Subject: Response to Staff Report—965 E Ustick Road (AZ H-2024-0063)
Dear Planning & Zoning Commissioners,
We respectfully propose the following restriction as an alternative to the limitation to
"professional services" recommended in the Staff Report:
(Alternative Restriction)
The City and Property Owner shall enter into a written development agreement
whereby the parties agree that the property shall not be used as a church, daycare,
food service business, or for educational use.
The Staff Report asserts that the term office use in the Comprehensive Plan refers exclusively
to professional services as defined in the Unified Development Code (UDC 11-1A-1).
However, we believe a closer reading of the Comprehensive Plan supports a broader
interpretation. The relevant section of the Plan states:
"At the discretion of City Council, areas with a Residential Comprehensive Plan
designation may request an office use if the property only has frontage on an
arterial street or section line road and is two acres or less in size."
Significantly, the Comprehensive Plan also defines Office Land Uses as follows:
"This designation will provide opportunities for low-impact business areas. These
uses would include professional offices, technology and resource centers; ancillary
commercial uses may be considered (particularly within research and development
centers or technological parks). Sample zoning includes L-O[Limited Office]."
Further, the proposed zone is Limited Office, which suggests that the zone already determines
what is appropriate as an office use. We propose additional restrictions on that zoning via a
development agreement, in the spirit of ensuring compatibility with the adjacent properties.
The proposed alternative ensures that all office uses and not only those which count as
professional services would be allowed. This includes doctor and dentists offices, mortgage and
lending offices, as well as other appropriate uses, e.g. salons.
