These conditions shall be considered in full, unless expressly modified or deleted by motion of the Meridian City Council: APPLICATION SUMMARY & LOCATION The applicant, TBID-MOBI-SL, LLC, has applied for short plat approval of 12 condominium units in 1 existing office building, on 1 existing building lot that contains 7.68 acres in an L-O zone for Touchmark Medical Condominiums. This site was previously approved for a Conditional Use Permit (CUP-03-040), Final Plat (FP-02-006) and Certificate of Zoning Compliance (CZC-03-071) for the existing building. The applicant must also comply with the conditions of all previous approvals for Touchmark Living Centers. Touchmark Medical Condo Subdivision is located on the south side of E. Louise Drive, approximately ~ ofa mile east ofS. Eagle Road at 3525 E. Louise Drive, in the northwest ~ of Section 16, T.3N., R.IE. The subject property meets all of the applicability requirements as stated in UDC 11-6B-5A and is eligible to be processed as a short plat. Staff recommends approval of Touchmark Medical Condominiums Short Plat with the comments and conditions stated in this report. REQUIRED FINDINGS FROM UDC 11-6B-6 In consideration of a short plat, the decision-making body shall make the following findings: A. The plat is in conformance with the Comprehensive Plan; The Comprehensive Plan designates the future land use of this property as Mixed Use Community. The current zoning district of the proposed condominium plat is L-O (Limited Office District). The proposed plat complies with the Comprehensive Plan. B. Public services are available or can be made available and are adequate to accommodate the proposed development; Staff finds that public services are available to accommodate the proposed plat. Water and sewer services have already been stubbed to this pad. The adjacent public roadways have been completed to the required design and approach standards. C. The plat is in conformance with scheduled public improvements in accord with the City's capital improvements program; Staff finds that the short plat will not require the expenditure of capital improvement funds. All sewer and water extension for this area were planned to be developer driven. All required utilities are either in place or will be the responsibility of the developer. D. There is public financial capability of supporting services for the proposed development; Staff finds that the plat will not require major expenditures for providing supporting services. The developer and/or future unit owners will finance the extension of sewer, water, utilities and pressurized irrigation to serve the proj ect. The primary public costs to serve the future residents will be fire and police services. E. The development will not be detrimental to the public health, safety or general welfare; and Staff does not believe that traffic and noise will increase with the approval of this plat and further, staff does not believe that the traffic from this site will be detrimental to the general welfare of the public in the surrounding area. Staff finds that the platting of this building will not involve uses that will create nuisances that would be detrimental to the public health, safety or general welfare. F. The development preserves significant natural, scenic or historic features. Staff is not aware of any significant natural, scenic or historic features associated with the approval of this plat that the Director and City Engineer should be aware of. PLANNING & PUBLIC WORKS DEPARTMENT - SITE SPECIFIC CONDITIONS 1. Civil plans have already been approved on this site. 2. Please contact Tricia Bieren, Addressing Specialist, at 898-5500 regarding suite level addressing. 3. Revise or add the following notes on the face of the plat: 4.) Include instrument number of the referenced recorded document. 4. Revise the Domestic Water Service Origin Statement in the Certificate of Owners to reference the City of Meridian instead of United Water. 5. Comply with all conditions of the Ada County Highway District as they relate to this short plat. 6. Staffs failure to cite specific ordinance provisions of the Unified Development Code does not relieve the applicant of responsibility for compliance. GENERAL CONDITIONS 1. Applicant shall be required to pay any applicable Public Works development plan review, and construction inspection fees, as detennined during the plan review process, prior to signature on the plat. Compaction test results must be submitted to the Meridian Building Department for all building pads receiving engineered backfill, where footing would sit atop fill material. 3. Plat approval shall be subject to the expiration provisions set forth in UDC 11-6B-7. 4. All development features shall comply with the Americans with Disabilities Act and the Fair Housing Act. POLICE DEPARTMENT COMMENTS 1. None. FIRE DEPARTMENT COMMENTS 1. The fIrst digit of the Apartment/Office Suite shall correspond to the floor level. 2. Occupancy will require passing a [mal fire inspection.
