Vista Ave., Ste. 206 Boise, ID 83705 RE: Pura Vida Ridge Ranch – Preliminary Plat & Planned Unit Development Time Extension (TED- 2022-0009) Dear Ms. Canning: This letter is to confirm that the Director approved the application you submitted for a two (2) year time extension on the preliminary plat and the planned unit development for Pura Vida Ridge Ranch in order to commence the permitted use and obtain the City Engineer’s signature on a final plat on or prior to January 19, 2025. The Applicant, Director, or a Party of Record may request City Council review of a decision of the Director. All requests for review shall be filed in writing with the Planning Division of the Community Development Department on or before December 30, 2022, within fifteen (15) days after the written decision is issued, and contain the information listed in UDC 11-5A-6B. If City Council review of the decision is not requested, the action of the Director represents a final decision on a land use application. Lake Hazel Rd., in the NW ¼ of Section 4, T.2N., R.1E. I. PROJECT DESCRIPTION Request for a two (2) year time extension on the preliminary plat and planned unit development (H-2020-0064) for Pura Vida Ranch Subdivision in order to obtain City Engineer’s signature on the first phase final plat (FP-2021-0043) and commence the permitted use. II. APPLICANT INFORMATION A. Applicant: Anna Canning, Centurion/B & A Engineers – 2323 S. Vista Ave., Ste. 206, Boise, ID 83705 B. Owner: Pacific Rim Builders – 9171 W. State St., Garden City, ID 83714 C. Representative: Same as Applicant III. STAFF ANALYSIS The preliminary plat and planned unit development (PUD) (H-2020-0064) for this project was approved by City Council on January 19, 2021 and is valid for two (2) years, until January 19, 2023. The preliminary plat consists of 157 building lots and 35 common lots on 26.34 acres of land in the R-8 and R-15 zoning districts. A final plat (FP-2021-0043) for the first phase of development was approved on October 26, 2021, which was later modified (MFP-2022-0001) on May 3, 2022. The PUD included deviations to certain UDC standards as noted in the approved Findings. STAFF REPORT COMMUNITY DEVELOPMENT DEPARTMENT Page 2 The Applicant requests approval from the Director of a two (2) year time extension in order to obtain the City Engineer’s signature on the first phase final plat and commence the permitted use. The Applicant’s narrative states the project has been delayed for several reasons, including the following: continued coordination with ACHD on the drainage issues associated with the site; completion of bridge improvements associated with the culvert for Ten Mile Creek drain where it passes under Lake Hazel Road that are the responsibility of the developer of the property to the north (Orchard Creek); vertical construction isn’t allowed until the bridge is constructed and floodplain development requirements are met; and the design of the roads for the subdivision is contingent upon the bridge construction and resulting changes in the floodplain and a lengthy approval process is anticipated with ACHD on the construction plans. With all extensions, the Director may require the preliminary plat and planned unit development to comply with the current provisions of this title. Because the amount of qualified open space approved with the preliminary plat (i.e. 4.9 acres) and site amenities exceed the current standards, and there are no other applicable updated provisions, Staff is not recommending any additional conditions of approval for this extension. The Applicant must continue to comply with all existing conditions of approval associated with this development. IV. DECISION Staff: Staff recommends approval of the requested two (2) year time extension on the preliminary plat and planned unit development to expire on January 19, 2025. Page 3 V. EXHIBITS A. Applicant shall comply with all terms of the annexation and zoning (Development Agreement Inst. #2021-042520), preliminary plat, planned unit development (H-2020-0064), final plat (FP-2021-0043) and final plat modification (MFP-2022-0001). 2. The applicant shall obtain the City Engineer’s signature on the final plat and commence the permitted use by January 19, 2025 in accord with UDC 11-6B-7 in order for the preliminary plat and planned unit development to remain valid; or another time extension may be requested.
