exhibit,which is the east/west portion of the
easement near the northern boundary(approximately 490 feet long and 24 feet wide containing.23 acres).
