Enclosed is a Miscellaneous Application for adjustment of the area of impact between the
Cities of Meridian and Boise. As background information, Winston Moore owns 57.84
acres ofland at the northwest comer of Us tick and Eagle Road. Ofthis total area,
approximately 12.23 acres are in the Boise City limits and the balance is in the City of
Meridian impact area. I have enclosed a site map illustrating the impact line separating the
two jurisdictions,
With this application Winston Moore is requesting that the 12.23 acres be included in the
Meridian impact area. Mr. Moore prefers to have all the land within one jurisdiction and
the logical choice is Meridian. This concept was presented to the Meridian City Council at
their July 16, 2002 meeting (see letter dated June 19,2002) , at which time the Council
approved a Utility Will Serve Letter for all ofMr. Moore's land. This included servicing
the land within Boise, if the area of impact was modified.
This request for area of impact modification was also reviewed by Mayor Coles and the
Boise City Council. As the attached letter from Mayor Coles states, the Council
"concluded that it was a fair and reasonable request" to modify the area of impact and
directed Mr. Moore to begin the formal approval process.
We believe this will be a very beneficial move for the City of Meridian, and we look
forward to assisting staff in accomplishing this modification. Please let me know if you
need future information regarding this request.

Dear Mayor and Council Members:
Winston Moore owns three contiguous parcels of unimproved land at the northwest quadrant of Ustick and
Eagle Road, which total approximatety 57.84 acres. Mr. Moore has acquired this land with the intent of
developing a business park with an interior road system. Of this total land area, approximately 12.23 acres
are in the Boise City limits and the balance is in the City of Meridia,n impact area. I have enclosed a site
map illustrating the impact line separating the two jurisdictions.
Given this somewhat unusnal situation, we asked Mayor Coles and the Boise City Council for their opinion
on adjusting the impact line so that all of Mr. Moore's land is solely in the Meridian area of impact
Simply put, we asked Boise to transfer the 12.23 acres of the impact area to the City of Meridian. Mayor
Coles and the City Council have reviewed Our request and feel it is "fair and reasonable" to adjust the
impact line (see attached letter from Mayor Coles). ptease bear in mind their decision' was not a formal
approval, but is their position regarding commencing a formal approval process.
With the understanding that Boise will not oppose transferring this land to the Meridian area of impact, we
are now submitting this letter requesting Meridian's preliminary feedback on accepting this land, and also
providing a Will Serve Utility Letter for the entire 57.84 acres ofland.
The basis for requesting the Will Serve Letter is this land is in the Meridian's area of impact but not within
the City limits. We understand the City generally requires the land be armexed before water and sewer
services are provided to the landowner. However, at this time there is no adjoining land within the City
limits; therefore, there is no path for armexation. We are certainly witling to support annexation when it
becomes available, and in fact are willing to make this an irrevocable condition to the City issuing a Will
Serve Letter. (As a side note, Pinnacle Engineers has detennined the proposed Ustick sewer line can serve
the entire 57.84 acres, which includes the 12.23 acres.) With respect to utilities, water is in Ustick and as
we Wlderstand it, sewer should be available by the fIrst of next year.
Winston Moore envisions a first class business park at the intersection of Ustick and Eagle and hopes to
submit a development application to the County under the assumption sewer and water will be available to
the site. However, without the City of Meridian's cooperation our hands are tied and the best we can do is
farm the land in the Meridian area, and since Boise can provide utilities to their land, submit a development
application for the 12.23 acres. We hope you will assist us in developing a quality project in Meridian.
Assuming the Mayor and Council respond favorably on both the impact line. modifIcation and Will Serve
Letter, we will begin the formal approval process with Meridian, Boise and Ada County to adjust the area
of impact boundary.

Re: Request to Renegotiate the Boise City Area oflmpacr Boundary
Dear Commissioners:
W. H. Moore Company recently requested input from the Boise City Council on a proposal to remove
approximately 12 aCres of a 58-acre parcel from theBoise City Area oflmpact aodthe incorporated area ofih.
City. The subject property is located on the northwest corner of Eagle and Ustick Roads. Approximately 12
acres in the northeast comer of the property are within the Boise Area oflmpactand.corporatc limits, while the
balance is within the Meridian Area of Impact The owner plans to develop a b~siness park and prefers that all
of the property be within one city jurisdiction.
The Council reviewed the request on February 13,2001 and concluded that it was afair and reasonable request
and it would be appropriate to submit the request to Ada County. The OWner has been advised that the governing
boards of Ada County and Boise City must hold a negotiation meeting and if agreement is reached, the actual
boundary change must go through the hearing process by each jUrisdiction.
In accordance with lbe Ada County-Boise City Area ofImpact Agreement andIdaho Code Sectiorl67-6526(d),
Boise City hereby request a meeting to renegotiate the Boise City Area of Impact boundary as requested by lhe
W. H. Moore Company. In accordance with lhe renegotiation process, a meeting shall occur within 30 days of
receipt of this request.
To facilitate a timely renegotiation meeting, this issue can be placed on the City Council n.oon meeting agenda
for Felmmry27, 200 I, if that time and date is convenient for the Commissiollers.
If tho Commissioner's schedule does not allow a meeting at that time, please let me know a date and time that
will work for you.
