Dear Mrs. Canning,
Please accept the attached application to rezone lots 41-45, Block 49 of Lochs a Falls
subdivision from R-4 to C~N, as well as an application to .modify the Conditional Use
Permit particular to these parcels that required an additional detailed Conditional Use
Permit for any use placed on this property.
As you know, many planned developments were processed in the early nineties that
required all properties, regardless of their intended use, to be annexed under an blanket
land use zoning designation, in this case all of the commercial properties in Lochsa Falls
were annexed with an R-4 zoning designation~ This .was, and continues to be a confusing
issue for prospective buyers, sellers and anyone involved in the development of land in
Meridian. The land has always been intended for use as commercial/offi.ce land and
should be zoned as such to avoid confusion.
Furthermore, with the adoption of a new and appropriate zoning designation, the property
should be allowed to develop in accordance with the Unified Development Code and not
be subject to the requirement of additional public hearings unless justified by the
requirements of the Unified Development Code. We are not seeking to avoid staff level
design review and are supportive of this requirement~ Staffinformed me that this would
still be requirement at the pre-application meeting held for this re-zone~
The C- N zone will allow the approval of small-scale retail uses, as well as office uses
under the direction of a staff level Certificate of Zoning Compliance~ This process will
reduce the number of unnecessary public hearings for both the Planning and Zoning
Commission and prospective buyers of the subject properties~
